Photograph: Josh Edelson\/AFP\/Getty Images<\/p><\/div>\n<p><em>13 May 2019 &#8211; <\/em>A <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/us-news\/california\" >California<\/a> jury has ordered Monsanto to pay more than $2bn to a couple that got cancer after using its weedkiller, marking the third and largest verdict against the company over Roundup.<\/p>\n<p>A jury in Oakland ruled on Monday that <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/business\/monsanto\" >Monsanto<\/a>, now owned by the German pharmaceutical corporation Bayer, was liable for the non-Hodgkin\u2019s lymphoma (NHL) cancer of Alva and Alberta Pilliod. The jury ordered the company to pay $1bn in damages to each of them, and more than $55m total in compensatory damages.<\/p>\n<p>The victory for the Pilliods follows two consecutive trial wins for families taking on Monsanto over Roundup, the world\u2019s most widely used weedkiller, which research has <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/science\/2018\/oct\/07\/monsanto-trial-cancer-appeal-glyphosate-chemical\" >linked to NHL<\/a>, a cancer that affects the immune system. <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/business\/2018\/sep\/25\/monsanto-dewayne-johnson-cancer-verdict\" >Dewayne Johnson<\/a>, a former school groundskeeper with terminal cancer, won a $289m victory in state court last year, and <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/business\/2019\/apr\/10\/edwin-hardeman-monsanto-trial-interview\" >Edwin Hardeman<\/a>, who sprayed Roundup on his properties, was awarded $80m in the <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/business\/2019\/mar\/19\/monsanto-trial-roundup-verdict-edwin-hardeman-cancer\" >first federal<\/a> trial this year.<\/p>\n<p>The latest verdict is the largest by far and will increase pressure on Bayer, which has <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/business\/2019\/feb\/25\/monsanto-federal-trial-roundup-cancer\" >suffered<\/a> share price drops in the wake of the verdicts and is now facing similar lawsuits from <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/business\/2019\/apr\/10\/edwin-hardeman-monsanto-trial-interview\" >thousands of cancer patients<\/a>, survivors and families who lost loved ones to NHL.<\/p>\n<p>The juries have repeatedly ruled that Roundup was defectively designed, that the company failed to warn consumers about the cancer risks, and that Monsanto has acted negligently. The cases have uncovered <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/business\/2019\/apr\/10\/edwin-hardeman-monsanto-trial-interview\" >internal Monsanto documents<\/a> that plaintiffs\u2019 lawyers say reveal the ways in which the company has \u201c<a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/business\/2018\/jul\/09\/monsanto-trial-roundup-weedkiller-cancer-dewayne-johnson\" >bullied<\/a>\u201d scientists over the years and helped \u201cghostwrite\u201d research defending the safety of glyphosate, the main ingredient in Roundup.<\/p>\n<p><a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/business\/bayer\" >Bayer<\/a> and Monsanto have continued to argue that Roundup is safe to use and does not cause cancer. They are appealing against the verdicts.<\/p>\n<p>\u201cMonsanto has never had any interest in finding out whether Roundup is safe,\u201d R Brent Wisner, one of the Pilliods\u2019 attorneys, said in a statement after the verdict. \u201cInstead of investing in sound science, they invested millions in attacking science that threatened their business agenda.\u201d<\/p>\n<p>The Pilliods, who are in their 70s and live in Livermore, 40 miles east of San Francisco, used Roundup for more than 30 years to landscape their home and other properties. In 2011, Alva was diagnosed with systemic NHL in his bones, which spread to his pelvis and spine, and Alberta was diagnosed with NHL brain cancer in 2015. Both are in remission but testified about <a target=\"_blank\" href=\"https:\/\/www.courthousenews.com\/married-couple-asks-for-1b-in-damages-in-roundup-trial\/\" >lasting damage<\/a> from the cancer.<\/p>\n<p>Michael Miller, another attorney for the couple, noted that the judge in this case permitted the legal team to present significant evidence about Monsanto\u2019s conduct, in contrast to previous trials, where evidence was <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/business\/2019\/feb\/25\/monsanto-federal-trial-roundup-cancer\" >severely limited<\/a>.<\/p>\n<p>\u201cWe were finally allowed to show a jury the mountain of evidence showing Monsanto\u2019s manipulation of science, the media and regulatory agencies to forward their own agenda despite Roundup\u2019s severe harm to the animal kingdom and humankind,\u201d he said in a statement.<\/p>\n<p>Bayer said it was \u201cdisappointed\u201d in the decision and would appeal. The company cited the continuing approval of glyphosate by the US Environmental Protection Agency (EPA) and \u201cthe consensus among leading health regulators worldwide that glyphosate-based products can be used safely and that glyphosate is not carcinogenic, and the 40 years of extensive scientific research on which their favorable conclusions are based\u201d.<\/p>\n<p>Internal documents uncovered in the trials have repeatedly shone a harsh light on Monsanto\u2019s close <a target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2017\/03\/14\/business\/monsanto-roundup-safety-lawsuit.html\" >relationship<\/a> with US regulators.
