The White House was blunt about its intentions, promising that the executive branch would \u201c<a target=\"_blank\" href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/national-security-presidential-memorandum-regarding-u-s-conventional-arms-transfer-policy\/\" >advocate strongly on behalf of United States companies<\/a>.\u201d<\/p>\n<p>But one change in particular may make it easier for American companies to sell weapons to governments that routinely kill civilians in conflicts by discounting killings that the governments claim are unintentional. The change could have a significant impact on sales to Saudi Arabia and the United Arab Emirates \u2014 the top two U.S. weapons clients \u2014 both of which are engaged in a destructive bombing campaign in Yemen.<\/p>\n<p>The loophole hinges on the insertion of one word in a section that is otherwise identical to the <a target=\"_blank\" href=\"https:\/\/obamawhitehouse.archives.gov\/the-press-office\/2014\/01\/15\/presidential-policy-directive-united-states-conventional-arms-transfer-p\" >Obama administration\u2019s conventional arms policy<\/a>, which was issued in 2014. On Monday, the State Department issued a <a target=\"_blank\" href=\"https:\/\/www.state.gov\/r\/pa\/prs\/ps\/2018\/07\/284097.htm\" >fact sheet<\/a> on the policy\u2019s implementation, which promised it would energize a \u201cwhole-of-government effort to expedite transfers that support [the administration\u2019s] essential foreign policy and national security objectives.\u201d<\/p>\n<p>Colby Goodman, a researcher on arms sales and director of the <a target=\"_blank\" href=\"http:\/\/www.ciponline.org\/programs\/security-assistance-monitor\" >Security Assistance Monitor at the Center for International Policy<\/a>, said arms control groups had objected to the word \u201cintentional,\u201d but no change was reflected in the guidelines released Monday.<\/p>\n<p>\u201cDepending on how this policy is implemented, this focus could make it harder for those in the U.S. government [with] legitimate human rights concerns to block or modify some proposed U.S. arms sales,\u201d Goodman told The Intercept.<\/p>\n<p>The loophole is particularly significant in light of the destructive Saudi and Emirati-led bombing campaign in Yemen, where civilian deaths are routinely termed inadvertent or unintentional.<\/p>\n<p>Throughout its three-year bombing campaign, the Saudi and UAE-led coalition has repeatedly bombed civilian targets, striking <a target=\"_blank\" href=\"https:\/\/www.cnn.com\/2017\/09\/07\/middleeast\/yemeni-girl-viral-photo\/index.html\" >homes<\/a>, <a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2016\/04\/07\/yemen-us-bombs-used-deadliest-market-strike\" >markets<\/a>, <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/world\/2017\/dec\/12\/bombed-into-famine-how-saudi-air-campaign-targets-yemens-food-supplies\" >food sources<\/a>, and even <a target=\"_blank\" href=\"https:\/\/www.reuters.com\/article\/us-yemen-security-idUSKBN0TU1PQ20151211\" >schools<\/a>, <a target=\"_blank\" href=\"https:\/\/www.msf.org\/msf-supported-hospital-bombed-yemen-death-toll-rises-six\" >hospitals<\/a>, and <a target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2017\/11\/12\/opinion\/cholera-war-yemen.html\" >water infrastructure<\/a>. These attacks have become so common that human rights groups have called for an <a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2016\/03\/21\/yemen-embargo-arms-saudi-arabia\" >arms embargo on Saudi Arabia<\/a>.<\/p>\n<p>Both the Obama and Trump administrations have resupplied the coalition through arms sales, content with coalition claims that the strikes are unintentional mistakes. Under Obama\u2019s 2014 policy, the U.S. rebuffed human rights groups and <a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2016\/03\/21\/yemen-embargo-arms-saudi-arabia\" >sold the coalition more than $20 billion in weapons.<\/a><\/p>\n<p>As part of an effort to push back against criticism, Saudi Arabia and the UAE formed a body called the \u201cJoint Incidents Assessment Team\u201d in 2015 to investigate civilian deaths. But rather than holding the coalition accountable, the body frequently parrots\u00a0its rhetoric that <a target=\"_blank\" href=\"https:\/\/www.reuters.com\/article\/us-yemen-security-investigation\/saudi-coalition-investigates-own-air-strikes-clears-itself-idUSKCN1BN2O6\" >strikes are unintentional mistakes<\/a>,\u00a0according to Kristine Beckerle, Yemen researcher at Human Rights Watch.<\/p>\n<p>\u201c\u2018I didn\u2019t mean to\u2019 is not a sufficient excuse for the Yemenis still grieving [for] their loved ones killed or wounded \u2014 they deserve accountability, compensation,\u201d Beckerle told The Intercept. \u201cEven if the coalition didn\u2019t intend to bomb a wedding, a home, a hospital, it doesn\u2019t necessarily follow the strike was lawful, that an individual didn\u2019t commit a war crime \u2014 there\u2019s\u00a0<em>a lot<\/em>\u00a0more to the laws of war than that.\u201d<\/p>\n<p>In 2016, for example, the JIAT <a target=\"_blank\" href=\"https:\/\/www.spa.gov.sa\/viewstory.php?lang=en&amp;newsid=1524799\" >found<\/a> that a strike against a residential complex in western Yemen had been \u201cunintentional.\u201d Later that year, it <a target=\"_blank\" href=\"https:\/\/www.msf.org\/yemensaudi-led-airstrike-abs-hospital-cannot-be-justified-unintentional-error\" >found<\/a> that the bombing of a M\u00e9decins Sans Fronti\u00e8res-run hospital was an \u201cunintentional error,\u201d despite the fact the buildings were clearly marked as MSF medical facilities. And last year, after the coalition bombed a water factory in Yemen\u2019s Hajjah directorate, the JIAT <a target=\"_blank\" href=\"https:\/\/www.spa.gov.sa\/viewstory.php?lang=en&amp;newsid=1610999\" >found<\/a> that \u201cthe bomb went off course and fell on the factory unintentionally.\u201d<\/p>\n<p>The Trump administration\u2019s policy may help the U.S. facilitate further arms sales by relying on the pretext that these types of bombings, though recurrent, are unintentional. \u201cThose hoping this administration might learn lessons from the past about how U.S. weapons ended up being misused, or show proper restraint in sales to countries such as Saudi Arabia and the UAE, have nothing to cheer in the new policy or its implementation plan to date,\u201d said Jeff Abramson, a senior fellow at the Arms Control Association.<\/p>\n<p>In May, shortly after the coalition bombed a wedding party in North Yemen, the State Department briefed Senate staff about another possible <a target=\"_blank\" href=\"https:\/\/theintercept.com\/2018\/05\/11\/american-saudi-arabia-weapons-deal-yemen-uae\/\" >multibillion dollar sale of air-to-ground munitions<\/a> to Saudi Arabia and the UAE. The sale is currently being held up by Sen.
