Sari Bashi is HRW\u2019s Israel\/Palestine Advocacy Director. She can lay claim to an impressive academic pedigree (BA, Yale; JD, Yale), and she co-founded the important Israeli human rights group Gisha. It thus cannot but depress that Bashi is so wanting in elementary moral and legal judgment when it comes to the people of Gaza.<\/p>\n<p>Shortly after the Israeli massacre in Gaza on 14 May 2018, Bashi posted a commentary under the title,\u00a0<a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2018\/05\/22\/dont-blame-hamas-gaza-bloodshed\" >\u201cDon\u2019t Blame Hamas for the Gaza Bloodshed.\u201d<\/a><\/p>\n<p><a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2018\/05\/22\/dont-blame-hamas-gaza-bloodshed\" >\u200b<\/a>Its essence is captured in the opening sentence: \u201cIsrael has a right to defend its borders, but shooting unarmed protesters who haven\u2019t breached its frontier is disproportionate and illegal.\u201d Insofar as the demonstrators didn\u2019t pose an \u201cimminent threat to life,\u201d Bashi concludes, Israel had no right to use lethal force against them and, in any event, did not \u201cexhaust\u201d nonlethal means \u201csuch as tear gas, skunk water, and rubber-coated steel pellets\u201d to throw back the assembled crowd.<\/p>\n<p>The UN has pronounced Gaza\u00a0<a target=\"_blank\" href=\"https:\/\/www.reuters.com\/article\/us-palestinians-gaza-un\/gaza-unliveable-ten-years-after-hamas-seized-power-u-n-idUSKBN19W17T\" >unlivable<\/a>, while Sara Roy of Harvard\u2019s Center for Middle Eastern Studies has written, \u201c<a target=\"_blank\" href=\"http:\/\/theplatformproject.ca\/are-we-complicit-in-genocide-discussing-war-crimes-and-illegal-occupation\/\" >Innocent people, most of them young, are slowly being poisoned by the water they drink.<\/a>\u201d Is it not a tad unseemly, not to say unsettling, for the representative of a respected human rights organization to coach Israel how to stay within the letter of the law\u2014before resorting to bullets, you must first try \u201ctear gas, skunk water, and rubber-coated steel pellets\u201d\u2014while it\u2019s herding two million people, half of them children, in an unlivable space in which they are slowly being poisoned?<\/p>\n<p>To be sure, Bashi is not oblivious to the humanitarian catastrophe in Gaza caused by Israel\u2019s blockade. But she makes out no legal nexus between the effects of the siege and Israel\u2019s right to use force. Instead, she dwells on the apparently paradoxical outcome that whereas Israel imposed the blockade to weaken Hamas, it has in fact \u201chelped Hamas grow in strength.\u201d<\/p>\n<div id=\"attachment_114387\" style=\"width: 210px\" class=\"wp-caption alignright\"><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2018\/07\/Sari-Bashi-Human-Rights-Watch.jpg\" ><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-114387\" class=\"wp-image-114387\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2018\/07\/Sari-Bashi-Human-Rights-Watch-300x300.jpg\" alt=\"\" width=\"200\" height=\"200\" srcset=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2018\/07\/Sari-Bashi-Human-Rights-Watch-300x300.jpg 300w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2018\/07\/Sari-Bashi-Human-Rights-Watch-150x150.jpg 150w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2018\/07\/Sari-Bashi-Human-Rights-Watch.jpg 400w\" sizes=\"auto, (max-width: 200px) 100vw, 200px\" \/><\/a><p id=\"caption-attachment-114387\" class=\"wp-caption-text\">Sari Bashi of Human Rights Watch, from her twitter feed.<\/p><\/div>\n<p>But the siege is not irrelevant to a\u00a0legal\u00a0determination of Israel\u2019s right to use force\u2014be it proportionate or disproportionate, moderate or excessive, lethal or nonlethal\u2014to prevent demonstrators from breaching Gaza\u2019s perimeter fence. For brevity\u2019s sake, I would want to touch here on one basic, uncontroversial point. (A forthcoming article by Jamie Stern-Weiner and this writer parses the more nuanced legal issues.)<\/p>\n<p>It is a tenet of international law that no state can resort to forceful measures unless \u201cpeaceful means\u201d have been exhausted (UN Charter, Article 2). This principle is as sacred to the rule of law as the analogous Hippocratic Oath,\u00a0primum non nocere (first, do no harm), is to medicine. Now consider the situation in Gaza. Nearly all competent observers agree:<\/p>\n<ul>\n<li>Israel has imposed an illegal blockade on Gaza;<\/li>\n<li>The illegal blockade has created a humanitarian catastrophe;<\/li>\n<li>The impetus behind the protests at the perimeter fence is the illegal blockade, and their objective is to end it.<\/li>\n<\/ul>\n<p>It is to be noted that even Israeli prime minister Benjamin Netanyahu concedes the last bullet point. \u201cThey\u2019re suffocating economically,\u201d he\u00a0<a target=\"_blank\" href=\"https:\/\/www.haaretz.com\/israel-news\/netanyahu-israel-examining-ways-to-stop-humanitarian-crisis-in-gaza-1.6152028\" >observed<\/a>, \u201cand therefore they decided to crash into the fence.\u201d<\/p>\n<p>If Israel wants to protect its border, then it need not resort to either lethal or nonlethal coercion. It merely has to lift the siege. Israel\u2019s refusal to take this preliminary peaceful step puts it in double breach of international law: the imposition of an illegal blockade and the unlawful resort to armed force when peaceful means have not been exhausted.<\/p>\n<p>It is cause for wonder why Bashi doesn\u2019t see that Israel\u2019s resort to\u00a0any\u00a0force against Gaza demonstrators cannot be legally justified. It is cause for dismay that she counsels Israel to use nonlethal repression in order to corral Gaza\u2019s inhabitants in a hellhole, instead of counseling it, not just as a matter of political expedience but also as a matter of law, to end the siege. If, by way of comparison,\u00a0police repeatedly enter a man\u2019s premises in flagrant violation of the law, the homeowner finally resists, and the police try to subdue him, would a human rights representative be advising the officers to use graduated force?<\/p>\n<p>\u200bIndeed, prior to Israel\u2019s slated\u00a0<a target=\"_blank\" href=\"https:\/\/www.haaretz.com\/israel-news\/.premium-clashes-as-west-bank-bedouin-village-warned-of-impending-demolition-1.6243251\" >violent eviction\/demolition<\/a>\u00a0of the Bedouin village Khan al-Amar in the West Bank, HRW itself did not recommend that the army first use \u201ctear gas, skunk water, and rubber-coated steel pellets\u201d but, on the contrary, bluntly warned Israel that such an act would constitute a \u201c<a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2018\/04\/25\/israel-army-demolishing-west-bank-schools\" >war crime.<\/a>\u201d<\/p>\n<p>Were the siege of Gaza lifted, it would put Israel on the right side of the law as it yielded the double dividend of enabling the people of Gaza to breathe and terminating the purported threat to Israel\u2019s border.
