{"id":215049,"date":"2022-06-13T12:00:21","date_gmt":"2022-06-13T11:00:21","guid":{"rendered":"https:\/\/www.transcend.org\/tms\/?p=215049"},"modified":"2022-06-13T04:57:54","modified_gmt":"2022-06-13T03:57:54","slug":"israeli-anti-torture-body-refers-israel-to-international-criminal-court","status":"publish","type":"post","link":"https:\/\/www.transcend.org\/tms\/2022\/06\/israeli-anti-torture-body-refers-israel-to-international-criminal-court\/","title":{"rendered":"Israeli Anti-Torture Body Refers Israel to International Criminal Court"},"content":{"rendered":"<blockquote><p>Public Committee Against Torture in Israel <em>says after 30 years it has concluded Israeli authorities not interested and unable to stop abuse of Palestinians.<\/em><\/p><\/blockquote>\n<div id=\"attachment_215051\" style=\"width: 410px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2022\/06\/palestine-israel.webp\" ><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-215051\" class=\"wp-image-215051\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2022\/06\/palestine-israel-1024x682.webp\" alt=\"\" width=\"400\" height=\"267\" srcset=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2022\/06\/palestine-israel-1024x682.webp 1024w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2022\/06\/palestine-israel-300x200.webp 300w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2022\/06\/palestine-israel-768x512.webp 768w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2022\/06\/palestine-israel.webp 1400w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><\/a><p id=\"caption-attachment-215051\" class=\"wp-caption-text\">Palestinians take part in a protest in solidarity with prisoners in Israeli jails, in front of the Erez Crossing in Beit Hanoun in the northern Gaza Strip (Reuters)<\/p><\/div>\n<p><em>10 Jun 2022 &#8211; <\/em>An Israeli anti-torture body has referred its own country to the International Criminal Court (ICC) after concluding that <a href=\"https:\/\/www.middleeasteye.net\/countries\/israel\"  target=\"_blank\" rel=\"noopener\">Israel<\/a> is \u201cnot interested and unable to stop the use of torture against <a href=\"https:\/\/www.middleeasteye.net\/countries\/palestine\"  target=\"_blank\" rel=\"noopener\">Palestinians<\/a>\u201d.<\/p>\n<article class=\"story full article-type clearfix\" role=\"article\" data-history-node-id=\"254656\">\n<div class=\"field field-body clearfix\">\n<p>The Public Committee Against Torture in Israel (PCATI) said on Friday it had demanded that Israelis involved in torture be tried as part of an investigation by the Hague-based ICC over suspected war crimes committed by Israel in the occupied Palestinian territories.<\/p>\n<p>It said that after 30 years of fighting torture it had \u201creached the unfortunate conclusion\u201d that Israel has no wish to end torture, honestly investigate victims&#8217; complaints and prosecute those responsible.<\/p>\n<p>&#8220;For us, this is a necessary and obligatory step today in our struggle for the moral image of Israeli society, and for the sake of justice for the victims we represent,&#8221; it said in a statement.<\/p>\n<p>Established in 1990, the PCATI has represented and worked to protect Israelis, Palestinians, refugees and migrants who have suffered torture and inhuman or degrading treatment in detention.<\/p>\n<blockquote><p><em><strong>&#8216;This is a necessary and obligatory step today in our struggle for the moral image of Israeli society, and for the sake of justice for the victims we represent.&#8217;<\/strong><\/em><br \/>\n<strong>&#8211;\u00a0Public Committee Against Torture in Israel<\/strong><\/p><\/blockquote>\n<p>The PCATI noted that over 1,300 complaints of torture victims had been filed with Israeli law enforcement authorities between 2001 and 2021 in the belief that the system will fulfil its duty, conduct fair and exhaustive investigations and do justice to the victims.<\/p>\n<p>However, the group said, that led to zero indictments and just two criminal investigations &#8211; including in cases where \u201cunequivocal evidence of serious violations of the law\u201d has been collected.<\/p>\n<p>\u201cThe law in Israel backs up the culture of falsehood and cover-up that still exists in the security system,\u201d the PCATI said.<\/p>\n<p>Tal Steiner, PCATI\u2019s executive director, told Middle East Eye that appealing to the international court is a very radical step.<\/p>\n<p>\u201cWe understood after 30 years that the system of Israeli courts is unwilling and unable to create change. They have a culture of immunity,\u201d she said.<\/p>\n<p>\u201cWe are the first Israeli organisation to take such a step and we expect very hard and difficult reactions.\u201d<\/p>\n<p>The PCATI appeal represents 17 clients who Steiner says \u201cwent through very severe physical torture\u201d.<\/p>\n<p>\u201cAll of their complaints were rejected in Israel. Maybe finally justice can be achieved for them in the international court,\u201d she said.<\/p>\n<p>Unlike the Palestinian Authority, Israel is not a signatory of the ICC\u2019s Rome Statute, which the country says means the court has no jurisdiction there.<\/p>\n<p>However, the ICC prosecutor in March 2021 formally began probing war crimes allegedly committed in the occupied Palestinian territories \u2013 by both Israel and Palestinian groups such as Hamas.<\/p>\n<div class=\"mee-readmore mee-readmore-article-story mee-readmore-type-image align-right\">\n<p style=\"text-align: center;\"><a href=\"https:\/\/www.middleeasteye.net\/news\/shireen-abu-akleh-israel-war-crimes-icc-case-lawyers-add\" class=\"mee-readmore-img-link\"  target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" class=\"mee-readmore-image aligncenter\" src=\"https:\/\/www.middleeasteye.net\/sites\/default\/files\/styles\/read_more\/public\/images-story\/shireen-abu-akleh-brother-vigil-may-2022-afp.jpg?itok=hrr0covp\" alt=\"\" width=\"400\" height=\"250\" \/> <\/a><strong>Lawyers to add Shireen Abu Akleh killing to Israel war crimes ICC case.<\/strong><br \/>\n<a href=\"https:\/\/www.middleeasteye.net\/news\/shireen-abu-akleh-israel-war-crimes-icc-case-lawyers-add\" class=\"mee-readmore-link\"  target=\"_blank\" rel=\"noopener\">Read More \u00bb<\/a><\/p>\n<\/div>\n<p>Then in April 2022, the International Federation of Journalists, the Palestinian Journalists Syndicate and the International Centre of Justice for Palestinians <a href=\"https:\/\/www.middleeasteye.net\/news\/israel-palestine-icc-complaint-filed-systematic-targeting-journalists\"  target=\"_blank\" rel=\"noopener\">filed a complaint<\/a> with the ICC alleging that Israel&#8217;s &#8220;systematic targeting&#8221; of Palestinian journalists and its failure to investigate their killings amounts to war crimes.<\/p>\n<p>When Israeli forces killed Al Jazeera journalist <a href=\"https:\/\/www.middleeasteye.net\/topics\/shireen-abu-akleh-killing\"  target=\"_blank\" rel=\"noopener\">Shireen Abu Akleh<\/a> in the occupied West Bank&#8217;s Jenin last month, the Palestinian Authority <a href=\"https:\/\/www.middleeasteye.net\/news\/palestine-foreign-minister-icc-shireen-abu-akleh-killing\"  target=\"_blank\" rel=\"noopener\">asked the ICC<\/a> to add her case to other alleged crimes being investigated.<\/p>\n<p>Investigations are opened by the ICC in places where the domestic authorities are unable or unwilling to probe allegations of abuse. Israel has previously said it will not cooperate with any ICC investigation.<\/p>\n<p>The PCATI application is submitted in cooperation with the International Federation for Human Rights (FIDH), an organisation that unites 192 human rights organisations from around the world.<\/p>\n<p>&#8220;Israeli security agents and other state officials have systematically tortured, degraded, and inhumanely treated Palestinian individuals suspected of involvement in national security crimes,&#8221; said\u00a0Alice Mogwe, FIDH president.<\/p>\n<p>&#8220;They have unlawfully deported them from the Palestinian territories into Israel for the purpose of such treatment. They have denied them the fundamental right to a fair trial.&#8221;<\/p>\n<p>The PCATI is not the first Israeli human rights organisation to conclude that the country&#8217;s authorities are unwilling and unable to investigate abuses.
