Or are they illegal occupiers?\u00a0A group of Israeli settlers made the move, to seize land in East<a target=\"_blank\" href=\"https:\/\/en.wikipedia.org\/wiki\/Hebron\" >\u00a0Hebron<\/a>\u00a0(al-Khalil) last\u00a0<a target=\"_blank\" href=\"http:\/\/english.wafa.ps\/page.aspx?id=4TLFRUa96770438028a4TLFRU\" >Monday<\/a>\u00a0(26 Mar 2018), setting up camp \u2013 adjacent to the \u2018Kharsina settlement\u2019 \u2013 backed by an entourage of heavily armed soldiers. This move threatens three Palestinian families, with fears that they will soon be dispossessed of their land and homes. Those at risk of being cleansed and their property stolen, are the Eida, Jwihan and the al-Halawa families. The initiative to take this land came from the settlers themselves, who now occupy the 70-dunums. The settlers are living in four newly purchased caravans.<\/p>\n<p>The above example clearly illustrates the way in which illegally established settlements, in the West Bank, come to their fruition.<\/p>\n<p>Most people do not understand the true nature of Israel\u2019s settlers, many granting settlers the same status that regular Israelis \u2013 living within Israel\u2019s internationally accepted borders \u2013 have.\u00a0\u00a0The point that will be challenged in this article, is an Israeli settlers status as a \u201ccivilian\u201d.<\/p>\n<p>The fact of the matter is that West Bank settlers are completely illegal. With the continuing development of West Bank settlements, Israel is currently violating several United Nations resolutions, including the latest\u00a0<a target=\"_blank\" href=\"https:\/\/www.un.org\/press\/en\/2016\/sc12657.doc.htm\" >resolution 2334<\/a>, which called for the state to completely dismantle its settlements and withdraw its citizens.<\/p>\n<p>One of the most important<a target=\"_blank\" href=\"https:\/\/www.icrc.org\/eng\/resources\/documents\/misc\/634kfc.htm\" >\u00a0duties listed of an occupying power<\/a>\u00a0\u2013 according to the \u20181907 Hague Regulations\u2019 and the \u2018Fourth Geneva Convention\u2019, as well as within provisions of \u2018Additional Protocol I\u2019 and \u2018Customary International Humanitarian Law\u2019 \u2013 is that the occupying power, does not transfer its population into the occupied territory:<\/p>\n<p>\u201cThe Occupying Power shall not deport or transfer parts of its own civilian population into the territory it occupies.\u201d \u2013 Fourth Geneva Convention (Article 49)<\/p>\n<p>According to International Law, it is clear that Israeli settlers illegally occupy the land on which they live. Regardless of whether it was their own initiative to participate in illegal colonies or not, the settlers are committing a crime. The key question to ask about the ongoing settlement campaign, however, is; are settlers, who are actively committing a crime, whether on behalf of their government or not, to be classed as a \u201ccivilian\u201d?<\/p>\n<p>Is someone who is participating in harassing, killing, aiding the occupation army and changing the demographics of the West Bank, to be classed as a civilian? Are Israeli settlers to be classified the same way as someone living in territory internationally recognized as \u2018the state of Israel\u2019?<\/p>\n<p>In 1968 the Israeli government prohibited previously \u201cunregistered land\u201d from being registered, they have \u2013 since then \u2013 declared, at least, 28% of the West Bank as \u201c<a target=\"_blank\" href=\"https:\/\/www.btselem.org\/publications\/summaries\/201203_under_the_guise_of_legality\" >State land<\/a>\u201d. This is one way in which the Israeli government has used settlers, to heist land.<\/p>\n<p>As of the \u2018<a target=\"_blank\" href=\"https:\/\/www.cnn.com\/2013\/09\/03\/world\/meast\/oslo-accords-fast-facts\/index.html\" >Oslo Accords<\/a>\u2019 of 1993, the West Bank has been divided into three main areas \u2013 \u2018Area A\u2019, \u2018Area B\u2019 and \u2018Area C\u2019 \u2013 in \u2018Area C\u2019, which was supposed to constitute 61% of the West Bank, Israel maintains a full military occupation. (AP\/Ariel Schalit)<\/p><\/div>\n<p><strong>How Does Israel Take Land: Settlements and Outposts<\/strong><\/p>\n<p>In order to really get to the heart of the settler issue and to properly classify them, it is essential that we understand how these settlements are first established.<\/p>\n<p>A lot of the language surrounding this issue makes things complicated, so let\u2019s get a basic understanding of what\u2019s going on. \u2018Settlements\u2019 are defined by the Israeli government as a colony, that they classify as legal and have become a part of a government initiative. Israeli outposts are just settlements that are unofficial, to the Israeli government.<\/p>\n<p>An outpost is how most settlements start. Israeli citizens simply decide to move somewhere and set up camp, then, later on, the Israeli government recognizes the outpost as a legitimate settlement.<\/p>\n<p>As soon as settlers set up their \u2018outpost\u2019, the Israeli army will guard them and the Israeli government will supply them with all the essentials to build a settlement with (water systems, military protection, electricity etc.). This scenario should sound familiar, as the case used at the start of the article illustrates this point also.<\/p>\n<p><strong>Two Types of Settlers?<\/strong><\/p>\n<p>The next level of analysis would be to ask whether the settlers of the \u2018outposts\u2019 are different from those living in \u2018settlements\u2019. Settlers of the outposts have stolen this land out of their sheer willingness to do so, this is not strictly a state mission, but rather something the state works with the settlers to achieve its aims.<\/p>\n<p>So if \u2018outpost\u2019 settlers are acting on their own and not as a result of the state, then are we to view them as civilians? The aim of the settler projects, \u2018outpost\u2019 and \u2018settlement\u2019, is to colonize the land. Acquiring land through war is, of course, illegal and the most tasked job, within the occupation, is guarding settlers and settlements.<\/p>\n<p>The settlers are the occupation, more so than the soldiers. Most soldiers only occupy for a few years and at the demand of the government, not their own will.<\/p>\n<p>Another thing to take into consideration is that settlers physically deprive the native Palestinians of their basic requirements. The human rights organization \u2018al-Haq\u2019, found that<a target=\"_blank\" href=\"https:\/\/electronicintifada.net\/blogs\/adri-nieuwhof\/israeli-settlers-use-six-times-more-water-palestinians-new-report\" >\u00a0Israeli Settlers in the West Bank, use as much as 6 times more water than Palestinians<\/a>. That same study also found that whilst Palestinians lived on an average of 73 liters (per day, per capita), which is below the recommended standard amount, according to the \u2018World Health Organization\u2019. Israeli Settlers were even found to have been using more water than people living inside of the state of Israel itself.<\/p>\n<p>About<a target=\"_blank\" href=\"https:\/\/www.btselem.org\/settlements\" >\u00a0fifty percent<\/a>\u00a0of the West Bank has been annexed due to settlements. Through the usage of Settlement Israel also operates its exploitation of the West Banks resources. Even 90% of the West Bank\u2019s water is stolen from underneath the Palestinians, primarily by a company called<a target=\"_blank\" href=\"http:\/\/stopmekorot.org\/\" >\u00a0Mekorot<\/a>. The settlers occupy the land, steal from it, commit violent harassment (even murder) against the Palestinians, as documented by the<a target=\"_blank\" href=\"https:\/\/palsolidarity.org\/\" >\u00a0ISM<\/a>,<a target=\"_blank\" href=\"https:\/\/www.cpt.org\/\" >\u00a0Christian Peacemaker Teams<\/a>, and<a target=\"_blank\" href=\"https:\/\/www.btselem.org\/\" >\u00a0B\u2019Tselem<\/a>\u00a0on a regular basis.<\/p>\n<p>If we look to the \u2018United Nations General Assembly Resolution A\/RES\/33\/24 on 29 November 1978\u2019, it:<\/p>\n<blockquote><p>\u201cReaffirms the legitimacy of the struggle of peoples for independence, territorial integrity, national unity and liberation from colonial and foreign domination and foreign occupation by all available means, particularly armed struggle\u201d.<\/p><\/blockquote>\n<p>If illegal settlers inside the West Bank, willingly uphold the occupation, is it fair to say that by any reasonable standard, they are not to be classed as civilians? Furthermore, are Palestinians to be condemned for violent acts of resistance against settlers, if the settlers are indeed occupiers? If we are to look to International Law, \u00a0it is clear that Palestinians have every right to resist their occupiers.<\/p>\n<p>Examining the conduct of settlers, it is safe to make the assumption that Israeli settlers make their own decisions when violating international law.<\/p>\n<p>Settler organizations, such as \u2018<a target=\"_blank\" href=\"http:\/\/www.fundisrael.org\/regavim\" >Regavim<\/a>\u2019,\u00a0aim to pressure the Israeli Government into creating court orders to bulldoze private property and legitimize settlement activity.
