{"id":143209,"date":"2019-09-23T12:00:20","date_gmt":"2019-09-23T11:00:20","guid":{"rendered":"https:\/\/www.transcend.org\/tms\/?p=143209"},"modified":"2019-11-19T10:49:33","modified_gmt":"2019-11-19T10:49:33","slug":"genocide-threat-for-myanmars-rohingya-greater-than-ever-investigators-warn-human-rights-council","status":"publish","type":"post","link":"https:\/\/www.transcend.org\/tms\/2019\/09\/genocide-threat-for-myanmars-rohingya-greater-than-ever-investigators-warn-human-rights-council\/","title":{"rendered":"Genocide Threat for Myanmar\u2019s Rohingya Greater than Ever, Investigators Warn Human Rights Council"},"content":{"rendered":"<p style=\"padding-left: 40px;\"><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2018\/04\/un-news-logo-e1524746883441.png\" ><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-109474 size-full\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2018\/04\/un-news-logo-e1568706362531.png\" alt=\"\" width=\"150\" height=\"150\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>16 Sep 2019 &#8211;<em> Hundreds of thousands of ethnic Rohingya who remain in Myanmar may face a greater threat of genocide than ever, amid Government attempts to \u201cerase their identity and remove them from the country\u201d, UN-appointed independent investigators said today.<\/em><\/p>\n<p>&nbsp;<\/p>\n<p>In a report detailing alleged violations in Myanmar over the last year, the <a target=\"_blank\" href=\"https:\/\/www.ohchr.org\/en\/hrbodies\/hrc\/myanmarffm\/pages\/index.aspx\" >Independent International Fact-Finding Mission<\/a>, insists that many of the conditions that led to \u201ckillings, rapes and gang rapes, torture, forced displacement and other grave rights violations\u201d by the country\u2019s military, that prompted some 700,000 Rohingya to flee to neighbouring Bangladesh in 2017, are still present.<\/p>\n<p>Citing the lack of accountability for the perpetrators of these alleged crimes, as well as the failure by Myanmar \u201cto investigate genocide and to enact effective legislation criminalizing and punishing genocide\u201d, the UN-appointed independent panel concludes \u201cthat the evidence that infers genocidal intent on the part of the State\u2026has strengthened, that there is a serious risk that genocidal actions may occur or recur\u201d.<\/p>\n<p>Echoing those findings, Special Rapporteur on the situation of human rights in Myanmar, Yanghee Lee told the Human Rights Council earlier on Monday that Myanmar had \u201cdone nothing to dismantle the system of violence and persecution\u201d against the Rohingya who live in the \u201csame dire circumstances that they did, prior to the events of August 2017\u201d.<\/p>\n<p>Citing satellite imagery of destroyed Rohingya villages, Ms. Lee questioned Myanmar\u2019s assertion that it rebuilt areas affected by the violence, given that there were \u201csix military bases that have been built on the site of destroyed Rohingya villages\u201d.<\/p>\n<p>Of nearly 400 Rohingya villages apparently destroyed, \u201cthere has been no attempt to reconstruct 320 of them\u201d, the Special Rapporteur noted, and four in 10 villages had been \u201ccompletely razed to the ground\u201d.<\/p>\n<p>Some of that demolition occurred in 2018 and some even in 2019 \u201cand all of this is completely antithetical to the claim that Myanmar is ready to receive the refugees (back from Bangladesh)\u201d, Ms. Lee insisted.<\/p>\n<div id=\"attachment_143210\" style=\"width: 710px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/09\/rohingya-burma-myanmar-1.jpg\" ><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-143210\" class=\"wp-image-143210\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/09\/rohingya-burma-myanmar-1-1024x461.jpg\" alt=\"\" width=\"700\" height=\"315\" srcset=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/09\/rohingya-burma-myanmar-1-1024x461.jpg 1024w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/09\/rohingya-burma-myanmar-1-300x135.jpg 300w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/09\/rohingya-burma-myanmar-1-768x346.jpg 768w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/09\/rohingya-burma-myanmar-1.jpg 1178w\" sizes=\"auto, (max-width: 700px) 100vw, 700px\" \/><\/a><p id=\"caption-attachment-143210\" class=\"wp-caption-text\">Rohingya refugees fleeing conflict and persecution in Myanmar. IOM\/Mohammed<\/p><\/div>\n<p><strong>600,000 Rohingya \u2018Remain the Target\u2019 of Myanmar Authorities<\/strong><\/p>\n<p>According to the International Fact-Finding Mission\u2019s near 200-page report, the abuses it found were not on the same scale as the \u201cclearance operations\u201d conducted against Rohingya communities in the summer of 2017.<\/p>\n<p>Nonetheless, the 600,000 mainly-Muslim Rohingya still in Myanmar \u201cremain the target\u201d of Government efforts to remove them from the country, the expert panel insisted.<\/p>\n<p>The threats the Rohingya minority face include a \u201ccontinuation of hate speech\u201d and discrimination that affects their ability to work, attend school, seek medical care \u201cor even pray and congregate\u201d, the report notes.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\"><a target=\"_blank\" href=\"https:\/\/twitter.com\/hashtag\/HRC42?src=hash&amp;ref_src=twsrc%5Etfw\" >#HRC42<\/a> Presentation of oral update by SR, Ms Yanghee Lee, on the situation of <a target=\"_blank\" href=\"https:\/\/twitter.com\/hashtag\/humanrights?src=hash&amp;ref_src=twsrc%5Etfw\" >#humanrights<\/a> in <a target=\"_blank\" href=\"https:\/\/twitter.com\/hashtag\/Myanmar?src=hash&amp;ref_src=twsrc%5Etfw\" >#Myanmar<\/a>, followed by statement of concerned country and interactive dialogue. <a target=\"_blank\" href=\"https:\/\/twitter.com\/YangheeLeeSKKU?ref_src=twsrc%5Etfw\" >@YangheeLeeSKKU<\/a> live on <a target=\"_blank\" href=\"https:\/\/t.co\/6PWCTAjxDN\" >https:\/\/t.co\/6PWCTAjxDN<\/a> <a target=\"_blank\" href=\"https:\/\/twitter.com\/UNGeneva?ref_src=twsrc%5Etfw\" >@UNgeneva<\/a> <a target=\"_blank\" href=\"https:\/\/twitter.com\/hashtag\/Rohingyas?src=hash&amp;ref_src=twsrc%5Etfw\" >#Rohingyas<\/a> <a target=\"_blank\" href=\"https:\/\/t.co\/bDvu5fmnT3\" >pic.twitter.com\/bDvu5fmnT3<\/a><\/p>\n<p>&mdash; United Nations Human Rights Council | #HRC55 (@UN_HRC) <a target=\"_blank\" href=\"https:\/\/twitter.com\/UN_HRC\/status\/1173600871952846849?ref_src=twsrc%5Etfw\" >September 16, 2019<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p><strong>Ongoing Gross Rights Violations still Occurring, Says Rights Investigator<\/strong><\/p>\n<p>Echoing those comments, Ms. Lee insisted that Myanmar \u201ccontinues to be a State that commits ongoing gross violations of international law\u201d.<\/p>\n<p>Humanitarian access remains severely restricted by the State, she went on, and all those involved in the violence \u2013 among them, the Tatmadaw State military and the Arakan separatist army \u2013 have been responsible for \u201cindiscriminate\u2026heavy artillery fire, gunfire and landmines in civilian areas\u201d linked to the displacement of some 65,000 people across northern Rakhine and southern Chin states since January.<\/p>\n<p>Highlighting information about \u201creprisals, surveillance and harassment\u201d of people in Myanmar and outside the country who have cooperated with international human rights mechanisms, Ms. Lee urged the international community to continue to scrutinize events in Myanmar.<\/p>\n<p>\u201cThe parties to the conflict must end their hostilities \u2013 the people of Rakhine have suffered enough,\u201d she insisted.<\/p>\n<p>In addition to reports of up to six villages being burned deliberately since the end of June, the Special Rapporteur also noted with concern that the Government-imposed internet blackout has been in place for nearly three months in Kyauktaw, Minbya, Ponnagyun and Mrauk-U, \u201cwhere the worst fighting is happening\u201d.<\/p>\n<p>Conflict escalated on 15 August when separatists launched attacks in northern Shan and Mandalay, Ms. Lee explained, \u201ckilling and injuring soldiers, police officers, and civilians\u201d. This sparked intense fighting between the Tatmadaw State military and the ethnic armed organizations in northern Shan which led to the death of a farmer killed when Tatmadaw \u201creportedly fired mortars into his village as people were fleeing military helicopters conducting air strikes nearby\u201d.<\/p>\n<p><strong>Ceasefires Welcomed but Peace Talks still in Doubt<\/strong><\/p>\n<p>While welcoming the separatists\u2019 unilateral ceasefire declared last week ahead of peace talks with the Government\u2019s National Reconciliation and Peace Commission scheduled for Tuesday, Ms. Lee questioned whether the Tatmadaw were serious about bringing about peace after launching operations against Ta&#8217;ang National Liberation Army (TNLA) separatists \u2013 despite also saying that they were laying down their weapons.<\/p>\n<p>In a related development, UN-appointed independent human rights experts expressed serious concerns on Monday about new restrictions at Rohingya refugee camps in Bangladesh, following a massive \u201cGenocide Day\u201d protest last month.<\/p>\n<p>In a statement, the six Special Rapporteurs said that some 200,000 refugees had gathered for the rally in Cox\u2019s Bazar to mark the second anniversary of their exodus from Myanmar.<\/p>\n<p>Demonstrators called for Myanmar citizenship rights and other guarantees before they would agree to return.<\/p>\n<p>\u201cSince the demonstration at Cox\u2019s Bazar on 25 August, a number of the protest organisers have been questioned and subjected to intimidation,\u201d the experts said.<\/p>\n<p>A curfew is also being strictly enforced on those in the camps, they added, while mobile phones have been banned and confiscated.<\/p>\n<p><strong>Myanmar Responds<\/strong><\/p>\n<p>In response to the allegations, the delegation for Myanmar maintained that the country faced development and human rights challenges, which were one and the same thing.<\/p>\n<p>The Myanmar constitution prohibits the targeting of minorities, Ambassador Kyaw Moe Tun insisted, before adding that there had been only temporary internet shutdowns in Rakhine and Shan states in response to insurgents\u2019 alleged use of wireless technology to detonate bombs.<\/p>\n<p>Blaming separatists for the Rohingya exodus in 2017, the Ambassador maintained that the tragedy had been exploited for political purposes.<\/p>\n<p>\u201cIt is crystal clear\u201d that there are people who want to return to Myanmar, he added, before rejecting any attempt by the international community to prosecute State military figures allegedly responsible for grave rights violations against the Rohingya unless all national remedies had been exhausted.<\/p>\n<p><a target=\"_blank\" href=\"https:\/\/news.un.org\/en\/story\/2019\/09\/1046442?utm_source=UN+News+-+Newsletter&amp;utm_campaign=aa69ed1d72-EMAIL_CAMPAIGN_2019_09_17_12_00&amp;utm_medium=email&amp;utm_term=0_fdbf1af606-aa69ed1d72-105796125\" >Go to Original \u2013 news.un.org<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>16 Sep 2019 &#8211;
