{"id":149571,"date":"2019-12-16T12:01:43","date_gmt":"2019-12-16T12:01:43","guid":{"rendered":"https:\/\/www.transcend.org\/tms\/?p=149571"},"modified":"2019-12-26T10:48:00","modified_gmt":"2019-12-26T10:48:00","slug":"aung-san-suu-kyi-defends-myanmar-from-accusations-of-genocide-at-top-un-court","status":"publish","type":"post","link":"https:\/\/www.transcend.org\/tms\/2019\/12\/aung-san-suu-kyi-defends-myanmar-from-accusations-of-genocide-at-top-un-court\/","title":{"rendered":"Aung San Suu Kyi Defends Myanmar from Accusations of Genocide, at Top UN Court"},"content":{"rendered":"<blockquote><p><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2018\/04\/un-news-logo-e1568706362531.png\" ><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-109474\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2018\/04\/un-news-logo-e1568706362531.png\" alt=\"\" width=\"150\" height=\"150\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>11 Dec 2019 &#8211;<em> Myanmar will have \u201cno tolerance\u201d for human rights abuses committed in Rakhine state and will prosecute the military, if war crimes have been committed there, Aung San Suu Kyi told the International Court of Justice (ICJ), the UN\u2019s main judicial body, today.<\/em><\/p><\/blockquote>\n<p>Ms. Suu Kyi was testifying in defence of her country, which is facing charges of genocide committed against the mainly-Muslim Rohingya minority group, brought by The Gambia, on behalf of the Organization of Islamic Cooperation.<\/p>\n<p>The de facto leader of Myanmar, who was placed under house arrest by the country\u2019s then military rulers off and on over more than 20 years, is not on trial at the <a target=\"_blank\" href=\"https:\/\/www.icj-cij.org\/en\" >ICJ<\/a>, which settles disputes between countries. The <a target=\"_blank\" href=\"https:\/\/www.icc-cpi.int\/\" >International Criminal Court<\/a> (ICC) has the responsibility of trying individuals, and in November, the ICC authorized its own investigation into alleged crimes against humanity, namely deportation, committed against the Rohingya.<\/p>\n<p>\u201cIf war crimes have been committed, they will be prosecuted within our military justice system\u201d, the Nobel peace laureate Ms. Suu Kyi said in court, during the second day of preliminary proceedings at the ICJ.<\/p>\n<p>In her opening statement in front of judges in The Hague, Ms. Suu Kyi outlined decades of tensions between Rakhine\u2019s mainly Rohingya Muslim community and their Buddhist neighbours.<\/p>\n<blockquote><p><strong><em>\u201cIf war crimes have been committed, they will be prosecuted within our military justice system.\u201d<\/em><\/strong><br \/>\n<strong>&#8212; Myanmar State Counsellor, Aung San Suu Kyi<\/strong><\/p><\/blockquote>\n<p>These boiled over on 25 August 2017, when the country\u2019s military \u2013 often referred to as the Tatmadaw &#8211; carried out a sweeping crackdown against Rohingya communities, in response to deadly attacks on police and security posts by separatists known as the Arakan Rohingya Salvation\u00a0Army.<\/p>\n<p>The result was the exodus of more than 700,000 people to neighbouring Bangladesh, many of whom told UN-appointed independent investigators that they had witnessed targeted violence of extreme brutality.<\/p>\n<p>Numerous alleged human rights abuses took place, with the then UN human rights chief describing it as bearing all the hallmarks of a \u201ctextbook example of ethnic cleansing\u201d.<\/p>\n<div id=\"attachment_149572\" style=\"width: 610px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/12\/Aung-San-Suu-Kyi-un-icj-genocide-burma-myanmar-rohingya.jpg\" ><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-149572\" class=\"wp-image-149572\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/12\/Aung-San-Suu-Kyi-un-icj-genocide-burma-myanmar-rohingya-1024x461.jpg\" alt=\"\" width=\"600\" height=\"270\" srcset=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/12\/Aung-San-Suu-Kyi-un-icj-genocide-burma-myanmar-rohingya-1024x461.jpg 1024w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/12\/Aung-San-Suu-Kyi-un-icj-genocide-burma-myanmar-rohingya-300x135.jpg 300w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/12\/Aung-San-Suu-Kyi-un-icj-genocide-burma-myanmar-rohingya-768x346.jpg 768w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2019\/12\/Aung-San-Suu-Kyi-un-icj-genocide-burma-myanmar-rohingya.jpg 1178w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><p id=\"caption-attachment-149572\" class=\"wp-caption-text\">Aung San Suu Kyi appears at the UN International Court of Justice (ICJ) on 11 December 2019.<br \/>ICJ\/Frank van Beek<\/p><\/div>\n<p><strong>Genocidal intent \u2018cannot be only possibility\u2019: Suu Kyi<\/strong><\/p>\n<p>It could not be ruled out that the Tatmadaw had used disproportionate force, Ms. Suu Kyi told the Netherlands-based court, while also suggesting that \u201csurely, under the circumstances, genocidal intent cannot be the only hypothesis\u201d \u2013 the same phraseology used around a 2019 UN <a target=\"_blank\" href=\"https:\/\/www.ohchr.org\/EN\/HRBodies\/HRC\/MyanmarFFM\/Pages\/sexualviolence.aspx\" >report<\/a> by independent experts on the circumstances leading up to the Rakhine mass exodus.<\/p>\n<p>According to the report by the UN Fact-Finding Mission on Myanmar, the country\u2019s military were responsible for the \u201cwidespread and systematic killing of women and girls, the systematic selection of women and girls of reproductive ages for rape, attacks on pregnant women and on babies, the mutilation and other injuries to their reproductive organs, the physical branding of their bodies by bite marks on their cheeks, neck, breast and thigh, and so severely injuring victims that they may be unable to have sexual intercourse with their husbands or to conceive and leaving them concerned that they would no longer be able to have children.\u201d<\/p>\n<p>Highlighting that Myanmar\u2019s own military justice system \u201cmust\u201d be responsible for investigating and prosecuting allegations of possible war crimes by soldiers or officers in Rakhine, Ms. Suu Kyi regretted that the case brought against her country by The Gambia was \u201can incomplete and misleading factual picture in Rakhine state and Myanmar\u201d.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">MULTIMEDIA: photos and videos of today&#39;s public hearings in the case concerning Application of the Convention on the Prevention and Punishment of the Crime of Genocide (<a target=\"_blank\" href=\"https:\/\/twitter.com\/hashtag\/TheGambia?src=hash&amp;ref_src=twsrc%5Etfw\" >#TheGambia<\/a> v. <a target=\"_blank\" href=\"https:\/\/twitter.com\/hashtag\/Myanmar?src=hash&amp;ref_src=twsrc%5Etfw\" >#Myanmar<\/a>) before the <a target=\"_blank\" href=\"https:\/\/twitter.com\/hashtag\/ICJ?src=hash&amp;ref_src=twsrc%5Etfw\" >#ICJ<\/a> are available here <a target=\"_blank\" href=\"https:\/\/t.co\/VCPBkFJ7ht\" >https:\/\/t.co\/VCPBkFJ7ht<\/a> <a target=\"_blank\" href=\"https:\/\/t.co\/jBgCxZfTDX\" >pic.twitter.com\/jBgCxZfTDX<\/a><\/p>\n<p>&mdash; CIJ_ICJ (@CIJ_ICJ) <a target=\"_blank\" href=\"https:\/\/twitter.com\/CIJ_ICJ\/status\/1204407189936451584?ref_src=twsrc%5Etfw\" >December 10, 2019<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p><strong>Tatmadaw military \u2018will be put on trial in Myanmar if guilty\u2019<\/strong><\/p>\n<p>If war crimes have been committed by members of Myanmar\u2019s defence services, Ms Suu Kyi added, \u201cthey will be prosecuted through our military justice system, in accordance with Myanmar\u2019s constitution\u201d.<\/p>\n<p>In addition, she said that \u201cit would not be helpful\u201d for the international legal order if the impression takes hold that only resource-rich countries can conduct adequate domestic investigations and prosecutions\u201d.<\/p>\n<p>The Myanmar representative also insisted that it was of the utmost importance that the ICJ also assess the situation \u201con the ground in Rakhine dispassionately and accurately\u201d.<\/p>\n<p><iframe loading=\"lazy\" title=\"CLIP - Aung San Suu Kyi, de facto leader of Myamar, defends her country against genocide allegations by United Nations News\" width=\"500\" height=\"400\" scrolling=\"no\" frameborder=\"no\" src=\"https:\/\/w.soundcloud.com\/player\/?visual=true&#038;url=https%3A%2F%2Fapi.soundcloud.com%2Ftracks%2F726378382&#038;show_artwork=true&#038;maxheight=750&#038;maxwidth=500\"><\/iframe><\/p>\n<p><strong>Case against Myanmar laid out in detail<\/strong><\/p>\n<p>The hearing, brought by The Gambia with the backing of the 57 members of the\u00a0 Organization of Islamic Cooperation, alleges that \u201c\u2026against the backdrop of longstanding persecution and discrimination, from around October 2016 the Myanmar military (the \u201cTatmadaw\u201d) and other Myanmar security forces began widespread and systematic \u2018clearance operations\u2019 \u2013 the term that Myanmar itself uses \u2013 against the Rohingya group\u201d.<\/p>\n<p>The \u201cgenocidal acts\u201d that followed \u201cwere intended to destroy the Rohingya as a group &#8211; in whole or in part\u201d, The Gambia\u2019s submission states, detailing mass murder, rape and other sexual violence against the Rohingya and the \u201csystematic destruction by fire\u201d of villages, \u201coften with inhabitants locked inside burning houses\u201d.<\/p>\n<p>From August 2017 onwards, such genocidal acts continued with Myanmar\u2019s resumption of \u201cclearance operations\u201d on a more massive and wider geographical scale\u201d, it continued.<\/p>\n<p><a target=\"_blank\" href=\"https:\/\/news.un.org\/en\/story\/2019\/12\/1053221\" >Go to Original \u2013 news.un.org<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>11 Dec 2019 &#8211;
