The Defender\/Sustainable Pulse<\/p><\/div>\n<p><em>22 Sep 2021 &#8211; <\/em>Baum Hedlund Aristei &amp; Goldman class action attorneys announced Tuesday [21 Sep] the resolution of the <a href=\"https:\/\/www.baumhedlundlaw.com\/toxic-tort-law\/monsanto-roundup-lawsuit\/roundup-class-action-lawsuit\/\"  target=\"_blank\" rel=\"noopener\">Monsanto class action litigation<\/a> concerning the misleading label for the company\u2019s <a target=\"_blank\" href=\"https:\/\/childrenshealthdefense.org\/defender\/bayer-roundup-cancer-trial-appeal-rules-plaintiffs-alva-alberta-pilliod\/\" >Roundup<\/a> weedkiller.<\/p>\n<p><a target=\"_blank\" href=\"https:\/\/childrenshealthdefense.org\/defender\/bayer-roundup-cancer-trial-appeal-rules-plaintiffs-alva-alberta-pilliod\/\" >Bayer AG<\/a>, which acquired Monsanto Company in 2018, agreed to settle the case of Lisa Jones et al. v. <a target=\"_blank\" href=\"https:\/\/childrenshealthdefense.org\/defender\/epa-buried-internal-report-monsanto-glyphosate-non-hodgkin-lymphoma\/\" >Monsanto Company<\/a> for $39.5 million and will make changes to the Roundup product label.<\/p>\n<p>The class had alleged that Monsanto engaged in illegal marketing, distribution, promotion and sale of certain Roundup weedkiller products because a statement on some product labels that <a href=\"https:\/\/www.baumhedlundlaw.com\/toxic-tort-law\/monsanto-roundup-lawsuit\/what-is-glyphosate-herbicide\/\"  target=\"_blank\" rel=\"noopener\">glyphosate<\/a>, a key Roundup ingredient, \u201ctargets an enzyme found in plants but not in people or pets,\u201d is false and misleading.<\/p>\n<p>The allegations in Lisa Jones et al. v. Monsanto Company (Case No. 19-0102-CV-W-BP) go back to 2015 when several class action lawsuits were filed against Monsanto concerning the Roundup label.<\/p>\n<p>Baum Hedlund had filed one such lawsuit in 2017 on behalf of six consumers in the Western District of Wisconsin. <a href=\"https:\/\/www.baumhedlundlaw.com\/blog\/2017\/june\/monsanto-faces-wisconsin-roundup-class-action-la\/\"  target=\"_blank\" rel=\"noopener\">Blitz v. Monsanto Company<\/a> (Case No. 3:17-cv-00473) was dismissed after substantial discovery and pretrial motions, though many of the substantive allegations in that case remained in the Jones complaint.<\/p>\n<p>Last March, class action attorneys for the plaintiffs in Jones filed a motion seeking preliminary approval for a class action settlement. Months later, the court granted <a href=\"https:\/\/sustainablepulse.com\/2020\/03\/30\/monsanto-to-pay-39-m-in-roundup-false-ad-class-settlement\/#.YUr2PbgzZPY\"  target=\"_blank\" rel=\"noopener\">preliminary approval<\/a> of the agreement and created a $39.5 million settlement fund.<\/p>\n<p>Notably, the settlement agreement also required Monsanto (Bayer) to remove the false and misleading statement from the Roundup product label.<\/p>\n<p>During the course of litigation, Baum Hedlund vice president and senior shareholder <a href=\"https:\/\/www.baumhedlundlaw.com\/attorneys\/r-brent-wisner\/\"  target=\"_blank\" rel=\"noopener\">R. Brent Wisner<\/a> got Monsanto to concede that <a target=\"_blank\" href=\"https:\/\/childrenshealthdefense.org\/defender\/stephanie-seneff-toxic-legacy-glyphosate-destroying-our-health\/\" >glyphosate<\/a> influences an enzyme in the <a target=\"_blank\" href=\"https:\/\/childrenshealthdefense.org\/defender\/roundup-weedkiller-disrupts-gut-microbiome-new-study\/\" >human gut biome<\/a>, which could lead to significant health effects.<\/p>\n<p>Wisner also conducted several science and liability depositions, including two of Monsanto that forced the company into a position where settling the litigation made sense. He and Baum Hedlund\u2019s managing partner, <a href=\"https:\/\/www.baumhedlundlaw.com\/attorneys\/michael-l-baum\/\"  target=\"_blank\" rel=\"noopener\">Michael L. Baum<\/a>, were among the attorneys of record in the Monsanto Roundup class action litigation.<\/p>\n<p>\u201cThe importance of the class action litigation cannot be understated,\u201d stated Wisner. \u201cFor decades, Monsanto told people that Roundup could not affect humans. Consumers were never informed of Roundup\u2019s true risks because Monsanto made misrepresentations and omitted material information on its label.\u00a0By demonstrating through litigation that the Roundup label was misleading, consumers now have a chance to make a more informed choice to avoid a dangerous chemical moving forward. This case is another example where litigation was the key to making meaningful and necessary changes to protect human health.\u201d<\/p>\n<p>Class members will receive up to half of the average retail price of purchased Roundup products. The specific refund amounts range between $0.37 to $10.63 with a maximum payment after adjustments of up to $2.51 to $53.15.
