{"id":210031,"date":"2022-04-25T12:00:09","date_gmt":"2022-04-25T11:00:09","guid":{"rendered":"https:\/\/www.transcend.org\/tms\/?p=210031"},"modified":"2022-04-25T13:43:14","modified_gmt":"2022-04-25T12:43:14","slug":"europe-sweeps-away-more-refugees-asylum-seekers-part-i-uk-greece","status":"publish","type":"post","link":"https:\/\/www.transcend.org\/tms\/2022\/04\/europe-sweeps-away-more-refugees-asylum-seekers-part-i-uk-greece\/","title":{"rendered":"Europe Sweeps Away More Refugees, Asylum Seekers \u2013 Part I: UK, Greece"},"content":{"rendered":"<p><em>21 Apr 2022 &#8211; <\/em>In what looks pretty much like an \u2018operation clean sweep\u2019 aiming at getting rid of more and more migrants, refugees and asylum seekers by shipping them far away, the process of \u2018externalisation\u2019 of millions of victims of wars, poverty, climate crisis and political persecution, is now growing fast.<\/p>\n<div class=\"featimg\" align=\"center\">\n<p><img loading=\"lazy\" decoding=\"async\" class=\"attachment-storypage_img wp-post-image aligncenter\" src=\"https:\/\/www.ipsnews.net\/Library\/2022\/04\/Migrants-and-Refugees_.jpg\" alt=\"\" width=\"369\" height=\"247\" \/><\/p>\n<p class=\"wp-caption-text\" style=\"text-align: center;\"><em><strong>\u201cAt a time when the people of the UK have opened their hearts and homes to Ukrainians, the government is choosing to act with cruelty and rip up their obligations to others fleeing war and persecution\u201d says HRW report.<\/strong><\/em><\/p>\n<p class=\"wp-caption-text\" style=\"text-align: center;\"><em><strong>Credit: UNOHCR<\/strong><\/em><\/p>\n<\/div>\n<p>In fact, in a short period of time, reports by major human rights organisations have revealed how the US and Europe, in addition to Australia, are increasingly sending migrants, refugees and asylum seekers to other countries, regardless of their human rights records.<\/p>\n<div class=\"simplePullQuote3\">&#8220;They then turn the migrants over to masked men, who force them onto small boats, take them to the middle of the Evros River, and force them into the frigid water, making them wade to the riverbank on the Turkish side. None are apparently being properly registered in Greece or allowed to lodge asylum claims.\u201d<\/div>\n<p>Take the case, for example, of the United Kingdom, which plans to ship asylum seekers to Rwanda, a proceeding that <a href=\"https:\/\/www.hrw.org\/\"  target=\"_blank\" rel=\"noopener\">Human Rights Watch<\/a>(<a href=\"https:\/\/www.hrw.org\/\"  target=\"_blank\" rel=\"noopener\">HRW<\/a>) has classified as a \u201ccruelty itself.\u201d<\/p>\n<p>In a<a href=\"https:\/\/www.hrw.org\/news\/2022\/04\/14\/uk-plan-ship-asylum-seekers-rwanda-cruelty-itself\"  target=\"_blank\" rel=\"noopener\"> report<\/a> by<a href=\"https:\/\/www.hrw.org\/about\/people\/yasmine-ahmed\"  target=\"_blank\" rel=\"noopener\"> Yasmine Ahmed<\/a> and<a href=\"https:\/\/www.hrw.org\/about\/people\/emilie-mcdonnell\"  target=\"_blank\" rel=\"noopener\"> Emilie McDonnell<\/a>, the two human rights defenders said that shirking its obligations to persons seeking asylum at its shores, the UK government has on 14 April 2022<a href=\"https:\/\/www.gov.uk\/government\/news\/world-first-partnership-to-tackle-global-migration-crisis\"  target=\"_blank\" rel=\"noopener\"> signed an agreement<\/a> with<a href=\"https:\/\/www.hrw.org\/africa\/rwanda\"  target=\"_blank\" rel=\"noopener\"> Rwanda<\/a> to send asylum seekers crossing the English Channel there.<\/p>\n<p>\u201cUnder the new<a href=\"https:\/\/www.gov.uk\/government\/publications\/memorandum-of-understanding-mou-between-the-uk-and-rwanda\/memorandum-of-understanding-between-the-government-of-the-united-kingdom-of-great-britain-and-northern-ireland-and-the-government-of-the-republic-of-r\"  target=\"_blank\" rel=\"noopener\"> Asylum Partnership Arrangement<\/a>, people arriving in the UK irregularly or who arrived irregularly since January 1, 2022 may be sent to Rwanda on a one-way ticket to have their asylum claim processed and, if recognized as refugees, to be granted refugee status there.\u201d<\/p>\n<h3><em><strong>Pushing away the victims of \u2018their\u2019 wars<\/strong><\/em><\/h3>\n<p>It should be noted that many of the shipped migrants, refugees and asylum seekers are victims of long wars launched by US-led coalitions with the intensive participation of the United Kingdom\u2019s military forces.<\/p>\n<p>Such is the case, for example, of the war in Afghanistan (which lasted 20 years); in Iraq and in Libya, let alone Syria (now entering its tewlveth year), and the huge Western weapons sales to Saudi Arabia and the United Arab Emirates to fuel their continued bombing on Yemen (so far for over seven years).<\/p>\n<h3><em><strong>Cruel, ineffective and likely unlawful<\/strong><\/em><\/h3>\n<p>The Human Rights Watch<a href=\"https:\/\/www.hrw.org\/news\/2022\/04\/14\/uk-plan-ship-asylum-seekers-rwanda-cruelty-itself\"  target=\"_blank\" rel=\"noopener\"> report<\/a> said that the UK is arguing that offshoring asylum seekers to Rwanda complies with its international legal obligations.<\/p>\n<p>\u201cHowever, offshore processing is not only cruel and ineffective, but also very likely to be unlawful,\u201d add<a href=\"https:\/\/www.hrw.org\/about\/people\/yasmine-ahmed\"  target=\"_blank\" rel=\"noopener\"> Yasmine Ahmed<\/a> and<a href=\"https:\/\/www.hrw.org\/about\/people\/emilie-mcdonnell\"  target=\"_blank\" rel=\"noopener\"> Emilie McDonnell<\/a>.<\/p>\n<p>\u201cIt creates a two-tiered refugee system that discriminates against one group based on their mode of arrival, despite refugee status being grounded solely on the threat of persecution or serious harm and international standards recognizing that asylum seekers are often compelled to cross borders irregularly to seek protection.\u201d<\/p>\n<h3><em><strong>The UN \u201cfirmly\u201d opposed<\/strong><\/em><\/h3>\n<p>The deal reportedly made by the United Kingdom to send some migrants for processing and relocation to the Central African nation of Rwanda, are at odds with States\u2019 responsibility to take care of those in need of protection, the UN refugee agency,<a href=\"http:\/\/www.unhcr.org\/\"  target=\"_blank\" rel=\"noopener\"> UNHCR<\/a>, said on 14 April 2022.<\/p>\n<p>In an initial response,<a href=\"http:\/\/www.unhcr.org\/\"  target=\"_blank\" rel=\"noopener\"> UNHCR<\/a> spelled out that it was not a party to negotiations that have taken place between London and Kigali, which it is understood were part of an economic development partnership.<\/p>\n<p>According to news reports, UK Prime Minister Boris Johnson, has said the scheme costing around $160 million, would \u201csave countless lives\u201d from human trafficking, and the often treacherous water crossing between southern England and the French coast, known as the English Channel, UNHCR explained.<\/p>\n<p>\u201cUNHCR remains firmly opposed to arrangements that seek to transfer refugees and asylum seekers to third countries in the absence of sufficient safeguards and standards,\u201d<a href=\"https:\/\/www.unhcr.org\/news\/press\/2022\/4\/62585e814\/un-refugee-agency-opposes-uk-plan-export-asylum.html\"  target=\"_blank\" rel=\"noopener\"> said UNHCR\u2019s Assistant High Commissioner for Protection<\/a>, Gillian Triggs.<\/p>\n<p>Triggs described the arrangements as shifting asylum responsibilities and evading international obligations that are \u201ccontrary to the letter and spirit of the<a href=\"https:\/\/www.unhcr.org\/en-us\/1951-refugee-convention.html\"  target=\"_blank\" rel=\"noopener\"> Refugee Convention<\/a>.\u201d<\/p>\n<h3><em><strong>Rwanda\u2019s \u201cappalling human rights record\u201d<\/strong><\/em><\/h3>\n<p>Furthermore, Rwanda\u2019s appalling human rights record is well documented, the two human rights activists went on. In 2018, Rwandan security forces<a href=\"https:\/\/www.hrw.org\/news\/2019\/02\/23\/rwanda-year-no-justice-refugee-killings\"  target=\"_blank\" rel=\"noopener\"> shot dead at least 12 refugees<\/a> from the Democratic Republic of Congo when they protested a cut to food rations.<\/p>\n<p><em><strong>Extrajudicial killings<\/strong><\/em><\/p>\n<p>According to the Human Rights Watch\u2019s report \u201dRwanda has<a href=\"https:\/\/www.hrw.org\/news\/2020\/07\/09\/human-rights-watch-submission-universal-periodic-review-rwanda\"  target=\"_blank\" rel=\"noopener\"> a known track record<\/a> of extrajudicial killings, suspicious deaths in custody, unlawful or arbitrary detention, torture, and abusive prosecutions, particularly targeting critics and dissidents.\u201d<\/p>\n<p>In fact, the UK directly<a href=\"https:\/\/www.gov.uk\/government\/speeches\/37th-universal-periodic-review-uk-statement-on-rwanda\"  target=\"_blank\" rel=\"noopener\"> raised<\/a> its concerns about respect for human rights with Rwanda, and grants asylum to Rwandans who have fled the country, including four<a href=\"https:\/\/www.gov.uk\/government\/statistical-data-sets\/asylum-and-resettlement-datasets\"  target=\"_blank\" rel=\"noopener\"> just last year<\/a>.<\/p>\n<p>\u201cAt a time when the people of the UK have opened their hearts and homes to Ukrainians, the government is choosing to act with cruelty and rip up their obligations to others fleeing war and persecution.\u201d<\/p>\n<h3><em><strong>Greece: Migrants stripped, robbed, and forced to Turkey<\/strong><\/em><\/h3>\n<p>Just one week earlier, Human Rights Watch on 7 April 2022<a href=\"https:\/\/www.hrw.org\/news\/2022\/04\/07\/greece-using-other-migrants-expel-asylum-seekers\"  target=\"_blank\" rel=\"noopener\"> reported<\/a> from Athens that<a href=\"https:\/\/www.hrw.org\/europe\/central-asia\/greece\"  target=\"_blank\" rel=\"noopener\"> Greek<\/a> security forces are employing third country nationals, men who appear to be of Middle Eastern or South Asian origin, to push asylum seekers back at the Greece-Turkey land border.<\/p>\n<p>The 29-page report<a href=\"https:\/\/www.hrw.org\/node\/381646\"  target=\"_blank\" rel=\"noopener\"> \u201cTheir Faces Were Covered\u2019: Greece\u2019s Use of Migrants as Police Auxiliaries in Pushbacks,\u201d<\/a> found that Greek police are detaining asylum seekers at the Greece-Turkey land border at the Evros River, in many cases stripping them of most of their clothing and stealing their money, phones, and other possessions.<\/p>\n<p>\u201cThey then turn the migrants over to masked men, who force them onto small boats, take them to the middle of the Evros River, and force them into the frigid water, making them wade to the riverbank on the Turkish side. None are apparently being properly registered in Greece or allowed to lodge asylum claims.\u201d<\/p>\n<p>There can be no denying that the Greek government is responsible for the illegal pushbacks at its borders, and using proxies to carry out these illegal acts does not relieve it of any liability, said<a href=\"https:\/\/www.hrw.org\/about\/people\/bill-frelick\"  target=\"_blank\" rel=\"noopener\"> Bill Frelick<\/a>, refugee and migrant rights director at Human Rights Watch.<\/p>\n<p>\u201cThe European Commission should urgently open legal proceedings and hold the Greek government accountable for violating EU laws prohibiting collective expulsions.\u201d<\/p>\n<p>Human Rights Watch interviewed 26 Afghan migrants and asylum seekers, 23 of whom were pushed back from Greece to Turkey across the Evros River between September 2021 and February 2022.<\/p>\n<p>The 23 men, 2 women, and a boy said they were detained by men they believed to be Greek authorities, usually for no more than 24 hours with little to no food or drinking water, and pushed back to Turkey.<\/p>\n<p>\u201cThe men and boy provided first hand victim or witness accounts of Greek police or men they believed to be Greek police beating or otherwise abusing them.\u201d<\/p>\n<h3><em><strong>Greece uses of migrants as police auxiliaries in pushbacks<\/strong><\/em><\/h3>\n<p>Sixteen of those interviewed by Human Rights Watch said the boats taking them back to Turkey were piloted by men who spoke Arabic or the South Asian languages common among migrants.<\/p>\n<p>\u201cThey said most of these men wore black or commando-like uniforms and used balaclavas to cover their faces. Three people interviewed were able to talk with the men ferrying the boats. The boat pilots told them they were also migrants who were employed by the Greek police with promises of being provided with documents enabling them to travel onward.\u201d<\/p>\n<p><a href=\"https:\/\/www.ecchr.eu\/en\/glossary\/push-back\/\"  target=\"_blank\" rel=\"noopener\">Pushbacks<\/a> violate multiple human rights norms, including the prohibition of<a href=\"https:\/\/www.echr.coe.int\/Documents\/FS_Collective_expulsions_ENG.pdf\"  target=\"_blank\" rel=\"noopener\"> collective expulsion<\/a> under the<a href=\"https:\/\/www.echr.coe.int\/Documents\/Convention_ENG.pdf\"  target=\"_blank\" rel=\"noopener\"> European Convention on Human Rights<\/a>, the<a href=\"https:\/\/www.borderviolence.eu\/legal-framework\/\"  target=\"_blank\" rel=\"noopener\"> right to due process<\/a> in the<a href=\"http:\/\/www.ohchr.org\/en\/professionalinterest\/pages\/ccpr.aspx\"  target=\"_blank\" rel=\"noopener\"> International Covenant on Civil and Political Rights<\/a>, the right to seek asylum under<a href=\"https:\/\/www.europarl.europa.eu\/RegData\/etudes\/BRIE\/2021\/689368\/EPRS_BRI(2021)689368_EN.pdf\"  target=\"_blank\" rel=\"noopener\"> EU asylum law<\/a> and the<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:12012P\/TXT&amp;from=EN\"  target=\"_blank\" rel=\"noopener\"> EU Charter of Fundamental Rights<\/a>, and the principle of non refoulement under the<a href=\"https:\/\/www.unhcr.org\/3b66c2aa10\"  target=\"_blank\" rel=\"noopener\"> 1951 Refugee Convention<\/a>, Human Rights Watch noted.<\/p>\n<h3><em><strong>Some are more \u201creal refugees\u201d than others<\/strong><\/em><\/h3>\n<p>On March 1, Greece\u2019s migration minister, Notis Mitarachi,<a href=\"https:\/\/twitter.com\/nmitarakis\/status\/1498621457005531140?s=20&amp;t=L0evNhBClGmsKit25dnBqQ\"  target=\"_blank\" rel=\"noopener\"> declared before the Hellenic Parliament<\/a> that<a href=\"https:\/\/www.aljazeera.com\/news\/2022\/3\/16\/ngos-say-ukraine-refugee-crisis-easier-with-govt-support\"  target=\"_blank\" rel=\"noopener\"> Ukrainians were the \u201creal refugees,\u201d<\/a> implying that those on Greece\u2019s border with Turkey are not.<\/p>\n<p>Reacting to this,<a href=\"https:\/\/www.hrw.org\/about\/people\/bill-frelick\"  target=\"_blank\" rel=\"noopener\"> Bill Frelick<\/a>, refugee and migrant rights director at Human Rights Watch,<a href=\"https:\/\/www.hrw.org\/news\/2022\/04\/07\/greece-using-other-migrants-expel-asylum-seekers\"  target=\"_blank\" rel=\"noopener\"> said<\/a> that at a time when Greece welcomes Ukrainians as \u2018real refugees,\u2019 it conducts cruel pushbacks on Afghans and others fleeing similar war and violence.<\/p>\n<p>\u201cThe double standard makes a mockery of the purported shared European values of equality, rule of law, and human dignity.\u201d<\/p>\n<p><em>_____________________________________________<\/em><\/p>\n<p><a href=\"https:\/\/www.transcend.org\/tms\/2022\/04\/europe-sweeps-away-more-refugees-asylum-seekers-part-ii-hungary-poland\/\" >READ PART 2 HERE<\/a><\/p>\n<p style=\"padding-left: 40px;\"><em><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2015\/12\/baher-kamal-e1454666328650.jpg\" ><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-67245\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2015\/12\/baher-kamal-e1454666328650.jpg\" alt=\"\" width=\"100\" height=\"150\" \/><\/a> Baher Kamal, <\/em><em>a member of the <\/em><a href=\"https:\/\/www.transcend.org\/\" >TRANSCEND Network for Peace Development Environment<\/a><em>, <\/em><em>is an Egyptian-born, Spanish national, secular journalist, with over 45 years of professional experience \u2014 from reporter to special envoy to chief editor of national dailies and an international news agency.
