{"id":168087,"date":"2020-09-07T12:00:20","date_gmt":"2020-09-07T11:00:20","guid":{"rendered":"https:\/\/www.transcend.org\/tms\/?p=168087"},"modified":"2020-09-04T08:38:39","modified_gmt":"2020-09-04T07:38:39","slug":"portuguese-youth-activists-sue-33-countries-over-climate-crisis","status":"publish","type":"post","link":"https:\/\/www.transcend.org\/tms\/2020\/09\/portuguese-youth-activists-sue-33-countries-over-climate-crisis\/","title":{"rendered":"Portuguese Youth Activists Sue 33 Countries over Climate Crisis"},"content":{"rendered":"<blockquote>\n<p class=\"intro\"><em>In the latest example of a wave of climate litigation across the world, six young people this week filed a case to the European Court of Human Rights in Strasbourg, asking for accountability around the climate crisis.<\/em><\/p>\n<\/blockquote>\n<div class=\"col3\">\n<div class=\"picBox full\"><a target=\"_blank\" href=\"https:\/\/www.dw.com\/en\/portugal-youthprotest-legal-humanrights-emissions-strasbourg-climatechange\/a-54799620?maca=en-VAM_volltext_ecowatch-28485-html-copypaste#\" class=\"overlayLink init\"  rel=\"nofollow\"> <img decoding=\"async\" class=\"aligncenter\" title=\"Four of the youth activists from Portugal filing a case to the European Court of Human Rights in Strasbourg\" src=\"https:\/\/www.dw.com\/image\/54800023_303.jpg\" alt=\"Four of the youth activists from Portugal filing a case to the European Court of Human Rights in Strasbourg\" \/> <\/a><\/div>\n<div class=\"group\">\n<div class=\"longText\">\n<p><em>3 Sep 2020 &#8211;<\/em>In what is being described as an unprecedented climate case, four children and two young adults from Portugal have filed a complaint at the European Court of Human Rights in Strasbourg against 33 industrialized countries.<\/p>\n<p>The young people, supported by the Global Legal Action Network (GLAN), <a href=\"https:\/\/youth4climatejustice.org\/assets\/images\/GLAN_COURT_APPLICATION_2020.09.02.pdf\" class=\"icon external\"  target=\"_blank\" rel=\"nofollow noopener noreferrer\">allege the countries<\/a> \u2014 which include Germany, the UK, Russia and Portugal \u2014 have failed to enact the <a target=\"_blank\" href=\"https:\/\/www.dw.com\/en\/why-are-high-emission-countries-lagging-on-climate-protection\/a-51644769\" >emission cuts<\/a> needed to protect their futures.<\/p>\n<p>The case focuses on countries whose policies lawyers argue are too weak to meet the 1.5 degrees Celsius\u00a0<a target=\"_blank\" href=\"https:\/\/www.dw.com\/en\/kyoto-protocol-climate-treaty\/a-52375473\" >Paris Agreement<\/a>\u00a0goal. They cite the country ratings of the <a href=\"https:\/\/climateactiontracker.org\/countries\/\" class=\"icon external\"  target=\"_blank\" rel=\"nofollow noopener noreferrer\">Climate Action Tracker<\/a>.<\/p>\n<p>The plaintiffs range from age\u00a08 to 21 and come from Lisbon and Leiria in Portugal. The case states climate change poses a rising threat to the six young people&#8217;s lives and physical and mental well-being. It invokes\u00a0<a target=\"_blank\" href=\"https:\/\/www.dw.com\/en\/un-rights-body-climate-change-could-be-grounds-for-asylum\/a-52101672\" >human rights<\/a>\u00a0arguments \u2014 including the right to life, a home and to family \u2014 as well as claiming discrimination.<\/p>\n<p>&#8220;Our generation is living in an age of great danger and uncertainty, so our voice must be heard,&#8221;\u00a0said Andre Oliveira, 12, whose father is translating for him.<\/p>\n<div class=\"picBox full\nrechts\n\"><a target=\"_blank\" href=\"https:\/\/www.dw.com\/en\/portugal-youthprotest-legal-humanrights-emissions-strasbourg-climatechange\/a-54799620?maca=en-VAM_volltext_ecowatch-28485-html-copypaste#\" class=\"overlayLink init\"  rel=\"nofollow\"> <img decoding=\"async\" class=\"aligncenter\" title=\"Andre and Sofia, two of the young people from Portugal filing a climate case in Strasbourg\" src=\"https:\/\/www.dw.com\/image\/54800892_401.jpeg\" alt=\"Andre and Sofia, two of the young people from Portugal filing a climate case in Strasbourg\" \/> <\/a><\/p>\n<p style=\"text-align: center;\"><strong>Andre, 12, and his sister Sofia, 15, are two of the six young people filing the climate case in Strasbourg\u00a0<\/strong><\/p>\n<\/div>\n<div class=\"picBox full\nrechts\n\"><a target=\"_blank\" href=\"https:\/\/www.dw.com\/en\/portugal-youthprotest-legal-humanrights-emissions-strasbourg-climatechange\/a-54799620?maca=en-VAM_volltext_ecowatch-28485-html-copypaste#\" class=\"overlayLink init\"  rel=\"nofollow\"> <img decoding=\"async\" class=\"aligncenter\" title=\"The European Court of Human Rights in Strasbourg, France\" src=\"https:\/\/www.dw.com\/image\/45731973_401.jpg\" alt=\"The European Court of Human Rights in Strasbourg, France\" \/> <\/a><\/p>\n<p style=\"text-align: center;\"><strong>The climate case is the first of its kind to be filed at the European Court of Human Rights<\/strong><\/p>\n<\/div>\n<p>&#8220;It&#8217;s clearly not the case that young people are the only people vulnerable to the effects of climate change,&#8221;\u00a0said Gerry Liston, legal officer at GLAN. &#8220;But because they stand to <a target=\"_blank\" href=\"https:\/\/www.dw.com\/en\/children-at-risk-of-new-threats-like-climate-change-warns-unicef\/a-51290018\" >endure the worst impacts<\/a>, we&#8217;re saying the effects of failing to adequately address greenhouse gas emissions amounts to unlawful discrimination on the grounds of age.&#8221;<\/p>\n<p>&#8220;It&#8217;s not about finger-pointing, but all about giving all these 33 governments a chance to act better and faster,&#8221;\u00a0said Andre. &#8220;It is a matter of human rights and that&#8217;s why we&#8217;re going all the way to Strasbourg.&#8221;<\/p>\n<h2>A first at Strasbourg<\/h2>\n<p>While there are numerous recent and ongoing climate cases, many also involving young plaintiffs, it is the first of its kind to be brought to Strasbourg. The international court, set up in 1959, deals with alleged violations of civil and political rights set out in the European Convention on Human Rights.<\/p>\n<p>The pressing need for significant and wide-scale action among many large emitters warranted going directly to Strasbourg, rather than through domestic courts which\u00a0is more common, explains Liston. &#8220;A decision from the European Court of Human Rights is urgently required in order to provide the legally binding decision that would then filter down and prompt the change that&#8217;s required at the domestic level.&#8221;<\/p>\n<p>According to GLAN, if successful, the 33 countries would be legally bound to tackle overseas contributions to climate change, including that of multinational companies, as well as ramping up emissions cuts. Rising sea levels, the constant threat of <a target=\"_blank\" href=\"https:\/\/www.dw.com\/en\/yes-climate-change-fuels-forest-fires-but-thats-not-the-only-factor\/a-41006333\" >forest fires<\/a>\u00a0and increasingly abnormal temperatures are now part of her everyday reality. &#8220;These changes make me feel apprehensive,&#8221;\u00a0she said, adding sometimes the heat makes it hard to breathe or sleep. In July this year the<a href=\"https:\/\/www.ipma.pt\/pt\/media\/noticias\/news.detail.jsp?f=\/pt\/media\/noticias\/textos\/resumo-clima-julho-20.html\" class=\"icon external\"  target=\"_blank\" rel=\"nofollow noopener noreferrer\">hottest temperatures<\/a>\u00a0 in 90 years were registered in the country.<\/p>\n<p>&#8220;What motivated me to be involved in this case was the desire for a world where one can at least survive,&#8221;\u00a0said Catarina. &#8220;Because if nothing is done by our governments this will not happen.&#8221;<\/p>\n<p><a target=\"_blank\" href=\"https:\/\/www.dw.com\/en\/fridays-for-future-uganda-climate-change-africa-activism-food-security-water\/a-54732304\" >Climate action<\/a>, such as this case, is necessary &#8220;in order to have a future and a healthy life without fear&#8221;\u00a0said plaintiff Claudia Agostinho, 21. &#8220;Our generation and all future generations deserve this.&#8221;<\/p>\n<div class=\"picBox full\nrechts\n\"><a target=\"_blank\" href=\"https:\/\/www.dw.com\/en\/portugal-youthprotest-legal-humanrights-emissions-strasbourg-climatechange\/a-54799620?maca=en-VAM_volltext_ecowatch-28485-html-copypaste#\" class=\"overlayLink init\"  rel=\"nofollow\"> <img decoding=\"async\" class=\"aligncenter\" title=\"Power plant emitting gas\" src=\"https:\/\/www.dw.com\/image\/54575634_401.jpg\" alt=\"Power plant emitting gas\" \/> <\/a><\/p>\n<p style=\"text-align: center;\"><strong>The case focuses on 33 high emitters of greenhouse gases<\/strong><\/p>\n<\/div>\n<h2>Wave of climate litigation<\/h2>\n<p>The Strasbourg case is one of a growing wave of climate litigation around the world. <a href=\"https:\/\/www.lse.ac.uk\/granthaminstitute\/news\/climate-change-litigation-shows-no-sign-of-abating-as-plaintiffs-use-a-variety-of-strategies-to-bring-lawsuits-against-governments-and-carbon-majors\/\" class=\"icon external\"  target=\"_blank\" rel=\"nofollow noopener noreferrer\">According to the Grantham Research Institute on Climate Change and Environment<\/a>\u00a0, while the majority happen in the US, over the last year climate cases were filed across six continents, 80% of them against governments.<\/p>\n<p>It also noted a recent increase in litigation by activists and advocacy groups, and the use of human rights arguments.<\/p>\n<p>While there are ongoing cases in many countries \u2014 including South Korea, Peru, and Canada \u2014 regarding states&#8217; human rights obligations to mitigate climate change, the most recent high-profile example is the Dutch <a href=\"https:\/\/www.urgenda.nl\/en\/themas\/climate-case\/\" class=\"icon external\"  target=\"_blank\" rel=\"nofollow noopener noreferrer\">Urgenda case<\/a>\u00a0.<\/p>\n<p>In 2019 the country&#8217;s Supreme Court became the first highest level domestic court to establish a state&#8217;s duty to significantly and immediately reduce emissions in line with human rights obligations. This summer activists were <a href=\"https:\/\/www.courts.ie\/acc\/alfresco\/681b8633-3f57-41b5-9362-8cbc8e7d9215\/2020_IESC_49.pdf\/pdf#view=fitH\" class=\"icon external\"  target=\"_blank\" rel=\"nofollow noopener noreferrer\">also successful<\/a>\u00a0in taking the Irish government to court over climate action failures. She sees the Strasbourg case and growing trend of climate litigation as born of the same mounting frustration driving the <a target=\"_blank\" href=\"https:\/\/www.dw.com\/en\/cliamte-change-environment-greta-thunberg-merkel-global-strike-climate-action-luisa-neubauer\/a-54618006\" >Fridays for Future<\/a> movement &#8211; namely, that &#8220;politics is not doing enough.&#8221;<\/p>\n<p>&#8220;I wish we wouldn&#8217;t have to bring the cases,&#8221;\u00a0said Roda Verheyen, a climate lawyer working on the <a href=\"https:\/\/peoplesclimatecase.caneurope.org\/\" class=\"icon external\"  target=\"_blank\" rel=\"nofollow noopener noreferrer\">People&#8217;s Climate Case<\/a> filed against the EU institutions. &#8220;But it is essentially still the case that the level of protection afforded to our children by the legislators is too low. And that&#8217;s why the courts will keep seeing these cases.&#8221;<\/p>\n<p>Verheyen points out that in emphasizing a general duty to protect rather than challenging a specific law, the Strasbourg case is less concrete than others she has worked on.
