The arrest was based on allegations by Jefry Tupas, a former information officer for Vice President Sara Duterte. He used his candidacy as a platform to highlight progressive and social justice issues during the campaign. He is a long-time critic of the late Ferdinand Marcos, father of President Ferdinand Marcos Jr, and of former President Rodrigo Duterte, father of Vice-President Duterte. Sara Duterte <a target=\"_blank\" href=\"https:\/\/www.philstar.com\/headlines\/2022\/08\/09\/2201420\/sara-duterte-denies-hand-walden-bello-cyber-libel-case\" >denied<\/a> any role in the libel case.<\/p>\n<p>The Philippines\u2019 cyber-libel law, passed in 2012, has been used several times against <a target=\"_blank\" href=\"https:\/\/www.philstar.com\/headlines\/2021\/12\/04\/2145698\/journalist-groups-decry-cusi-and-uys-libel-suits-over-malampaya-reports\" >journalists<\/a>, <a target=\"_blank\" href=\"https:\/\/www.pna.gov.ph\/articles\/1174771\" >columnists<\/a>, <a target=\"_blank\" href=\"https:\/\/mb.com.ph\/2022\/07\/25\/multiple-cyber-libel-raps-forced-doctor-to-shoot-ex-town-mayor-2-others-in-ateneo-qcpd\/\" >critics of the government<\/a>, and ordinary <a target=\"_blank\" href=\"https:\/\/acg.pnp.gov.ph\/main\/press-releases\/404-pnp-acg-arrests-woman-in-gensan-over-cyber-libel-charge.html\" >social media users<\/a>. The <a target=\"_blank\" href=\"https:\/\/www.doj.gov.ph\/office-of-cybercrime.html\" >Office of Cybercrime<\/a> at the Department of Justice reported that <a target=\"_blank\" href=\"https:\/\/www.rappler.com\/newsbreak\/in-depth\/decriminalize-philippines-junked-cyber-libel-cases-since-2012\/\" >3,700 cyber-libel cases<\/a> were filed as of May 2022. Of that number, 1,317 were filed in court while 1,131 were dismissed. Twelve cases ended in a conviction.<\/p>\n<p>Bello\u2019s arrest underscores the need to revoke criminal <a target=\"_blank\" href=\"https:\/\/www.chanrobles.com\/revisedpenalcodeofthephilippinesbook2.htm\" >libel<\/a> and <a target=\"_blank\" href=\"http:\/\/www.gov.ph\/2012\/09\/12\/republic-act-no-10175\/\" >cyber-libel<\/a>\u00a0laws in the Philippines and elsewhere. As the United Nations Human Rights Committee stated in its <a target=\"_blank\" href=\"https:\/\/www2.ohchr.org\/english\/bodies\/hrc\/docs\/gc34.pdf\" >general comment<\/a> on freedom of expression, \u201cimprisonment is never an appropriate penalty\u201d for defamation. The UN special rapporteur on freedom of expression, <a target=\"_blank\" href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2022\/07\/philippines-un-expert-slams-court-decision-upholding-criminal-conviction\" >Irene Khan<\/a>, said in July after a Manila court upheld the <a target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2020\/06\/14\/business\/maria-ressa-verdict-philippines-rappler.html\" >cyber-libel conviction<\/a> of Nobel Prize laureate Maria Ressa, \u201cCriminal libel law has no place in a democratic country and should be repealed.\u201d<\/p>\n<p>As Human Rights Watch <a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2012\/09\/28\/philippines-new-cybercrime-law-will-harm-free-speech\" >stated<\/a> before the law was passed, criminal libel \u2013 against both offline and online expression \u2013 harms free speech and is frequently used to \u00a0target critics of government officials.
