{"id":130907,"date":"2019-04-08T12:00:01","date_gmt":"2019-04-08T11:00:01","guid":{"rendered":"https:\/\/www.transcend.org\/tms\/?p=130907"},"modified":"2019-04-15T11:44:08","modified_gmt":"2019-04-15T10:44:08","slug":"un-agencies-urge-brunei-to-repeal-new-extreme-and-unjustified-penal-code","status":"publish","type":"post","link":"https:\/\/www.transcend.org\/tms\/2019\/04\/un-agencies-urge-brunei-to-repeal-new-extreme-and-unjustified-penal-code\/","title":{"rendered":"UN Agencies Urge Brunei to Repeal New \u2018Extreme and Unjustified\u2019 Penal Code"},"content":{"rendered":"<blockquote><p><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2018\/04\/un-news-logo-e1524746883441.png\" ><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-109474\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2018\/04\/un-news-logo-e1524746883441.png\" alt=\"\" width=\"200\" height=\"200\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>4 Apr 2019 &#8211; <em>New criminal laws in Brunei that impose the death penalty for same-sex relationships, adultery and childbirth out of marriage, \u201cbreach international human rights norms\u201d, and should be suspended or repealed said the heads of two United Nations agencies today.<\/em><\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<p>Underscoring that every person has the right to be \u201cfree from torture\u201d and \u201ccruel, inhumane or degrading treatment\u201d, <a target=\"_blank\" href=\"http:\/\/www.unaids.org\/en\" >UNAIDS<\/a>, the agency dedicated to tackling the virus, and the UN Population Fund (<a target=\"_blank\" href=\"https:\/\/www.unfpa.org\/\" >UNFPA<\/a>), the sexual and reproductive health agency, warned the new penal code, which came into force in the south-east Asian monarchy on Wednesday, \u201cwill have a significant negative impact on overall health and well-being\u201d there.<\/p>\n<p>\u201cThese extreme and unjustified punishments will drive people underground and out of reach of life-saving HIV treatment and prevention services,\u201d said Michel Sidib\u00e9, Executive Director of <a target=\"_blank\" href=\"http:\/\/www.unaids.org\/en\" >UNAIDS<\/a>.<\/p>\n<p>The discriminatory laws further punish sexual orientation, same sex relations and reproductive health care. They will disproportionately impact women and create barriers to accessing health information and services, the agencies said.<\/p>\n<blockquote><p><strong><em>\u201cEvery person, without any distinction on any grounds, has an equal right to live free from violence, persecution, discrimination and stigma of any kind.\u201d<\/em><\/strong><br \/>\n<strong>\u2013 <a target=\"_blank\" href=\"https:\/\/www.unfpa.org\/\" >UNFPA<\/a> chief <\/strong><\/p><\/blockquote>\n<p>Mr. Sidib\u00e9 \u201cstrongly\u201d urged Brunei to \u201csuspend or repeal the amendments to the Shariah Penal Code\u201d, which are based on an extreme interpretation of Islamic law, offering UNAIDS\u2019 support to \u201censure that laws are grounded in human rights, based on evidence and protect the most vulnerable\u201d.<\/p>\n<p>Further criminalizing same-sex activities not only negatively impacts public health, but also increases stigma and gives license to discrimination, violence and harassment, they added.<\/p>\n<p>\u201cEvery person, without any distinction on any grounds, has an equal right to live free from violence, persecution, discrimination and stigma of any kind\u201d, stated UNFPA Executive Director Natalia Kanem.<\/p>\n<p>The UN agencies cited evidence showing that criminalized communities are more vulnerable to violence, less likely to access necessary HIV and other health services, and less able to protect themselves against HIV infection.<\/p>\n<p>Moreover, they pointed out that criminalizing minorities also works against reaching the <a target=\"_blank\" href=\"https:\/\/www.un.org\/sustainabledevelopment\/sustainable-development-goals\/\" >Sustainable Development Goals<\/a> (<a target=\"_blank\" href=\"https:\/\/sustainabledevelopment.un.org\/sdgs\" >SDGs<\/a>), designed and agreed by 193 Member States, to leave no-one behind.<\/p>\n<p>\u201cHuman rights are universal\u201d, reminded Ms. Kanem. \u201cCultural, religious and moral practices and beliefs, and social attitudes must not be invoked to justify human rights violations against any group regardless of gender or sexual orientation\u201d.<\/p>\n<p>Last December, Brunei called for improved data on key affected and higher-risk populations for greater outreach and better health-care provisions.
