The report will particularly consider the higher due diligence imposed on the private sector after the start of the International Criminal Court <a target=\"_blank\" href=\"https:\/\/www.icc-cpi.int\/palestine\" >investigation<\/a> in the situation in Palestine (2014), the <a target=\"_blank\" href=\"https:\/\/www.icj-cij.org\/case\/192\/orders\" >provisional measures<\/a> issued by the International Court of Justice (ICJ) since 26 January 2024, the ICJ\u2019s reminder to states in its order of 30 April 2024 in <a target=\"_blank\" href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/193\/193-20240430-ord-01-00-en.pdf\" ><em>Nicaragua v Germany<\/em><\/a>, and the ICJ <a target=\"_blank\" href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/186\/186-20240719-adv-01-00-en.pdf\" >Advisory Opinion<\/a> of 19 July 2024.<\/p>\n<p>Practices, policies and relationships of private entities in the oPt will be assessed against relevant provisions of international law, including the <a target=\"_blank\" href=\"https:\/\/thearmstradetreaty.org\/hyper-images\/file\/ATT_English\/ATT_English.pdf?templateId=137253\" >Arms Trade Treaty<\/a> and the <a target=\"_blank\" href=\"https:\/\/www.ohchr.org\/en\/publications\/reference-publications\/guiding-principles-business-and-human-rights\" >Guiding Principles of Businesses and Human Rights<\/a>.<\/p>\n<h3>Key questions and types of input\/comments sought<\/h3>\n<p>The Special Rapporteur welcomes contributions from States and other authorities, NHRIs, NGOs and human rights defenders, business enterprises, unions, academics, UN agencies and other stakeholders, on <strong>how the private sector is linked to, invests in and contributes to Israel\u2019s unlawful occupation, racial segregation and apartheid regime in the oPt and the military\/security industry underpinning it.<\/strong><\/p>\n<p>The Special Rapporteur would particularly appreciate clarification on the following issues:<\/p>\n<ol>\n<li>How has the private sector <strong>contributed to establish and maintain<\/strong> Israel\u2019s presence in the oPt since 1967?<\/li>\n<li>Which private entities, regardless of nationality, have had the most <strong>detrimental impact <\/strong>on the fundamental rights of Palestinian people in the oPt (specify how and which international crimes and violations of international law particularly)?<\/li>\n<li>What is the role played by these entities, particularly PMSC and WM, in <strong>aiding and abetting<\/strong> violations of international law and potential international crimes in the oPt? In addition, which third country are they affiliated to, if any?<\/li>\n<li>To what extent have these private entities carried out or avoided human rights <strong>due diligence <\/strong>measures to respect international law and decisions of international courts?<\/li>\n<li>Have <strong>international mechanisms (e.g. Human Council resolution <\/strong><a target=\"_blank\" href=\"https:\/\/undocs.org\/Home\/Mobile?FinalSymbol=A%2FHRC%2F55%2FL.30&amp;Language=E&amp;DeviceType=Desktop&amp;LangRequested=False\" >55\/L.30<\/a><strong>, <\/strong><a target=\"_blank\" href=\"https:\/\/www.ohchr.org\/en\/hr-bodies\/hrc\/regular-sessions\/session31\/database-hrc3136\" >OHCHR Database<\/a><strong>)<\/strong> addressed the potential negative involvement and impact of the private sector in the oPt? If not, why?<\/li>\n<li>What measures have been taken to end private entities\u2019 involvement in Israel\u2019s activities in the oPt?
