(Screenshot via YouTube)<\/p><\/div>\n<p><em>8 Jan 2021 &#8211; <\/em>Just two after saying \u201cno\u201d to a U.S. extradition request, Judge <a href=\"https:\/\/www.npr.org\/2021\/01\/06\/953887708\/u-k-judge-rejects-assange-bail-request-citing-flight-risk\"  target=\"_blank\" rel=\"noopener\">Vanessa Baraitser<\/a> rejected <a href=\"https:\/\/independentaustralia.net\/tag\/julian+assange\"  target=\"_blank\" rel=\"noopener\">Julian Assange\u2019s<\/a> bail application and sent him back to Belmarsh Prison. Meanwhile, the U.S. Government has confirmed they will appeal the verdict and the United Nations Special Rapporteur on Torture, Professor <a href=\"https:\/\/www.ohchr.org\/en\/issues\/torture\/srtorture\/pages\/nilsmelzer.aspx\"  target=\"_blank\" rel=\"noopener\">Nils Melzer<\/a>, called again for Assange to be immediately released.<\/p>\n<p>Despite winning his case on Monday, Julian Assange is not free yet. A bail application submitted by his legal team was rejected on Wednesday by Judge Vanessa Baraitser, who said she was satisfied there were substantial grounds for believing that the defendant would fail to surrender to custody.<\/p>\n<p>On Monday, discharging him under Section 91 of the <em><a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2003\/41\/section\/91\"  target=\"_blank\" rel=\"noopener\">Extradition Act 2003<\/a><\/em>, she stated that Mr Assange\u2019s mental condition made it <em>\u201cunjust or oppressive to extradite him\u201d<\/em>. So, after expressing concern regarding the American prison system and the fact that Assange has <em>\u201cthe intellect and determination\u201d<\/em> to get around suicide prevention measures, she seems not to detect the same risk at Belmarsh Prison in London, where the <a href=\"https:\/\/wikileaks.org\/\"  target=\"_blank\" rel=\"noopener\">WikiLeaks<\/a> founder is kept in complete isolation for 23 hours a day.<\/p>\n<blockquote>\n<p class=\"card-text\"><em><strong>Read more: <\/strong><\/em><strong><em><a target=\"_blank\" href=\"https:\/\/independentaustralia.net\/article-display\/assange-extradition-denial-how-human-rights-experts-have-responded,14674\" >Assange Extradition Denial: How Human Rights Experts Have Responded <\/a><\/em><\/strong><\/p>\n<\/blockquote>\n<p>Therefore, besides the worries generated in civil society and in the human rights sector about a judgment that is completely based on the mental health arguments and does not protect press freedom, now we know Assange will also have to wait until the appeal before hoping to regain his freedom.<\/p>\n<p>The decision goes in a totally different direction from that asked for on Tuesday by Nils Melzer, who <a href=\"https:\/\/www.ohchr.org\/EN\/NewsEvents\/Pages\/DisplayNews.aspx?NewsID=26638&amp;LangID=E\"  target=\"_blank\" rel=\"noopener\">said<\/a>:<\/p>\n<blockquote><p><em>\u201cMr Assange must now be immediately set free, rehabilitated and compensated for the abuse and arbitrariness he has been exposed to.\u201d<\/em><\/p><\/blockquote>\n<p>He was insisting on the same principles that he has been highlighting since Assange was arrested in 2019.<\/p>\n<p>According to Professor Melzer, even with a pending appeal, Assange\u2019s continued isolation in a high security prison is completely unnecessary and disproportionate:<\/p>\n<blockquote><p><em>\u201cThere is no justification whatsoever for preventing him from awaiting the final judgment in a setting where he can recover his health and live a normal family and professional life.&#8221; <\/em><\/p><\/blockquote>\n<p>The Office of the High Commissioner for Human Rights, in whose news section the statement was published, is the leading U.N. entity on human rights.<\/p>\n<p>During the hearing, the U.S. also confirmed they are planning an appeal to the High Court. Disputing Assange\u2019s bail application, counsel for the U.S. Government, <a href=\"https:\/\/3rblaw.com\/barrister\/clair-dobbin\/\"  target=\"_blank\" rel=\"noopener\">Clair Dobbin<\/a>, told the court that in 2012, while on bail over a <a href=\"https:\/\/en.wikipedia.org\/wiki\/Assange_v_Swedish_Prosecution_Authority\"  target=\"_blank\" rel=\"noopener\">Swedish charge<\/a>, Assange went to the Ecuadorian embassy in London to avoid being extradited to Sweden.<\/p>\n<blockquote><p><strong><em>Read more: <a target=\"_blank\" href=\"https:\/\/independentaustralia.net\/article-display\/assange-case-the-right-decision-for-the-wrong-reason,14668\" >Assange Case: The &#8216;Right Decision for the Wrong Reason&#8217;<\/a><\/em><\/strong><\/p><\/blockquote>\n<div class=\"row no-gutters my-5\">\n<div class=\"col-md-8 border-top border-bottom border-right p-3 artcardw\">\n<blockquote>\n<p class=\"card-text\"><strong><em><a target=\"_blank\" href=\"https:\/\/independentaustralia.net\/article-display\/assange-case-the-right-decision-for-the-wrong-reason,14668\" class=\"text-dark\" >Why did a British judge\u00a0reject\u00a0the U.S. Government&#8217;s attempt to extradite Assange, despite accepting &#8220;virtually all of the allegations&#8221; against him?<\/a><\/em><\/strong><\/p>\n<\/blockquote>\n<\/div>\n<\/div>\n<p><a href=\"https:\/\/en.wikipedia.org\/wiki\/Edward_Fitzgerald_(barrister)\"  target=\"_blank\" rel=\"noopener\">Edward Fitzgerald<\/a> QC, from the defence team, highlighted that the situation is now completely different, not only because Mr Assange would be monitored via GPS but for the fact that the decision not to allow extradition gave Assange a huge motive to stay in the UK. He also mentioned the fact that the appeal just announced was probably not even in the intentions of the new American administration, as stated by <a href=\"https:\/\/en.wikipedia.org\/wiki\/G._Zachary_Terwilliger\"  target=\"_blank\" rel=\"noopener\">Zachary Terwilliger<\/a>, the federal prosecutor seeking to extradite the WikiLeaks publisher and interviewed by <a href=\"https:\/\/www.npr.org\/2021\/01\/05\/953280737\/will-biden-doj-pursue-assange-extradition-outgoing-prosecutor-isnt-sure?t=1609887929913&amp;fbclid=IwAR3zSCcqyJ2pRZvh62zhT9xtwwadFb8NFCQG-rnG1DYi76Umw-l_DyuE86E\"  target=\"_blank\" rel=\"noopener\">NPR<\/a> in the past few days.<\/p>\n<p>From President-elect <a href=\"https:\/\/en.wikipedia.org\/wiki\/Joe_Biden\"  target=\"_blank\" rel=\"noopener\">Joe Biden\u2019s<\/a> side, no direct comment was made on what position it would take in the Assange case. However, as reported by NPR, a spokesperson stated that Biden would like to see an independent Justice Department during his administration.<\/p>\n<p>Many other voices have commented on the outcome of the Judge\u2019s decisions. A new petition has been launched by <a href=\"https:\/\/diem25.org\/about\/\"  target=\"_blank\" rel=\"noopener\">DiEM25<\/a>, a pan-European movement for the democratisation of Europe, in order to call for Assange\u2019s immediate release.<\/p>\n<p>They <a href=\"https:\/\/i.diem25.org\/en\/petitions\/43\"  target=\"_blank\" rel=\"noopener\">stated<\/a>:<\/p>\n<blockquote><p><em>\u2018If Wikileaks cannot be protected from prosecution for releasing a video that everyone agrees shows a war crime (the gunning-down of Afghan civilians and a Reuters journalist from a U.S. military helicopter) and that was republished in countless newspapers around the world, what kind of reporting will be protected?\u2019<\/em><\/p><\/blockquote>\n<p>This is exactly the reason why human rights organisations and grassroots movements will keep going in seeking justice, aware that, as the U.N.
