{"id":184816,"date":"2021-05-17T12:00:56","date_gmt":"2021-05-17T11:00:56","guid":{"rendered":"https:\/\/www.transcend.org\/tms\/?p=184816"},"modified":"2021-05-11T06:42:39","modified_gmt":"2021-05-11T05:42:39","slug":"six-more-lawsuits-filed-against-syngenta-and-chevron-over-pesticide-that-causes-parkinsons-disease","status":"publish","type":"post","link":"https:\/\/www.transcend.org\/tms\/2021\/05\/six-more-lawsuits-filed-against-syngenta-and-chevron-over-pesticide-that-causes-parkinsons-disease\/","title":{"rendered":"Six More Lawsuits Filed Against Syngenta and Chevron Over Pesticide That Causes Parkinson\u2019s Disease"},"content":{"rendered":"<blockquote>\n<p class=\"post-excerpt\"><em>More than a dozen similar lawsuits already filed in U.S. courts. <\/em><em>First trial set for May 10.<\/em><\/p>\n<\/blockquote>\n<p><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2021\/05\/lawsuits-against-Syngenta-Parkinsons-disease-feature-1-800x417-1.jpg\" ><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-184817\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2021\/05\/lawsuits-against-Syngenta-Parkinsons-disease-feature-1-800x417-1.jpg\" alt=\"\" width=\"400\" height=\"209\" srcset=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2021\/05\/lawsuits-against-Syngenta-Parkinsons-disease-feature-1-800x417-1.jpg 800w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2021\/05\/lawsuits-against-Syngenta-Parkinsons-disease-feature-1-800x417-1-300x156.jpg 300w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2021\/05\/lawsuits-against-Syngenta-Parkinsons-disease-feature-1-800x417-1-768x400.jpg 768w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><\/a><\/p>\n<p><em>3 May 2021 &#8211; <\/em>Six more lawsuits alleging <a target=\"_blank\" href=\"https:\/\/childrenshealthdefense.org\/defender\/syngenta-weedkiller-cheaper-not-safer\/\" >Syngenta\u2019s<\/a> weed killing pesticide paraquat <a target=\"_blank\" href=\"https:\/\/childrenshealthdefense.org\/defender\/lawsuits-syngenta-paraquat-parkinsons-disease\/\" >causes Parkinson\u2019s Disease<\/a> were filed last week in Pennsylvania, California and Illinois, adding to more than a dozen similar lawsuits already filed in U.S. courts.<\/p>\n<p>The lawsuits all allege that exposure to paraquat, which is banned in more than 30 countries though not in the U.S., causes the incurable and progressive Parkinson\u2019s disorder that affects nerve cells in the brain, leading in advanced cases to severe physical debilitation and often dementia and death.<\/p>\n<p>Many Parkinson\u2019s experts say the disease can be caused by a range of factors, including exposure to pesticides such as paraquat, as well as <a target=\"_blank\" href=\"https:\/\/childrenshealthdefense.org\/defender\/epa-pesticides-harm-people-wildlife\/\" >other chemicals<\/a>.<\/p>\n<p>The first trial set to take place in the U.S. is to begin on May 10 in St. Clair County Circuit Court in Illinois. Missouri lawyer Steve Tillery is representing the plaintiffs in <a href=\"https:\/\/usrtk.org\/wp-content\/uploads\/2021\/03\/Hoffmann-v.-Syngenta-Crop-Illinois-Tillery-3.pdf\"  target=\"_blank\" rel=\"noopener\">Hoffman V. Syngenta<\/a> and said he plans to introduce evidence that includes internal company records showing Syngenta has known for decades that its product causes Parkinson\u2019s Disease.<\/p>\n<p>The defendants in the Hoffman case, as well as the other cases filed, name the Swiss-based Syngenta and Chevron USA as defendants.<\/p>\n<p>Both Chevron and Syngenta deny there is a connection between the disease and the weed killer.<\/p>\n<p>Chevron distributed and sold paraquat products in the U.S. starting with an agreement with a Syngenta predecessor called Imperial Chemical Industries, which introduced a paraquat-based herbicide called Gramoxone in 1962. Under a license agreement, Chevron had the right to manufacture, use and sell paraquat formulations in the U.S.<\/p>\n<p>Syngenta says that its paraquat products have been approved as \u201csafe and effective\u201d for more than 50 years and it will \u201cvigorously\u201d defend the lawsuits. Syngenta is owned by China National Chemical Corporation, known as ChemChina.<\/p>\n<p>The complaints were filed on April 30 by a team of law firms: <a href=\"http:\/\/www.dicellolevitt.com\/\"  target=\"_blank\" rel=\"noopener\">DiCello Levitt Gutzler<\/a>, <a href=\"http:\/\/www.smbb.com\/\"  target=\"_blank\" rel=\"noopener\">Saltz Mongeluzzi &amp; Bendesky, P.C.<\/a> and\u00a0 <a href=\"http:\/\/www.searcylaw.com\/\"  target=\"_blank\" rel=\"noopener\">Searcy Denney<\/a>.<\/p>\n<p>Mark DiCello, one of the plaintiffs\u2019 attorneys bringing the cases, said Chevron and Syngenta have \u201clong known they were peddling this poison,\u201d and that the science surrounding paraquat \u201cis conclusively on the side of the plaintiffs.\u201d<\/p>\n<p>Jeffrey Goodman, another of the plaintiffs\u2019 attorneys helping bring the litigation said the filings so far are but the \u201ctip of the iceberg\u201d of what he expects to expand into a major mass tort case.<\/p>\n<p>\u201cThe manufacturers of paraquat knew for decades that their product was linked to Parkinson\u2019s disease yet chose to hide this information from regulators and the public,\u201d Goodman said.<\/p>\n<p>The newly filed cases are:<\/p>\n<ul>\n<li aria-level=\"1\"><a href=\"https:\/\/www.smbb.com\/wp-content\/uploads\/2021\/05\/Crane-et-al.-v.-Syngenta-Crop-Protection-LLC-et-al.-Complaint.pdf\"  target=\"_blank\" rel=\"noopener\">Eastern District of Pennsylvania, No. 2:21-cv-01996-JMY<\/a><\/li>\n<li aria-level=\"1\"><a href=\"https:\/\/www.smbb.com\/wp-content\/uploads\/2021\/05\/Copas-et-al.-v.-Syngenta-Crop-Protection-LLC-et-al.-Complaint.pdf\"  target=\"_blank\" rel=\"noopener\">Eastern District of Pennsylvania, No. 2:21-02013<\/a><\/li>\n<li aria-level=\"1\"><a href=\"https:\/\/www.smbb.com\/wp-content\/uploads\/2021\/05\/Friday-et-al.-v.-Syngenta-Crop-Protection-LLC-et-al.-Complaint.pdf\"  target=\"_blank\" rel=\"noopener\">Eastern District of Pennsylvania, No. 2:1:02016<\/a><\/li>\n<li aria-level=\"1\"><a href=\"https:\/\/www.smbb.com\/wp-content\/uploads\/2021\/05\/Shea-et-al.-v.-Syngenta-Crop-Protection-LLC-et-al.-Complaint.pdf\"  target=\"_blank\" rel=\"noopener\">Southern District of Illinois, No. 3:21-cv-00439<\/a><\/li>\n<li aria-level=\"1\"><a href=\"https:\/\/www.smbb.com\/wp-content\/uploads\/2021\/05\/Milling-et-al.-v.-Syngenta-Crop-Protection-LLC-et-al-Complaint.pdf\"  target=\"_blank\" rel=\"noopener\">Northern District of California, No. 3:21-cv-03233<\/a><\/li>\n<li aria-level=\"1\"><a href=\"https:\/\/www.smbb.com\/wp-content\/uploads\/2021\/05\/Parsons-v.-Syngenta-Crop-Protection-LLC-et-al.-Complaint.pdf\"  target=\"_blank\" rel=\"noopener\">Northern District of California, No. 3:21-cv-03229<\/a><\/li>\n<\/ul>\n<p>The new cases<a href=\"https:\/\/usrtk.org\/pesticides\/move-to-consolidate-u-s-paraquat-litigation-as-cases-mount-against-syngenta\/\"  target=\"_blank\" rel=\"noopener\"> join at least 14 lawsuits<\/a> filed by eight different law firms in six different federal courts across the country.<\/p>\n<p>______________________________________________________<\/p>\n<p style=\"padding-left: 40px;\"><em><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2021\/05\/Carey-Gillam.jpg\" ><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-184818 size-full\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2021\/05\/Carey-Gillam-e1620708937346.jpg\" alt=\"\" width=\"100\" height=\"100\" \/><\/a>Carey Gillam has spent more than 25 years reporting on corporate America.
