The case is sealed in the US District Court of Massachusetts, so I was unable to read the charging documents and thus far have to rely on press releases by <a href=\"https:\/\/www.ice.gov\/news\/releases\/hsi-arrests-ohio-man-decades-long-scheme-conceal-his-involvement-rwandan-genocide\" class=\"0\"  target=\"_blank\" rel=\"nofollow noopener\">ICE <\/a> and the <a href=\"https:\/\/www.justice.gov\/usao-ma\/pr\/rwandan-man-convicted-immigration-fraud-and-perjury-connection-1994-genocide\" class=\"0\"  target=\"_blank\" rel=\"nofollow noopener\">court <\/a>. The court says that \u201cthe defendant allegedly participated in the killing of Tutsi men, women and children by striking them on the head with a nail-studded club and then hacking them to death with a machete.\u201d The court also accuses him of raping Tutsi women.<\/span><\/p>\n<p><span lang=\"EN\" xml:lang=\"EN\">Those are horrendous crimes indeed, so before going further, let me say that I believe Eric is another innocent victim of the political witch hunts conducted by the totalitarian Rwandan government, whose president, Paul Kagame, is guiltier than anyone of Rwandan Genocide crime. As <a href=\"https:\/\/twitter.com\/JudiRever\" class=\"0\"  target=\"_blank\" rel=\"nofollow noopener\">Judi Rever <\/a>, author of <a target=\"_blank\" href=\"https:\/\/www.blackagendareport.com\/praise-blood-crimes-rwandan-patriotic-front-0\" ><em>In Praise of Blood: Crimes of the Rwandan Patriotic Front<\/em><\/a>, wrote on <a href=\"https:\/\/twitter.com\/JudiRever\/status\/1772736535424561630\" class=\"0\"  target=\"_blank\" rel=\"nofollow noopener\">X <\/a>, \u201cUS Homeland Security agents were doing @PaulKagame&#8217;s dirty work when they arrested Eric Nshimiye, who has become an opponent of the Rwandan regime because he testified as a defense witness in a high profile trial in the US.\u201d<\/span><\/p>\n<p><span lang=\"EN\" xml:lang=\"EN\">With regard to that high profile trial, the US Attorney\u2019s Office also charges Eric with \u201cobstruction of justice and with perjury for allegedly offering false testimony in the 2019 Boston trial of his former classmate and now-convicted Rwandan genocide perpetrator Jean Leonard Teganya.\u201d <\/span><\/p>\n<p><span lang=\"EN\" xml:lang=\"EN\">Jean Leonard is a \u201cconvicted genocide perpetrator\u201d in that he was convicted of the same crime Eric is accused of\u2014immigration fraud for concealing genocide crimes. The US does not have jurisdiction to prosecute crimes committed in Rwanda, but in order to convict a defendant for lying about said crimes to receive asylum, the court must prove that he was in fact guilty, and thereby indirectly convict him of the crime. <\/span><\/p>\n<p><span lang=\"EN\" xml:lang=\"EN\">In an absolute absurdity, the court charges that Eric testified on behalf of Jean Leonard in order to conceal his own crimes, but why would Eric step forward and attract attention to himself if he wanted to hide?<\/span><\/p>\n<h4><strong>Patterns of persecution<\/strong><\/h4>\n<p><span lang=\"EN\" xml:lang=\"EN\">This follows a familiar pattern that I have seen play out again and again. First, a Rwandan American\u2014or a Rwandan immigrant in North America or Western Europe\u2014is accused of lying about committing crimes during the 1994 Rwandan Genocide in order to receive asylum. He or she then goes on trial and is found guilty, after which they serve time for immigration fraud in prison. Upon their release, they are deported to Rwanda to stand trial for genocide crime and very likely face life in prison. <\/span><\/p>\n<p><span lang=\"EN\" xml:lang=\"EN\">In another familiar pattern, any Rwandan immigrant who dares to testify on behalf of an accused Rwandan immigrant will, in a matter of time, find himself accused of the same crimes\u2014immigration fraud and acts of genocide\u2014as Eric has. Eric no doubt knew what great risk he was taking to testify on behalf of Jean Leonard, so it was a courageous act for which he\u2019s paying a high price.\u00a0 <\/span><\/p>\n<p><span lang=\"EN\" xml:lang=\"EN\">After serving nearly five years, Jean Leonard is due to be released soon, at which point he will most likely face deportation to Rwanda. Friends and family say that he will die\u2014or be deported\u2014before testifying against Eric if he is asked to do so in exchange for any leniency.<\/span><\/p>\n<p><span lang=\"EN\" xml:lang=\"EN\">Needless to say, it will take a lot of courage for any Rwandan immigrant to testify on Eric\u2019s behalf, knowing they may well soon find themselves in court facing the same charges. <\/span><\/p>\n<h4><strong>Who is Eric Nshimiye?<\/strong><\/h4>\n<p><span lang=\"EN\" xml:lang=\"EN\">Eric is an electrical engineer who has lived in Lake Township, in the Uniontown, Ohio area, while <a href=\"https:\/\/www.linkedin.com\/in\/eric-nshimiye-594a8aa1\/\" class=\"0\"  target=\"_blank\" rel=\"nofollow noopener\">working for Goodyear Tire and Rubber <\/a> for more than two decades. Seventy friends and family members, including even his dentist, submitted statements to the Ohio District court to say that he is a devoted husband and father and an upstanding, engaged member of his community and church. Friends and family traveled from Ohio, New York, Texas, and Canada for his detention hearing at a Youngstown court and stood outside with signs reading, \u201cEric Is a Man of Virtue,\u201d \u201cEric Is a Man of High Morals,\u201d \u201cEric Is a Man of Faith,\u201d and more. As reported by the <a href=\"https:\/\/www.cantonrep.com\/story\/news\/crime\/2024\/03\/29\/bond-denied-for-eric-nshimiye-stark-man-accused-of-rwandan-genocide\/73129706007\/\" class=\"0\"  target=\"_blank\" rel=\"nofollow noopener\"><em>The Canton Repository<\/em> <\/a>, <\/span><span lang=\"EN\" xml:lang=\"EN\">\u201cthey <\/span><span lang=\"EN\" xml:lang=\"EN\">huddled in prayer, hugged, shook hands and shed a few tears.\u201d They have no doubt seen this pattern play out many times before. <\/span><\/p>\n<h4><strong>Trial by press<\/strong><\/h4>\n<p><span lang=\"EN\" xml:lang=\"EN\">The press love a \u201crape and murder\u201d headline, and Eric\u2019s case, like so many others, instantly generated sensational news around the world, from <a href=\"https:\/\/fox8.com\/news\/neighbors-shocked-by-ne-ohio-mans-genocide-charges-say-hes-been-caring-and-helpful\/\" class=\"0\"  target=\"_blank\" rel=\"nofollow noopener\">Fox News <\/a> to <a href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/eric-nshimiye-rwanda-genocide-homeland-security-b2517344.html\" class=\"0\"  target=\"_blank\" rel=\"nofollow noopener\">The Independent <\/a>, <a href=\"https:\/\/www.cnn.com\/2024\/03\/24\/us\/rwandan-genocide-ohio-arrest-eric-nshimiye\/index.html\" class=\"0\"  target=\"_blank\" rel=\"nofollow noopener\">CNN <\/a>, <a href=\"https:\/\/abcnews.go.com\/US\/wireStory\/rwandan-man-us-charged-lying-role-1994-genocide-108365816\" class=\"0\"  target=\"_blank\" rel=\"nofollow noopener\">ABC <\/a>, <a href=\"https:\/\/uk.news.yahoo.com\/thirty-years-allegedly-participated-rwandan-125411676.html?guccounter=1&amp;guce_referrer=aHR0cHM6Ly93d3cuZ29vZ2xlLmNvbS8&amp;guce_referrer_sig=AQAAABXJI6GycdQYBrHRdk3hffn3hso4pcJBg4g36uMU8PKH1PQEdbytyVmOVvw5eV8FKSlVAUelZajMSKOpKlEnTqDHnuEojDtOYYTjpQ870O-I2I5jC27n5CG8jhMqTGrJ2yK86Q90D90WN1TQ04MBqscOGalZf-wq_FCPmLpwCIG2\" class=\"0\"  target=\"_blank\" rel=\"nofollow noopener\">Yahoo News <\/a>, and more. The local <em>Canton Repository<\/em>, however, ultimately spoke to Eric\u2019s friends and family and <a href=\"https:\/\/www.cantonrep.com\/story\/news\/crime\/2024\/03\/25\/stark-county-ohio-man-accused-rwanda-genocide-rape-family-eric-nshimiye-says-innocent\/73097280007\/\" class=\"0\"  target=\"_blank\" rel=\"nofollow noopener\">published their statements <\/a> as to his innocence and good character. <\/span><\/p>\n<p><span lang=\"EN\" xml:lang=\"EN\">The prosecution is obliged to try Eric\u2019s case on its merits, but the jury will no doubt be advantaged by this and all the other sensational press about similar cases and about the Rwandan Genocide itself. <\/span><\/p>\n<h4><strong><span lang=\"EN\" xml:lang=\"EN\">Witness testimony in a totalitarian state<\/span><\/strong><\/h4>\n<p><span lang=\"EN\" xml:lang=\"EN\">Eric\u2019s case, like Jean Leonard Teganya\u2019s, will rely wholly on witness testimony, some of which has been previewed in the court\u2019s press release. They present a witness pointing to a site where they say Eric killed a 14-year-old boy. They also draw pictures and produce photos of the types of weapons Eric is said to have used to kill his victims. There is no hard evidence, as there was none in the case of Jean Leonard Teganya.<\/span><\/p>\n<p><span lang=\"EN\" xml:lang=\"EN\">Rwanda is a totalitarian state in which everyone is constantly under surveillance, as described by Anjan Sundaram in his book, <a href=\"https:\/\/www.theguardian.com\/books\/2016\/jan\/11\/bad-news-last-journalists-in-dictatorship-anjan-sundaram-review-rwanda-paul-kagame\" class=\"0\"  target=\"_blank\" rel=\"nofollow noopener\"><em>Bad News, Last Journalists in a Dictatorship<\/em> <\/a>. In an interview with Freedom House, David Himbara, former advisor to Rwandan President Paul Kagame, former chairman of the Rwanda Development Board, and author of <em>Kagame\u2019s Economic Mirage<\/em>, said:\u00a0<\/span><\/p>\n<blockquote><p><span lang=\"EN\" xml:lang=\"EN\">\u201c<em>Indeed, penetration of the administration to the village level facilitates a comprehensive surveillance system whereby local functionaries are enlisted as watchers. And almost everyone in Rwanda is watched.<\/em><\/span><\/p>\n<p><em><span lang=\"EN\" xml:lang=\"EN\">\u201cThe drive to control every aspect of citizens\u2019 lives is what defines totalitarianism. This is the case in Rwanda. All-encompassing propaganda campaigns are disseminated through ruling party\u2013controlled media, and the regime uses political repression, personality cultism, restriction of speech, and mass surveillance to maintain Kagame\u2019s grip on power. I believe all of these features distinguish Rwanda from mere dictatorship. And in the Rwanda case, use of terror is no longer limited inside its borders. Assassination campaigns have struck in neighboring countries and as far away as South Africa.
