{"id":100497,"date":"2017-10-23T12:00:51","date_gmt":"2017-10-23T11:00:51","guid":{"rendered":"https:\/\/www.transcend.org\/tms\/?p=100497"},"modified":"2017-10-17T15:12:46","modified_gmt":"2017-10-17T14:12:46","slug":"rohingya-crisis-ruled-as-genocide-by-permanent-peoples-tribunal","status":"publish","type":"post","link":"https:\/\/www.transcend.org\/tms\/2017\/10\/rohingya-crisis-ruled-as-genocide-by-permanent-peoples-tribunal\/","title":{"rendered":"Rohingya Crisis Ruled as Genocide by Permanent Peoples\u2019 Tribunal"},"content":{"rendered":"<div id=\"attachment_100498\" style=\"width: 710px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar.jpg\" ><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-100498\" class=\"wp-image-100498\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar.jpg\" alt=\"\" width=\"700\" height=\"308\" srcset=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar.jpg 1000w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar-300x132.jpg 300w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar-768x338.jpg 768w\" sizes=\"auto, (max-width: 700px) 100vw, 700px\" \/><\/a><p id=\"caption-attachment-100498\" class=\"wp-caption-text\">Ali MC<\/p><\/div>\n<p><em>17 Oct 2017 &#8211; <\/em>In September, the International Permanent Peoples\u2019 Tribunal ruled the current Rohingya crisis as unequivocally genocide, denouncing the United Nation\u2019s use of the term ethnic cleansing as a \u201ceuphemism\u201d with \u201cno basis in international law.\u201d<\/p>\n<p>After a week-long hearing at the University of Malaya, Judge Daniel Feierstein stated that the Myanmar Government was guilty of \u201cwar crimes, crimes against humanity and genocide\u201d.<\/p>\n<p>War crimes listed included arbitrary arrest and torture; enforced disappearances; rape; killing; confiscation of property; and internal displacement.<\/p>\n<p>The Tribunal also affirmed that the election of Aung San Suu Kyi\u2019s National League for Democracy had only brought about an \u201cacceleration\u201d of human rights abuses, and in was an attempt to turn Myanmar into a \u201csupreme Buddhist entity.\u201d<\/p>\n<p>Throughout the week, expert witnesses and victims of human rights abuses testified to the Peoples\u2019 Tribunal, which began a grassroots initiative in 1979 to denounce the crimes of Latin American dictators.<\/p>\n<p>The Tribunal heard that ongoing human rights abuses have been committed not only against the Rohingya, but also other ethnic and religious minorities, including the <a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2017\/01\/16\/burma-kachin-christians-feared-disappeared\" >Kachin people<\/a> and other Muslim groups.<\/p>\n<p>Testimonies included harrowing eye-witness accounts of mass rape of Rohingya women and the systemic slaughter of Rohingya men and boys.<\/p>\n<p>This included the massacre at Tula Toli, a Rohingya village near the border of Myanmar and Bangladesh.<\/p>\n<div id=\"attachment_100499\" style=\"width: 310px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar2.jpg\" ><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-100499\" class=\"wp-image-100499 size-medium\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar2-300x199.jpg\" alt=\"\" width=\"300\" height=\"199\" srcset=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar2-300x199.jpg 300w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar2-768x509.jpg 768w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar2-1024x679.jpg 1024w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar2.jpg 1565w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><p id=\"caption-attachment-100499\" class=\"wp-caption-text\">Mr Lazum Jimmy Phang provided evidence of the ongoing war crimes perpetrated against by Kachin people in the north of Myanmar.<\/p><\/div>\n<p>Razia Sultana, a Rohingya lawyer based in Chittagong, showed video interviews conducted with women from Tula Toli. In the video, one Rohingya woman tearfully described the massacre, explaining that the villagers were told by authorities not to leave Tula Toli and that they would be safe.<\/p>\n<p>Instead, she describes how the Myanmar Army descended by helicopter and surrounded the village. They then proceeded to systematically rape the women, killing and burning women, children and men.<\/p>\n<p>\u201cNothing was left of the women \u2026 mutilated bodies were chopped up and set on fire \u2026 oh, there was a massacre in Tula Toli,\u201d the woman exclaims.<\/p>\n<div id=\"attachment_100500\" style=\"width: 310px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar3.jpg\" ><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-100500\" class=\"size-medium wp-image-100500\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar3-300x199.jpg\" alt=\"\" width=\"300\" height=\"199\" srcset=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar3-300x199.jpg 300w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar3-768x509.jpg 768w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar3-1024x679.jpg 1024w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar3.jpg 1565w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><p id=\"caption-attachment-100500\" class=\"wp-caption-text\">Razia Sultana, a lawyer from Chittagong, gave harrowing first-hand witness accounts of Rohingya women who had experienced sexual violence.<\/p><\/div>\n<p>Tactics, such as the promise of safety, were also used by Hutu militia in the Rwandan genocide of 1994, in order to herd Tutsi people into kill zones, such as churches.<\/p>\n<p>In fact, parallels between the Rwandan genocide and the current crisis were noted during the Tribunal.<\/p>\n<p>Founder and chairmen of Genocide Watch, Dr Gregory Stanton, explained a 10-stage process of genocide, which includes classification, such as the use of ID cards, dehumanisation, preparation and planning, and persecution.<\/p>\n<div id=\"attachment_100501\" style=\"width: 510px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar4.jpg\" ><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-100501\" class=\"wp-image-100501\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar4-1024x679.jpg\" alt=\"\" width=\"500\" height=\"331\" srcset=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar4-1024x679.jpg 1024w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar4-300x199.jpg 300w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar4-768x509.jpg 768w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar4.jpg 1565w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\" \/><\/a><p id=\"caption-attachment-100501\" class=\"wp-caption-text\">A delegation of witnesses who provided testimony to attacks committed against Myanmar Muslims in other parts of the country, including the 2013 massacre in Meitkila.<\/p><\/div>\n<p>This process, he said, amounted to genocide, which, under the Genocide Convention, is defined as \u201cthe intent to destroy, in whole or in part, a national, ethnical, racial or religious group\u201d.<\/p>\n<p>Evidence of intent included a 1988 policy of the Myanmar Government to deny Rohingya citizenship, and that \u201cany property must be confiscated and redistributed amongst the Buddhist population\u201d.<\/p>\n<p>Dr Stanton explained that the term ethnic cleansing was actually coined by former Serbian President Slobodan Milosevic, who faced charges of war crimes in 1999.<\/p>\n<p>Unlike the Genocide Convention, there are no international legal instruments that address ethnic cleansing; as such, use of the term in the international sphere was said to be redundant.<\/p>\n<div id=\"attachment_100502\" style=\"width: 260px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar5.jpg\" ><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-100502\" class=\"wp-image-100502\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar5-199x300.jpg\" alt=\"\" width=\"250\" height=\"377\" srcset=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar5-199x300.jpg 199w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar5-768x1159.jpg 768w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar5-679x1024.jpg 679w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2017\/10\/permanent-people-tribunal-rohingya-burma-myanmar5.jpg 1037w\" sizes=\"auto, (max-width: 250px) 100vw, 250px\" \/><\/a><p id=\"caption-attachment-100502\" class=\"wp-caption-text\">Dr Gregory Stanton, founding president of Genocide Watch, gave a detailed account of the definition of genocide, and the difference between ethnic cleansing.<\/p><\/div>\n<p>The Tribunal sessions were heavily guarded by Malaysian police, most notably due to the presence of outspoken Burmese activist Dr Maung Zarni.<\/p>\n<p>Dr Zarni\u2019s great Uncle was a collegiate of Aung San Suu Kyi\u2019s father; he is related to many Burmese currently in positions of power.<\/p>\n<p>Yet, due to his outspoken opposition to the regime, he has been labelled a traitor and <a target=\"_blank\" href=\"http:\/\/www.maryscullyreports.com\/the-pro-genocide-irrawaddy-honors-maung-zarni-by-calling-him-enemy-of-the-burmese-state\/\" >an enemy of the state<\/a>.
