September 16, 2020.<br \/>(European Parliament\/CC-BY-4.0)<\/p><\/div>\n<p><em>19 Apr 2021 &#8211; <\/em>Since the International Holocaust Remembrance Alliance (IHRA) <a href=\"https:\/\/www.holocaustremembrance.com\/resources\/working-definitions-charters\/working-definition-antisemitism\"  target=\"_blank\" rel=\"noopener\">adopted<\/a> its \u201cworking definition of antisemitism\u201d in May 2016, various Israeli organizations \u2014 some of them with reported links to the Israeli government \u2014 have been promoting the definition with the aim of <a href=\"https:\/\/palestinelegal.org\/distorted-definition\"  target=\"_blank\" rel=\"noopener\">discrediting and undermining<\/a> civil society work challenging Israel\u2019s occupation of Palestine.<\/p>\n<p>One of these groups is NGO Monitor, which has been criticized for <a href=\"http:\/\/policyworkinggroup.org.il\/report_en.pdf\"  target=\"_blank\" rel=\"noopener\">targeting the funding sources<\/a> of organizations that are critical of Israel. Another is the International Legal Forum (ILF), a legal network that is seen to be <a href=\"https:\/\/www.ilfngo.org\/activities\"  target=\"_blank\" rel=\"noopener\">countering international pressure<\/a> against Israeli government policies. Both groups have been part of a wider campaign in recent years that has led to the shrinking of civic space for rights-based advocacy and activism on Israel and Palestine.<\/p>\n<p>The IHRA definition has become a major project for these Israel advocacy organizations. In recent weeks, the ILF, for example, helped organize an <a href=\"https:\/\/adoptihra.com\/supporting-ihra\/\"  target=\"_blank\" rel=\"noopener\">open letter by scholars<\/a> in support of the definition. The definition also features prominently in the ILF\u2019s <a target=\"_blank\" href=\"https:\/\/98f2f7f5-93ed-4a21-b23f-3f28cbb690f5.filesusr.com\/ugd\/f46e09_2159cedc50ed4fcb93da205d603cfd37.pdf\" >recent report<\/a>, \u201cAntisemitism &amp; De-Legitimization.\u201d The group even has a dedicated <a href=\"https:\/\/www.ilfngo.org\/ihra\"  target=\"_blank\" rel=\"noopener\">webpage<\/a> promoting a <a href=\"https:\/\/98f2f7f5-93ed-4a21-b23f-3f28cbb690f5.filesusr.com\/ugd\/3445b6_0c14c0546d8c4565a04cc9c95a707382.pdf\"  target=\"_blank\" rel=\"noopener\">legal analysis<\/a> that argues the definition \u201cprovides, for the first time in historic (sic), an objective standard to identify the antisemitic motives or objectives behind discriminatory acts\u201d and to \u201cclearly identify and understand what constitutes antisemitism.\u201d<\/p>\n<p>However, the IHRA definition is hardly an objective standard. As many critics have <a href=\"https:\/\/www.972mag.com\/antisemitism-israel-jews-ihra\/\"  target=\"_blank\" rel=\"noopener\">highlighted<\/a>, the definition lacks clarity and demarcation, which makes it vulnerable to misinterpretation and <a href=\"https:\/\/www.972mag.com\/trump-executive-order-aid-israel\/\"  target=\"_blank\" rel=\"noopener\">manipulations<\/a>. Indeed, the ILF doesn\u2019t treat the IHRA definition as a symbolic statement \u2014 it wants it to be practically applied by government agencies and officials, including the police, public prosecutors, and judges.<\/p>\n<h3><strong>Operationalizing the definition<\/strong><\/h3>\n<p>Regrettably, the European Commission played into the ILF\u2019s and NGO Monitor\u2019s agendas when, on January 7, 2021, <a href=\"https:\/\/op.europa.eu\/en\/publication-detail\/-\/publication\/d3006107-519b-11eb-b59f-01aa75ed71a1\/language-en\"  target=\"_blank\" rel=\"noopener\">it published<\/a> a \u201cHandbook for the practical use of the IHRA working definition of antisemitism.\u201d The handbook represents an ambitious action plan for the operationalization and entrenchment of the IHRA definition across multiple policy areas, from education to justice to civil society funding.<\/p>\n<p>A coalition of progressive Belgian NGOs, unions, and solidarity groups, called \u201c11.11.11,\u201d responded with a useful and informative <a href=\"https:\/\/11.be\/verhalen\/european-commission-handbook-entrenches-controversial-ihra-definition-antisemitism\"  target=\"_blank\" rel=\"noopener\">briefing paper<\/a> raising eight concerns about this handbook, some of which are summarized below.<\/p>\n<p>While the handbook was published with the European Commission\u2019s official logo, it was in fact authored by RIAS (the Federal Association of Departments for Research and Information on Antisemitism), a body <a target=\"_blank\" href=\"https:\/\/report-antisemitism.de\/en\/rias-bund\" >funded<\/a> by Germany\u2019s antisemitism czar, Dr. Felix Klein, who operates under the country\u2019s Interior Ministry. Klein has been a <a href=\"https:\/\/www.972mag.com\/achille-mbembe-germany-israel-antisemitism\/\"  target=\"_blank\" rel=\"noopener\">driving force<\/a> in Germany behind the political instrumentalization of the fight against antisemitism, particularly against groups supportive of BDS, resulting in <a href=\"https:\/\/www.dropbox.com\/s\/149fdvh7zx70opk\/Call%20to%20Minister%20Seehofer%20to%20replace%20Felix%20Klein.pdf?dl=0\"  target=\"_blank\" rel=\"noopener\">calls<\/a> for his resignation.<\/p>\n<p>According to the handbook, RIAS relied on a number of politically motivated stakeholders to produce its contents. For example, in <a href=\"http:\/\/www.wiesenthal.com\/about\/news\/top-10\/top-ten-2015-pdf.pdf\"  target=\"_blank\" rel=\"noopener\">2015<\/a>, the Wiesenthal Center listed the European Union as antisemitic for its decision to label Israeli settlement products. In <a href=\"https:\/\/www.wiesenthal.com\/about\/news\/top-10\/top-ten-2016.pdf\"  target=\"_blank\" rel=\"noopener\">2016<\/a>, France was placed on the list for the same reason. In <a href=\"https:\/\/www.wiesenthal.com\/assets\/pdf\/2018-top-ten-anti-semitic-2.pdf\"  target=\"_blank\" rel=\"noopener\">2018<\/a>, the center listed a German bank as antisemitic for hosting the account of a Jewish group that supports BDS. In <a href=\"http:\/\/www.wiesenthal.com\/assets\/pdf\/top-ten-anti-semitic.pdf\"  target=\"_blank\" rel=\"noopener\">2019<\/a>, it branded Germany\u2019s UN Ambassador Christoph Heusgen as antisemitic following his criticism of Israel in the UN Security Council.<\/p>\n<p>Among the other contributors to the handbook is the chair of the board of IIBSA (the International Institute for Education and Research on Antisemitism), a German organization that published a <a target=\"_blank\" href=\"https:\/\/iibsa.org\/publikation-die-antisemitische-boykottkampagne-bds-eine-handreichung\/\" >report<\/a> in 2018 framing the BDS movement as antisemitic.<\/p>\n<p>Interestingly, the European Commission handbook does not make any mention of BDS by name. However, it does promote as \u201cgood practice examples\u201d two resolutions passed by the French and Austrian parliaments that associated BDS with antisemitism. Conveniently for its authors, the handbook does not reference the <a href=\"https:\/\/hudoc.echr.coe.int\/app\/conversion\/pdf?library=ECHR&amp;id=003-6718555-8953654&amp;filename=Baldassi%20and%20Others%20v.%20France%20-%20criminal%20conviction%20of%20activists%20involved%20in%20the%20campaign%20boycotting%20products%20imported%20from%20Israel%20violated%20their%20freedom%20of%20expression.pdf\"  target=\"_blank\" rel=\"noopener\">landmark ruling<\/a> by the European Court of Justice in June 2020 affirming BDS as free speech.<\/p>\n<p>The handbook\u2019s ambiguity extends beyond BDS. Nowhere does it acknowledge the growing <a href=\"https:\/\/blogs.timesofisrael.com\/whos-against-adopting-the-ihra-antisemitism-definition\/\"  target=\"_blank\" rel=\"noopener\">concerns<\/a> about the IHRA definition and how it is being instrumentalized, <a href=\"https:\/\/jerusalemdeclaration.org\/\"  target=\"_blank\" rel=\"noopener\">as articulated<\/a> by countless scholars and civil society organizations, including <a href=\"https:\/\/www.972mag.com\/palestine-legal-boycott-ihra-israel\/\"  target=\"_blank\" rel=\"noopener\">civil liberties groups<\/a>. Even Kenneth Stern, the main drafter of the IHRA definition, has <a href=\"https:\/\/www.theguardian.com\/commentisfree\/2019\/dec\/13\/antisemitism-executive-order-trump-chilling-effect\"  target=\"_blank\" rel=\"noopener\">spoken out<\/a> against the weaponization of the definition to undermine free speech, particularly at universities.<\/p>\n<h3><strong>Far-reaching implications<\/strong><\/h3>\n<p>The effects of the European Commission handbook may have real, practical consequences on those who advocate for Palestinian rights and critique Israeli policy. Firstly, it facilitates the ILF\u2019s agenda to attribute quasi-legal effect to the IHRA definition, including its Israel-related examples. It proposes that governments and international actors introduce conditionality on their funding based on the IHRA definition, suggesting that \u201cinitiatives and organizations that base their actions on the [definition]\u201d should be prioritized for financial support. The handbook also recommends that governments and international actors use the definition as a \u201ccontrol mechanism to avoid funding for antisemitic groups and projects\u201d \u2014 in other words, to exclude groups or projects perceived as violating the IHRA definition, according to political interpretation.<\/p>\n<p>In this context, the handbook treats the \u201ccontemporary examples of antisemitism\u201d as an integral part of the IHRA definition. This contradicts earlier EU declarations, from which the examples were deliberately <a href=\"https:\/\/data.consilium.europa.eu\/doc\/document\/ST-15213-2018-INIT\/en\/pdf\"  target=\"_blank\" rel=\"noopener\">omitted<\/a>. Now, because the handbook includes them, its policy recommendations for law enforcement authorities and on funding conditionality effectively extend to the Israel-related examples attached to the definition. This could have far-reaching implications.<\/p>\n<p>It didn\u2019t take long for NGO Monitor to seize the opportunity presented by the handbook. Merely 18 days after the European Commission published the document, NGO Monitor released a <a href=\"https:\/\/www.ngo-monitor.org\/reports\/ihra-policy-paper\/\"  target=\"_blank\" rel=\"noopener\">policy paper<\/a> entitled \u201cImplementing the IHRA Definition of Antisemitism for NGO Funding.\u201d<\/p>\n<p>This reveals the extent to which the European Union has entangled itself with actors and agendas that are weaponizing the IHRA definition for motives other than fighting antisemitism. This is especially disturbing at a time when the Israeli government is <a href=\"https:\/\/mobile.twitter.com\/giladerdan1\/status\/1357846325065355265?s=19\"  target=\"_blank\" rel=\"noopener\">accusing<\/a> the International Criminal Court of antisemitism for intending to investigate suspected war crimes committed in the occupied territories. That same Israeli government, unsurprisingly, has <a href=\"https:\/\/twitter.com\/LiorHaiat\/status\/1348339565011075074\"  target=\"_blank\" rel=\"noopener\">warmly welcomed<\/a> the European Commission\u2019s handbook for making the IHRA definition \u201ca central instrument\u201d in fighting antisemitism.<\/p>\n<p>___________________________________________<\/p>\n<div class=\"author-meta flex no-avatar\">\n<div class=\"bio\">\n<p style=\"padding-left: 40px;\"><em><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2021\/04\/Ambassador-Ilan-Baruch-israel-palestine.jpg\" ><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-183777 size-full alignleft\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2021\/04\/Ambassador-Ilan-Baruch-israel-palestine-e1619423682863.jpg\" alt=\"\" width=\"100\" height=\"75\" \/><\/a>Ambassador (ret.)
