The Council\u2019s inaction over the last few months starkly contrasts with the clear warnings from senior UN officials who are urgently ringing alarm bells. As the Council is grappling with calls for <a href=\"https:\/\/www.un.org\/africarenewal\/magazine\/august-2024\/maada-bio-makes-africa%E2%80%99s-strong-case-reforms-un-security-council\"  target=\"_blank\" rel=\"noopener noreferrer\">reform<\/a>, the current silence on Myanmar only deepens the sense that the Council can\u2019t rise to the moment when it matters.<\/p>\n<p>The UN\u00a0special rapporteur on human rights in\u00a0Myanmar <a href=\"https:\/\/www.thehindu.com\/news\/international\/un-expert-warns-of-looming-genocidal-violence-in-myanmar\/article68367059.ece\"  target=\"_blank\" rel=\"noopener noreferrer\">warned<\/a> in July that \u201cthe situation carries echoes of the lead-up to genocidal violence in 2016 and 2017.\u201d In <a href=\"https:\/\/www.globalr2p.org\/resources\/statement-on-the-escalation-of-violence-in-myanmar\/\"  target=\"_blank\" rel=\"noopener noreferrer\">a rare joint statement<\/a>, the UN special advisers on genocide prevention and the responsibility to protect urged the international community to undertake \u201cjoint efforts to reassess the crisis in Myanmar in the light of the significant developments that are unfolding and launch a robust coordinated effort.\u201d<\/p>\n<p>In the last few weeks, both <a href=\"https:\/\/www.unicef.org\/myanmar\/press-releases\/distressing-reports-civilian-casualties-conflict-escalates-rakhine-state-myanmar\"  target=\"_blank\" rel=\"noopener noreferrer\">the UN children\u2019s agency, Unicef,<\/a> and the <a href=\"https:\/\/myanmar.un.org\/en\/276134-statement-resident-and-humanitarian-coordinator-ai-myanmar\"  target=\"_blank\" rel=\"noopener noreferrer\">UN\u2019s acting resident coordinator<\/a> in Myanmar have condemned attacks on civilians in Rakhine State.<\/p>\n<p>The Council\u2019s last <a href=\"https:\/\/www.securitycouncilreport.org\/whatsinblue\/2024\/04\/myanmar-open-briefing.php\"  target=\"_blank\" rel=\"noopener noreferrer\">open meeting on Myanmar<\/a> was held in April. Britain is the \u201cpenholder\u201d on Myanmar, which means it takes the lead on all statements or resolutions in the Council and bears unique responsibility to galvanize the members. The Council has allowed paralysis at the Association of Southeast Asian Nations (<a href=\"https:\/\/asean.org\/\"  target=\"_blank\" rel=\"noopener noreferrer\">ASEAN<\/a>) level around Myanmar to influence its approach, leading to paralysis at the international level too. The Council has also failed to follow up on its <a href=\"https:\/\/press.un.org\/en\/2022\/sc15159.doc.htm\"  target=\"_blank\" rel=\"noopener noreferrer\">December 2022 resolution<\/a> on Myanmar, the body\u2019s first since the country\u2019s independence in 1948.<\/p>\n<p>In contrast, both the UN Human Rights Council and the UN General Assembly have adopted a series of stronger but nonbinding resolutions on Myanmar, including calls for an embargo on <a href=\"https:\/\/www.armscontrol.org\/act\/2021-07\/news-briefs\/un-adopts-nonbinding-arms-embargo-myanmar\"  target=\"_blank\" rel=\"noopener noreferrer\">arms<\/a> and <a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2024\/04\/un-human-rights-council-resolution-on-myanmar-takes-crucial-stand-against-deadly-jet-fuel-supply-chain\/\"  target=\"_blank\" rel=\"noopener noreferrer\">jet fuel<\/a> to the military junta. The crisis presents a key test for the UK\u2019s new Labour government, which has claimed the mantle of \u201c<a href=\"https:\/\/geopolitique.eu\/en\/2024\/05\/06\/the-lammy-doctrine-a-conversation-with-the-shadow-foreign-secretary\/\"  target=\"_blank\" rel=\"noopener noreferrer\">progressive realism\u201d<\/a>\u00a0and defense of international law.<\/p>\n<p>Progressive realism may promote engaging with regional blocs, but allowing regional paralysis to mute the Security Council amid atrocities certainly is neither progressive nor pragmatic.<\/p>\n<p>Since the breakdown of an unofficial ceasefire between the Myanmar military and the ethnic Rakhine Arakan Army last November, Human Rights Watch has been warning that the ethnic Rohingya population, which was already marginalized, faced even greater risks. The Rohingya have been subjected for years to <a target=\"_blank\" href=\"https:\/\/www.hrw.org\/report\/2020\/10\/08\/open-prison-without-end\/myanmars-mass-detention-rohingya-rakhine-state\" >movement restrictions, mass detention, denial of medical care persecution and apartheid<\/a>.<\/p>\n<p>The recent violence has included the killing of nearly 200 Rohingya civilians on the banks of the Naf River. They <a href=\"https:\/\/www.bbc.com\/news\/articles\/czx6w130q1ko\"  target=\"_blank\" rel=\"noopener noreferrer\">were attempting to escape<\/a> hostilities after <a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2024\/08\/12\/myanmar-armies-target-ethnic-rohingya-rakhine\" >monthlong<\/a> Arakan Army attacks on Rohingya villages and neighborhoods. Satellite imagery and thermal anomaly data analyzed by Human Rights Watch reveal that more than 40 villages and hamlets in Buthidaung township were partly or completely destroyed by fire from April 24 to May 21.<\/p>\n<p>The Myanmar military has been stoking tensions between the Rakhine Buddhist and Rohingya Muslim communities for years, most recently through the <a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2024\/04\/10\/myanmar-military-forcibly-recruiting-rohingya\" >unlawful recruitment<\/a> of Rohingya men and boys, triggering heightened hate speech and misinformation.<\/p>\n<p>These divisive tactics were previously used during the <a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2013\/04\/22\/burma-end-ethnic-cleansing-rohingya-muslims\" >ethnic cleansing against the Rohingya in 2012.<\/a> The\u00a0 community\u2019s vulnerability was then deepened by the military junta\u2019s 2017 <a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2017\/08\/30\/burma-satellite-data-indicate-burnings-rakhine-state\" >scorched-earth campaign<\/a>, <a target=\"_blank\" href=\"https:\/\/www.hrw.org\/report\/2017\/11\/16\/all-my-body-was-pain\/sexual-violence-against-rohingya-women-and-girls-burma\" >rampant sexual violence<\/a> and <a target=\"_blank\" href=\"https:\/\/www.hrw.org\/news\/2022\/08\/24\/myanmar-no-justice-no-freedom-rohingya-5-years\" >genocidal acts<\/a>, which left villages burned to ash as several hundred thousand people fled to Bangladesh.<\/p>\n<p>More than 327,000 Rohingya have been newly displaced across Rakhine State since fighting resumed in late 2023, bringing the overall number of displaced people to well over a half a million. The UN Office for the Coordination of Humanitarian Affairs <a href=\"https:\/\/reliefweb.int\/report\/myanmar\/myanmar-humanitarian-update-no-40-16-august-2024\"  target=\"_blank\" rel=\"noopener noreferrer\">estimates<\/a> that 400,000 people are experiencing \u201cfood gaps\u201d in Rakhine State with cross-border supplies limited because of the conflict.<\/p>\n<p>Members of the military junta, the Arakan Army and other armed groups could also face scrutiny by the prosecutor of the International Criminal Court (ICC) for alleged crimes amid the current conflict committed in Bangladesh, such as <a href=\"https:\/\/thediplomat.com\/2024\/06\/rohingya-refugees-in-bangladesh-pressured-to-join-myanmars-civil-war\/\"  target=\"_blank\" rel=\"noopener noreferrer\">forced recruitment<\/a> and <a href=\"https:\/\/www.rfa.org\/english\/news\/myanmar\/rohingya-stranded-maungdaw-08092024151002.html\"  target=\"_blank\" rel=\"noopener noreferrer\">deportation<\/a> of Rohingya.<\/p>\n<p>The court is <a href=\"https:\/\/www.icc-cpi.int\/victims\/bangladesh-myanmar\"  target=\"_blank\" rel=\"noopener noreferrer\">investigating the situation<\/a>, but its jurisdiction is limited to crimes committed, at least in part, in Bangladesh, an ICC member country, or on the territory of any other member of the court. The Security Council should expand the court\u2019s jurisdiction by referring the situation in Myanmar, which is not an ICC member country, to the court.<\/p>\n<p>Recent events also underscore the blatant disregard of the <a href=\"https:\/\/www.icj-cij.org\/case\/178\/provisional-measures\"  target=\"_blank\" rel=\"noopener noreferrer\">provisional measures ordered<\/a> by International Court of Justice in the ongoing case brought by Gambia against Myanmar. The provisional measures are binding, and the Council should play a role in enforcing them. In a <a href=\"https:\/\/bangkok.ohchr.org\/wp-content\/uploads\/2024\/06\/A_HRC_56_23_AdvanceUneditedVersion.pdf\"  target=\"_blank\" rel=\"noopener noreferrer\">June report<\/a>, the UN high commissioner for human rights found that \u201cactions taken by all parties that endanger the Rohingya appear inconsistent with the provisional measures ordered by the International Court of Justice.\u201d<\/p>\n<p><a href=\"https:\/\/www.un.org\/en\/about-us\/un-charter\/chapter-14#:~:text=Article%2094&amp;text=If%20any%20party%20to%20a,give%20effect%20to%20the%20judgment.\"  target=\"_blank\" rel=\"noopener noreferrer\">Article 94(2) of the UN Charter<\/a> makes clear that parties to disputes may take recourse to the Security Council if their opponent fails to \u201cperform obligations incumbent upon it under a judgment rendered by the Court.\u201d<\/p>\n<p>The Council\u2019s great-power deadlock means that it has been far too quiet on Myanmar for years.
