He continues to be denied due process as his physical and mental health deteriorates. This is the point.<\/em><\/p><\/blockquote>\n<p><em>27 Mar 2024<\/em> &#8211; Prosecutors representing the United States, whether by design or incompetence, refused \u2014 in the <a target=\"_blank\" href=\"https:\/\/chrishedges.substack.com\/p\/julian-assanges-day-in-court\"  rel=\"\">two-day<\/a> hearing I <a target=\"_blank\" href=\"https:\/\/chrishedges.substack.com\/p\/julian-assanges-grand-inquisitor\"  rel=\"\">attended<\/a> in London in February \u2014 to provide guarantees that Julian Assange would be afforded First Amendment rights and would be spared the death penalty if extradited to the U.S.<\/p>\n<p>The inability to give these assurances all but guaranteed that the High Court \u2014 <a target=\"_blank\" href=\"https:\/\/www.democracynow.org\/2024\/3\/26\/julian_assange_extradition\"  rel=\"\">as it did<\/a> on Tuesday \u2014 would allow Julian\u2019s lawyers to appeal. Was this done to stall for time so that Julian would not be extradited until after the U.S. presidential election? Was it a delaying tactic to work out a plea deal? Julian\u2019s lawyers and U.S. prosecutors are discussing this possibility. Was it careless legal work? Or was it to keep Julian locked in a high security prison until he collapses mentally and physically?<\/p>\n<p>If Julian is extradited, he will stand trial for allegedly violating 17 counts of the 1917 Espionage Act, with a potential sentence of 170 years, along with another charge for \u201cconspiracy to commit computer intrusion\u201d carrying an additional five years.<\/p>\n<p>The court will permit Julian to appeal minor technical points \u2014 his basic free speech rights must be honored, he cannot be discriminated against on the basis of his nationality and he cannot be under threat of the death penalty.<\/p>\n<p>No new hearing will allow his lawyers to focus on the war crimes and corruption that WikiLeaks exposed. No new hearing will permit Julian to mount a public-interest defense. No new hearing will discuss the political persecution of a publisher who has not committed a crime.<\/p>\n<p>The court, by asking the U.S. for assurances that Julian would be granted First Amendment rights in the U.S. courts and not be subject to the death penalty, offered the U.S. an easy out \u2014 give the guarantees and the appeal is rejected.<\/p>\n<p>It is hard to see how the U.S. can refuse the <a target=\"_blank\" href=\"https:\/\/www.declassifieduk.org\/julian-assange-judge-previously-acted-for-mi6\/\"  rel=\"\">two-judge panel<\/a>, composed of Dame Victoria Sharp and Justice Jeremy Johnson, which issued on Tuesday a<a target=\"_blank\" href=\"https:\/\/www.tareqhaddad.com\/wp-content\/uploads\/2024\/03\/24.03.26-Assange-v-USA-Approved-Judgment.pdf\"  rel=\"\"> 66-page <\/a>judgment accompanied by a <a target=\"_blank\" href=\"https:\/\/www.tareqhaddad.com\/wp-content\/uploads\/2024\/03\/24.03.26-Assange-v-USA-Judges-Order.pdf\"  rel=\"\">three-page court order <\/a>and a<a target=\"_blank\" href=\"https:\/\/www.tareqhaddad.com\/wp-content\/uploads\/2024\/03\/24.03.26-Assange-v-USA-Press-Summary.pdf\"  rel=\"\"> four-page media briefing<\/a>.<\/p>\n<p>The hearing in February was Julian\u2019s <a target=\"_blank\" href=\"https:\/\/chrishedges.substack.com\/p\/assanges-final-appeal\"  rel=\"\">last chance<\/a> to request an appeal of the extradition decision <a target=\"_blank\" href=\"https:\/\/thedissenter.org\/uk-government-approves-assanges-extradition-to-united-states\/\"  rel=\"\">made<\/a> in 2022 by the then British home secretary, Priti Patel, and many of the rulings of District Judge Vanessa Baraitser <a target=\"_blank\" href=\"https:\/\/jacobin.com\/2021\/01\/julian-assange-extradition-ruling-free-press\"  rel=\"\">in 2021<\/a>.<\/p>\n<p>If Julian is denied an appeal, he can request an emergency stay of execution from the European Court of Human Rights (<a target=\"_blank\" href=\"https:\/\/www.coe.int\/en\/web\/tbilisi\/europeancourtofhumanrights#:~:text=The%20European%20Court%20of%20Human%20Rights%20is%20an%20international%20court,can%20apply%20to%20it%20directly.\"  rel=\"\">ECtHR<\/a>) <a target=\"_blank\" href=\"https:\/\/www.echr.coe.int\/documents\/d\/echr\/fs_interim_measures_eng\"  rel=\"\">under<\/a> Rule 39, which is given in \u201cexceptional circumstances\u201d and \u201conly where there is an imminent risk of irreparable harm.\u201d But it is possible the British court could order Julian\u2019s immediate extradition prior to a Rule 39 instruction, or decide to ignore a request from the ECtHR to allow Julian to have his case heard there.<\/p>\n<p>Julian has been engaged in a legal battle for 15 years. It began in 2010 when WikiLeaks published classified military files from the wars in<a target=\"_blank\" href=\"https:\/\/web.archive.org\/web\/20130429122404\/http:\/\/www.iraqwarlogs.com\/2010\/10\/21\/the-leaked-us-files-and-what-they-mean\/\"  rel=\"\"> Iraq<\/a> and<a target=\"_blank\" href=\"https:\/\/www.wikileaks.org\/wiki\/Afghan_War_Diary,_2004-2010\"  rel=\"\"> Afghanistan<\/a> \u2014 including footage showing a U.S. helicopter<a target=\"_blank\" href=\"https:\/\/collateralmurder.wikileaks.org\/\"  rel=\"\"> gunning down<\/a> civilians, including two Reuters journalists, in Baghdad.<\/p>\n<p>Julian took refuge in the Embassy of Ecuador in London for seven years, fearing extradition to the U.S. He was arrested in April 2019 by the Metropolitan Police, who were permitted by the Embassy to enter and seize him. He has been held for nearly five years in HM Prison Belmarsh, a high-security prison in southeast London.<\/p>\n<p>The case against Julian has made a mockery of the British justice system and international law. While in the embassy, the Spanish security firm UC Global <a target=\"_blank\" href=\"https:\/\/thegrayzone.com\/2020\/05\/14\/american-sheldon-adelsons-us-spy-julian-assange\/amp\/\"  rel=\"\">provided<\/a> video recordings of meetings between Julian and his lawyers to the CIA, eviscerating attorney-client privilege.<\/p>\n<p>The Ecuadorian government \u2014 led by Lenin Moreno \u2014 violated international law by rescinding Julian\u2019s asylum status and permitting police into their embassy to carry Julian into a waiting van. The courts have denied Julian\u2019s status as a legitimate journalist and publisher. The U.S. and Britain have ignored Article 4 of their<a target=\"_blank\" href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/243246\/7146.pdf\"  rel=\"\"> Extradition Treaty<\/a> that prohibits extradition for political offenses. The key witness for the U.S., Sigurdur Thordarson \u2014 a convicted fraudster and pedophile \u2014<a target=\"_blank\" href=\"https:\/\/heimildin.is\/grein\/13627\/key-witness-in-assange-case-admits-to-lies-in-indictment\/\"  rel=\"\"> admitted<\/a> to fabricating the accusations he made against Julian for money.<\/p>\n<p>Julian, an Australian citizen, is being charged under the U.S. Espionage Act although he did not engage in espionage and was not based in the U.S when he was sent the leaked documents. The British courts are considering extradition, despite the CIA\u2019s plan to <a target=\"_blank\" href=\"https:\/\/thegrayzone.com\/2021\/09\/30\/inside-the-cia-plot-to-kidnap-kill-julian-assange\/\"  rel=\"\">kidnap and assassinate<\/a> Julian, plans that included a potential shoot-out on the streets of London, with involvement by London\u2019s Metropolitan Police.<\/p>\n<p>Julian has been held in isolation in a high-security prison without trial, although his only technical violation of the law is breaching bail conditions after he obtained asylum in the Embassy of Ecuador. This should only entail a fine.<\/p>\n<p>Finally, Julian did not, unlike Daniel Ellsberg, <a target=\"_blank\" href=\"https:\/\/www.thecanary.co\/discovery\/feature\/2021\/05\/02\/as-the-world-celebrates-press-freedom-day-julian-assange-remains-in-belmarsh-prison\/\"  rel=\"\">leak<\/a> the documents. He published documents leaked by U.S. Army whistleblower Chelsea Manning.<\/p>\n<p>Three of the nine legal grounds were accepted by the judges as potential points for appeal. The other six were denied. The two-judge panel also rejected the request by Julian\u2019s lawyers to present new evidence.<\/p>\n<p>Julian\u2019s legal team asked the court to introduce into the case the Yahoo! News report that <a target=\"_blank\" href=\"https:\/\/news.yahoo.com\/kidnapping-assassination-and-a-london-shoot-out-inside-the-ci-as-secret-war-plans-against-wiki-leaks-090057786.html\"  rel=\"\">revealed<\/a>, after the release of the documents known as <a target=\"_blank\" href=\"https:\/\/wikileaks.org\/ciav7p1\/#FAQ\"  rel=\"\">Vault 7<\/a>, that the then-director of the CIA Mike Pompeo, considered assassinating Julian. Julian\u2019s lawyers also hoped to introduce a statement from Joshua Dratel, a U.S. attorney, who said that Pompeo\u2019s use of the terms \u201cnon-state hostile intelligence service\u201d and \u201cenemy combatant\u201d were phrases designed to give legal cover for an assassination. The third piece of evidence Julian\u2019s lawyers hoped to introduce was a <a target=\"_blank\" href=\"https:\/\/www.pressenza.com\/2020\/07\/spanish-jurist-denounces-us-political-harassment-against-assange\/\"  rel=\"\">statement<\/a> from a Spanish witness in the criminal proceedings underway in Spain against UC Global.<\/p>\n<p>The CIA is the engine behind Julian\u2019s extradition. Vault 7 exposed <a target=\"_blank\" href=\"https:\/\/wikileaks.org\/ciav7p1\/\"  rel=\"\">hacking tools<\/a> that permit the CIA to access our phones, computers and televisions, turning them \u2014 even when switched off \u2014 into monitoring and recording devices. The extradition request does not include charges based on the release of the Vault 7 files, but the U.S. indictment followed the release of the Vault 7 files.<\/p>\n<p>Justice Sharp and Justice Johnson dismissed the report in Yahoo! News as \u201canother recitation of opinion by journalists on matters that were considered by the judge.\u201d They rejected the argument made by the defense that Julian\u2019s extradition would be in violation of Section 81 of the U.K. Extradition Act of 2003, which prohibits extraditions in cases where individuals are prosecuted for their political opinions. The judges also dismissed <a target=\"_blank\" href=\"https:\/\/thedissenter.org\/high-court-hears-assange-request-for-appeal\/\"  rel=\"\">the arguments<\/a> made by Julian\u2019s attorneys that extradition would violate his protections under the European Convention of Human Rights \u2014 the right to life, the prohibition of inhuman and degrading treatment, the right to a free trial and protections against punishment without law respectively.<\/p>\n<p>The U.S. largely built its arguments from the affidavits of the U.S. prosecutor Gordon D. Kromberg. Kromberg, an Assistant U.S. Attorney in the Eastern District of Virginia has <a target=\"_blank\" href=\"https:\/\/thedissenter.org\/countdown-to-day-x-us-assange-no-first-amendment-rights\/\"  rel=\"\">stated<\/a> that Julian, as a foreign national, is \u201cnot entitled to protections under the First Amendment, at least as it concerns national defense information.\u201d<\/p>\n<p>Ben Watson, King\u2019s Counsel, who represented the U.K. government during the two-day hearing in February, conceded that if Julian is found guilty under the Espionage Act, he could receive a death penalty sentence.<\/p>\n<p>The U.S. and the U.K Secretary of State were urged by the judges to offer the British court assurances on these three points by April 16.<\/p>\n<p>If the assurances are not provided, the appeal will proceed.<\/p>\n<p>If the assurances are provided, lawyers for both sides have until April 30th to make new written submissions to the court. At that point, the court will convene again on May 20 to decide if the appeal can go forward.<\/p>\n<p>The goals in this Dickensian <a target=\"_blank\" href=\"https:\/\/www.democracynow.org\/2024\/3\/26\/julian_assange_extradition\"  rel=\"\">nightmare<\/a> remain unchanged. Erase Julian from the public consciousness. Demonize him. Criminalize those who expose government crimes. Use Julian\u2019s slow motion crucifixion to warn journalists that no matter their nationality, no matter where they live, they can be kidnapped and extradited to the U.S. Drag out the judicial lynching for years until Julian, already in a precarious physical and mental condition, disintegrates.<\/p>\n<p>This ruling, like all of the rulings in this case, is not about justice.
