{"id":133670,"date":"2019-05-20T12:00:45","date_gmt":"2019-05-20T11:00:45","guid":{"rendered":"https:\/\/www.transcend.org\/tms\/?p=133670"},"modified":"2019-05-16T10:30:10","modified_gmt":"2019-05-16T09:30:10","slug":"myanmar-conflict-resolution-at-total-standstill-military-commanders-must-answer-for-crimes-against-humanity","status":"publish","type":"post","link":"https:\/\/www.transcend.org\/tms\/2019\/05\/myanmar-conflict-resolution-at-total-standstill-military-commanders-must-answer-for-crimes-against-humanity\/","title":{"rendered":"Myanmar: Conflict Resolution at \u2018Total Standstill\u2019, Military Commanders Must Answer for Crimes against Humanity"},"content":{"rendered":"<blockquote><p><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2018\/04\/un-news-logo-e1524746883441.png\" ><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-109474\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2018\/04\/un-news-logo-e1524746883441.png\" alt=\"\" width=\"200\" height=\"200\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>14 May 2019 &#8211; <em>Myanmar\u2019s military commanders must answer charges of war crimes, crimes against humanity and genocide in a credible court, a United Nations Independent International Fact-Finding Mission on Myanmar (FFM) <a target=\"_blank\" href=\"https:\/\/www.ohchr.org\/EN\/NewsEvents\/Pages\/DisplayNews.aspx?NewsID=24608&amp;LangID=E\" >said<\/a> today, urging the international community to cut off all financial and other support to them.<\/em><\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<p>Myanmar has not done enough to resolve the nation\u2019s internal-conflicts or protect human rights, including those of over a million ethnic Rohingya civilians who have been forced into exile, according to FFM Chairperson Marzuki Darusman.<\/p>\n<p>\u201cThere has been no movement toward a resolution of the crisis\u201d, Mr. Darusman said after a 10-day visit to Bangladesh, Malaysia, Thailand and Indonesia. \u201cThe situation is at a total standstill.\u201d<\/p>\n<blockquote><p><strong><em>\u201cThere has been no movement toward a resolution of the crisis.\u201d<\/em><\/strong><br \/>\n<strong>&#8212; Fact-Finding Mission Head\u00a0 <\/strong><\/p><\/blockquote>\n<p>The FFM documented in its 444-page report to the Human Rights Council in September how Myanmar\u2019s military brutally and systemically violated the human rights of ethnic minorities throughout the country.<\/p>\n<p>It spotlighted the military\u2019s so-called \u201cclearance operations\u201d in 2017, when security forces killed thousands of Rohingya civilians, raped and sexually abused women and girls and burned villages in Rakhine State in an explosion of violence that caused more than 700,000 people to flee across the border into Bangladesh, in just two months.<\/p>\n<p>Moreover, Myanmar authorities have levelled abandoned Rohingya villages with bulldozers, effectively destroying criminal evidence, while making no substantive progress in resolving the ethnic animosities that have helped fuel the crisis.<\/p>\n<p>For their part, the Government denies the facts and disclaim any responsibility for crimes under international law.<\/p>\n<div id=\"attachment_133673\" style=\"width: 510px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/05\/burma-myanmar-rohingya.jpg\" ><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-133673\" class=\"wp-image-133673\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/05\/burma-myanmar-rohingya-1024x460.jpg\" alt=\"\" width=\"500\" height=\"225\" srcset=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/05\/burma-myanmar-rohingya-1024x460.jpg 1024w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/05\/burma-myanmar-rohingya-300x135.jpg 300w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/05\/burma-myanmar-rohingya-768x345.jpg 768w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/05\/burma-myanmar-rohingya.jpg 1179w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\" \/><\/a><p id=\"caption-attachment-133673\" class=\"wp-caption-text\">The two children of Nomtaz Begum, 30, a refugee from Myanmar who is now in Bangladesh, were killed in front of her. (March 2018)<br \/>UNOCHA\/Vincent Tremeau<\/p><\/div>\n<p><strong>Rights abuses flourish\u00a0<\/strong><\/p>\n<p>The report also condemns ethnic armed organizations within Myanmar, for committing human rights abuses and violating international humanitarian law.<\/p>\n<p>The FFM visited Kutupalong Camp in Bangladesh\u2019s Cox\u2019s Bazar, where Mr. Darusman told the refugees that when its mandate expires in September, it would hand over its evidence to the new Independent Investigative Mechanism on Myanmar to expedite fair criminal proceedings against the perpetrators.<\/p>\n<p>\u201cIn short, this is not the end of the story,\u201d he told them. \u201cPlease have hope that this will lead to eventual accountability of those who are responsible for what took place against the Rohingya community.\u201d<\/p>\n<p>Against the backdrop that the conduct of national security forces in Rakhine State \u201cwere the result of structural problems fuelled by the absence of a political and legal system that is willing to accommodate diversity\u201d, Mr. Darusman said: \u201cAny solutions should directly address the structural problems.\u201d<\/p>\n<blockquote><p><em>I met Swra in Sittwe, <a target=\"_blank\" href=\"https:\/\/twitter.com\/hashtag\/Rakhine?src=hash&amp;ref_src=twsrc%5Etfw\" >#Rakhine<\/a>. People desperately need essential services &amp; freedom of movement &#8211; <a target=\"_blank\" href=\"https:\/\/twitter.com\/hashtag\/Myanmar?src=hash&amp;ref_src=twsrc%5Etfw\" >#Myanmar<\/a> <a target=\"_blank\" href=\"https:\/\/t.co\/BZRTJJAQJ6\" >pic.twitter.com\/BZRTJJAQJ6<\/a><\/em><\/p>\n<p><em>\u2014 Ursula Mueller (@UschiMuller) <a target=\"_blank\" href=\"https:\/\/twitter.com\/UschiMuller\/status\/1127912981352738817?ref_src=twsrc%5Etfw\" >May 13, 2019<\/a><\/em><\/p><\/blockquote>\n<p>He also advised the Government to \u201cfocus on the real betterment of the remaining Rohingya community in Myanmar\u201d where many live in fear of security forces.<\/p>\n<p>Since 3 May, the FFM Experts have met with different ethnic communities, where they have found that the Tatmadaw, or Myanmar military, has \u201ccommitted similar atrocities\u201d against other ethnic groups within the country\u2019s borders.<\/p>\n<p>Acknowledging human rights violations, holding people accountable and reforming the Tatmadaw is \u201cthe only way forward,\u201d according to FFM member Radhika Coomaraswamy who said that \u201cthe repatriation of refugees remains remote unless and until the Myanmar Government takes concrete measures to provide conditions that are conducive for voluntary, safe, dignified, and sustainable return, including full and equal inclusion in Myanmar society\u201d.<\/p>\n<p>However team member Christopher Sidoti emphasized that the FFM \u201chas seen no evidence\u201d that the Government is acting in good faith, saying: \u201cThe situation demands an increase in international pressure\u201d.<\/p>\n<p>The Independent Investigative Mechanism is not the only body laying the ground for future prosecution. The International Criminal Court is conducting its own examination and discussions are also taking place about the jurisdiction of the International Court of Justice under the Genocide Convention.
