{"id":204502,"date":"2022-02-07T12:00:09","date_gmt":"2022-02-07T12:00:09","guid":{"rendered":"https:\/\/www.transcend.org\/tms\/?p=204502"},"modified":"2024-06-12T21:24:07","modified_gmt":"2024-06-12T20:24:07","slug":"amnesty-apartheid-report-the-walls-protecting-israel-are-finally-crumbling","status":"publish","type":"post","link":"https:\/\/www.transcend.org\/tms\/2022\/02\/amnesty-apartheid-report-the-walls-protecting-israel-are-finally-crumbling\/","title":{"rendered":"Amnesty Apartheid Report: The Walls Protecting Israel Are Finally Crumbling"},"content":{"rendered":"<blockquote><p><em>With the publication of Amnesty International\u2019s new apartheid report, Israel\u2019s supporters have just one tactic left: to accuse critics of antisemitism.<\/em><\/p><\/blockquote>\n<p><em>2 Feb 2022 &#8211; <\/em>The walls protecting Israel are quickly crumbling. A year ago, it was Israel\u2019s most celebrated human rights group, <a href=\"https:\/\/www.btselem.org\/publications\/fulltext\/202101_this_is_apartheid\"  target=\"_blank\" rel=\"noopener\">B\u2019Tselem<\/a>. Months later, it was the New York-based <a href=\"https:\/\/www.hrw.org\/report\/2021\/04\/27\/threshold-crossed\/israeli-authorities-and-crimes-apartheid-and-persecution\"  target=\"_blank\" rel=\"noopener\">Human Rights Watch<\/a>, whose senior staff have often enjoyed a revolving door with the US State Department.<\/p>\n<p>Now, the one speaking up is Amnesty International \u2013 an organisation widely viewed as the most authoritative arbiter of what constitutes human rights violations. Over the past year, all have reached the same conclusion: <a href=\"https:\/\/www.middleeasteye.net\/countries\/israel\"  target=\"_blank\" rel=\"noopener\">Israel<\/a> is an apartheid state. According to <a href=\"https:\/\/www.transcend.org\/tms\/2022\/02\/israels-apartheid-against-palestinians-cruel-system-of-domination-and-crime-against-humanity\/\" >Amnesty\u2019s new report<\/a> published on Tuesday [1 Feb]: \u201cIsrael\u2019s system of institutionalized segregation and discrimination against Palestinians, as a racial group, in all areas under its control amounts to a system of apartheid.\u201d<\/p>\n<p>This is not just a criticism of Israel\u2019s occupation. All three groups have been pointing out for decades Israel\u2019s flagrant disregard of international law, and its likely commission of war crimes, in the <a href=\"https:\/\/www.hrw.org\/news\/2021\/07\/27\/gaza-apparent-war-crimes-during-may-fighting\"  target=\"_blank\" rel=\"noopener\">occupied territories<\/a>.<\/p>\n<p>But Israel was little concerned, so long as public debate was confined to the occupation. Its advocates quickly learned that they could always deflect to matters of Israel\u2019s security, by presenting any Palestinian resistance as terrorism.<\/p>\n<p>Now, the consensus is shifting to entirely new terrain \u2013 a discursive battlefield where Israel has less effective weapons with which to defend itself. The biggest human rights watchdogs are agreed that everything about Israel\u2019s rule over Palestinians is connected, from its military oppression of those under occupation, to the civil legal system inside Israel that systematically confers inferior rights on the country\u2019s large minority of nominal Palestinian \u201ccitizens\u201d.<\/p>\n<p>In other words, Israel\u2019s apartheid structures cannot be disentangled, separating out the occupied territories from \u201cIsrael proper\u201d. It is all part of the same, single system of rule by one ethnic-national group, Jews, designed to oppress and marginalise another ethnic-national group, Palestinians.<\/p>\n<p>Late in the day, the champions of human rights have fully understood that the divisions between Israel and the occupied territories are simply cosmetic. They have served a public relations purpose, hiding Israel\u2019s true intent: to dispossess Palestinians wherever they find themselves under Israeli rule.<\/p>\n<h3>\u2018Not perfect\u2019<\/h3>\n<p>Crucially, all the major human rights groups have now jettisoned the key artificial distinction insisted upon by Israel. Israel\u2019s premise was that its <a href=\"https:\/\/www.aljazeera.com\/news\/2021\/5\/24\/a-war-declaration-palestinians-in-israel-decry-mass-arrests\"  target=\"_blank\" rel=\"noopener\">1.8 million Palestinian \u201ccitizens\u201d<\/a> \u2013 a fifth of the population inside Israel \u2013 faced informal and unconscious discrimination, similar to that suffered by minorities in western democracies, such as the US and UK.<\/p>\n<p>The message was intended to reassure: Israel\u2019s treatment of its Palestinian citizens was not perfect, but it was no worse than other liberal democratic states. That allowed it to rationalise its brutal, repressive treatment of Palestinians under occupation. The military occupation was supposedly an anomaly, forced on Israel by the need to protect its citizens and democratic structures from constant, unprovoked Palestinian violence and terrorism.<\/p>\n<p>Israel\u2019s foreign minister, Yair Lapid, rehearsed exactly that line in a pre-emptive strike against Amnesty. Shortly before the report was published, <a href=\"https:\/\/www.middleeasteye.net\/news\/israel-apartheid-state-amnesty-becomes-latest-rights-group\"  target=\"_blank\" rel=\"noopener\">he said<\/a>: \u201cIsrael isn\u2019t perfect, but we are a democracy committed to international law, open to criticism, with a free press and a strong and independent judicial system.\u201d For good measure, he accused Amnesty of echoing \u201cthe same lies shared by terrorist organisations\u201d.<\/p>\n<p>In Britain, the Board of Deputies of British Jews took a similar <a href=\"https:\/\/twitter.com\/BoardofDeputies\/status\/1488123882888470532\"  target=\"_blank\" rel=\"noopener\">approach<\/a>: \u201cIsrael is a vibrant democracy and a state for all its citizens, as exemplified by its diverse government and robust civil society.\u201d<\/p>\n<p>Except every mainstream Israeli politician vehemently rejects the idea that Israel could ever be a \u201cstate of all its citizens\u201d. That was the <a href=\"https:\/\/www.theguardian.com\/world\/2019\/mar\/10\/benjamin-netanyahu-says-israel-is-not-a-state-of-all-its-citizens\"  target=\"_blank\" rel=\"noopener\">expressed view<\/a> of former Prime Minister Benjamin Netanyahu. And four years ago, a council of legislators even took the rare step of banning a bill from being debated in the Israeli parliament because it <a href=\"https:\/\/www.haaretz.com\/israel-news\/.premium-knesset-council-bans-bill-to-define-israel-as-state-for-all-citizens-1.6145333\"  target=\"_blank\" rel=\"noopener\">promoted<\/a> Israel as a \u201cstate of all its citizens\u201d.<\/p>\n<p>In fact, the phrase itself is the slogan of Palestinian leaders inside Israel who have been mobilising their supporters in a <a href=\"https:\/\/www.plutobooks.com\/9781783715893\/blood-and-religion\/\"  target=\"_blank\" rel=\"noopener\">campaign<\/a> for sweeping change to end Israel\u2019s current status as a racist Jewish state. Well-worn deflection campaigns by Israel and its defenders are looking ever more threadbare.<\/p>\n<p>Amnesty has now joined B\u2019Tselem and Human Rights Watch in repudiating this narrative as a smokescreen. All have accepted that Israel\u2019s Palestinian minority faces systematic, structural and malign discrimination \u2013 and equated that <a href=\"https:\/\/www.jonathan-cook.net\/2021-02-17\/picnic-video-israel-apartheid\/\"  target=\"_blank\" rel=\"noopener\">discrimination<\/a> to the oppression of Black and \u201ccoloured\u201d populations in apartheid South Africa.<\/p>\n<p>In short, Israel\u2019s racism is not an add-on or temporary. It is hard-baked into the very idea of a Jewish state.<\/p>\n<h3>Collision course<\/h3>\n<p>The implication of all these apartheid reports is that Israel, as it is currently constituted, cannot be reformed. As with apartheid South Africa, there has to be a fundamental realignment of power within the region. Change has to be deep and all-encompassing. And as was the case with South Africa, it will not happen without strong international pressure.<\/p>\n<p>That\u2019s why Amnesty has <a href=\"https:\/\/www.amnesty.org\/en\/wp-content\/uploads\/2022\/02\/MDE1551412022ENGLISH.pdf\"  target=\"_blank\" rel=\"noopener\">called on<\/a> the UN Security Council to \u201cimpose targeted sanctions, such as asset freezes, against Israeli officials most implicated in the crime of apartheid, and a comprehensive arms embargo on Israel\u201d.<\/p>\n<p>Potentially waiting in the wings is the International Criminal Court, which is examining <a href=\"https:\/\/www.reuters.com\/world\/middle-east\/icc-prosecutor-warns-against-crimes-escalating-israel-palestinian-violence-2021-05-13\/\"  target=\"_blank\" rel=\"noopener\">Israel\u2019s violations<\/a> of international law. Amnesty has called on the war crimes court to <a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2022\/02\/israels-apartheid-against-palestinians-a-cruel-system-of-domination-and-a-crime-against-humanity\/\"  target=\"_blank\" rel=\"noopener\">extend<\/a> its deliberations to consider whether Israel is guilty of apartheid too.<\/p>\n<p>This is likely to prove a decisive moment for Israel. Its narrative, and that of the human rights community, are on a collision course.<\/p>\n<p>Once Israel\u2019s security rationale for oppressing Palestinians is dismissed, as it has been by Amnesty and others by classifying Israel as an apartheid state\u00a0even inside its recognised borders, then there is only one defensive position left: to call critics <a href=\"https:\/\/www.middleeasteye.net\/topics\/antisemitism\"  target=\"_blank\" rel=\"noopener\">antisemitic<\/a>.<\/p>\n<p>This, of course, is exactly what Israel and its supporters have been doing. Lapid\u2019s foreign ministry issued a press statement <a href=\"https:\/\/www.gov.il\/en\/departments\/news\/amnesty-uk-expected-to-publish-biased-antiemitic-report-31-jan-2022\"  target=\"_blank\" rel=\"noopener\">labelling<\/a> the report \u201cfalse, biased and antisemitic\u201d. Pro-Israel lobby groups variously <a href=\"https:\/\/www.haaretz.com\/us-news\/.premium-u-s-jewish-groups-slam-amnesty-s-israeli-apartheid-report-1.10579147\"  target=\"_blank\" rel=\"noopener\">described<\/a> Amnesty as \u201cvilifying\u201d and \u201cdemonising\u201d Israel. The UK\u2019s Board of Deputies <a href=\"https:\/\/www.jewishnews.co.uk\/amnesty-report-labelling-israel-apartheid-is-condemned-by-jewish-groups\/\"  target=\"_blank\" rel=\"noopener\">accused<\/a> Amnesty of \u201cbad faith\u201d.<\/p>\n<h3>Structural racism<\/h3>\n<p>B\u2019Tselem, Human Rights Watch and Amnesty all knew they would face a concerted campaign of vilification themselves if they dared to present Israel in a more truthful light \u2013 which is arguably why they delayed so long.<\/p>\n<p>After all, Israel did not become an apartheid state a year ago. It has been one since 1948, when it was explicitly founded as a Jewish state, premised on the mass expulsion of Palestinians from their homeland. It was just too radioactive for the human rights community to identify Israel\u2019s apartheid character until recently.<\/p>\n<p>For years, the legal group Adalah, which advocates for the Palestinian minority, has maintained an online database of Israeli laws that explicitly discriminate based on whether a citizen is Jewish or Palestinian.
