But in an appeal the following year Kupreskic was found not guilty and released.<\/p>\n<p>The Tribunal judges found there was insufficient evidence to convict Kupreskic for aiding and abetting an attack that killed Muslim residents of the village of Ahmi\u0107i in central Bosnia in April 1993.<\/p>\n<p>The crimes of which Kupreskic was accused were certainly serious. But, along with several other figures captured by the SAS in the late 1990s, they were less extensive than those currently levelled against Israeli prime minister Benjamin Netanyahu and former defence minister Yoav Gallant.<\/p>\n<p>Judges at the International Criminal Court (ICC) <a target=\"_blank\" href=\"https:\/\/www.icc-cpi.int\/news\/statement-icc-prosecutor-karim-aa-khan-kc-applications-arrest-warrants-situation-state\" >believe<\/a> that both Netanyahu and Gallant \u201cbear criminal responsibility\u201d for seven categories of \u201cwar crimes and crimes against humanity\u201d.<\/p>\n<p>They <a target=\"_blank\" href=\"https:\/\/www.icc-cpi.int\/news\/statement-icc-prosecutor-karim-aa-khan-kc-issuance-arrest-warrants-situation-state-palestine\" >say<\/a> there are reasonable grounds to suspect that both Netanyahu and Gallant have \u201ccommitted the war crime of using starvation as a method of warfare and crimes against humanity of murder, persecution, and other inhumane acts\u201d.<\/p>\n<p>They are also accused of \u201cintentionally directing attacks against civilians\u201d. These policies have surely affected tens of thousands, if not more, Palestinians.<\/p>\n<p>Far from sending in the SAS, the UK government is equivocating on whether it would even arrest the Israelis if they entered Britain, while the Conservative opposition thinks the ICC has no right to accuse them at all.<i class=\"fa fa-angle-right\"><\/i><\/p>\n<h2 id=\"h-behind-enemy-lines\" class=\"wp-block-heading\"><strong>Behind enemy lines<\/strong><\/h2>\n<p>Another figure captured by the SAS was Stevan Todorovic, who was seized in September 1998.<\/p>\n<p>The UK Ministry of Defence was so determined to arrest Todorovic that it ordered the SAS to carry out this operation inside <a target=\"_blank\" href=\"https:\/\/www.declassifieduk.org\/tag\/serbia\/\" >Serbia<\/a> itself.<\/p>\n<p>The territory was then still under the control of Slobodan Milosevic, whose policies sparked the Bosnian war and who later became the first sitting head of state charged with war crimes.<\/p>\n<p>Todorovic, the police chief in Bosanski \u0160amac in north-eastern Bosnia, was removed to The Hague and later sentenced by the Tribunal to ten years in prison.<\/p>\n<p>His crimes included beating a man who died as a result of this mistreatment, repeatedly beating seven other men over a period of eight months, and ordering three individuals over whom he had superior responsibility to torture a man.<\/p>\n<p>According to the UK Elite Forces <a target=\"_blank\" href=\"https:\/\/www.eliteukforces.info\/special-air-service\/sas-operations\/operation-ensue\/#google_vignette\" >website<\/a>, \u201cOn the night of the 27th of September, 1998, the 4-man SAS team, all fluent Serb speakers, stormed Todorovic\u2019s cabin. He was bound, gagged and put into a 4\u00d74 and driven to the Drina River, close to the border with Bosnia.<\/p>\n<p>\u201cOnce at the river, the SAS loaded Todorovic into an Zodiac-style inflatable boat and took him across and over the border where he was bundled into a waiting helicopter and flown to Tuzla for formal arrest.\u201d<\/p>\n<p>Others captured by the SAS were <a target=\"_blank\" href=\"https:\/\/www.icty.org\/x\/cases\/furundzija\/cis\/en\/cis_furundzija.pdf\" >Anto Furundzija<\/a>, a Bosnian Croat commander who was sentenced to ten years for involvement in torture, and Bosnian Serb general <a target=\"_blank\" href=\"https:\/\/www.icty.org\/x\/cases\/galic\/cis\/en\/cis_galic_en.pdf\" >Stanislav Galic<\/a>.<\/p>\n<p>He was sentenced to life in prison for conducting sniping and shelling attacks on the city of Sarajevo. These attacks, killing hundreds of men and women, were part of the siege of Bosnia\u2019s capital, which some have <a target=\"_blank\" href=\"https:\/\/www.aljazeera.com\/opinions\/2023\/12\/6\/as-bosniaks-we-have-a-duty-to-speak-up-for-gaza\" >compared<\/a> to the situation in Gaza.<strong>\u00a0<\/strong><\/p>\n<h2 id=\"h-putin\" class=\"wp-block-heading\"><strong>Putin<\/strong><\/h2>\n<p>Whitehall\u2019s weak reaction to ICC arrest warrants for Netanyahu and Gallant stands in contrast to the exertions it made towards the former Yugoslavia and, more recently, <a target=\"_blank\" href=\"https:\/\/www.declassifieduk.org\/tag\/russia\/\" >Russia<\/a>.<\/p>\n<p>When the ICC announced an arrest warrant for Russian ruler Vladimir Putin in March 2023, the UK increased <a target=\"_blank\" href=\"https:\/\/www.gov.uk\/government\/news\/london-hosts-major-international-war-crimes-meeting-as-uk-boosts-support-for-international-criminal-court\" >funding<\/a> to the organisation and hosted an international conference in London.<\/p>\n<p>\u201cThe ICC plays a vital role in global efforts to end impunity for war crimes\u201d, the UK Ministry of Justice said.<\/p>\n<p>A year earlier the UK had <a target=\"_blank\" href=\"https:\/\/www.gov.uk\/government\/news\/uk-leads-call-for-icc-to-investigate-russias-war-crimes\" >galvanised<\/a> a group of governments to refer Russian atrocities in <a target=\"_blank\" href=\"https:\/\/www.declassifieduk.org\/tag\/ukraine\/\" >Ukraine<\/a> to the ICC to enable it to proceed straight to an investigation \u2013 a process known as \u2018state party referral\u2019.<\/p>\n<p>David Lammy <a target=\"_blank\" href=\"https:\/\/x.com\/DavidLammy\/status\/1636771371668717572\" >described<\/a> the ICC\u2019s arrest warrant for Putin as \u201can historic step\u201d, adding that \u201cPresident Putin is now a wanted man\u201d.<\/p>\n<p>By contrast, the current foreign secretary has only grudgingly <a target=\"_blank\" href=\"https:\/\/inews.co.uk\/news\/politics\/david-lammy-uk-would-have-to-arrest-netanyahu-if-he-visits-britain-3403616?srsltid=AfmBOoo_cGx6DttzQTlLiZcW_yViwbpSfoq2DXOYcp6Qwd-mJDoOt3g2\" >conceded<\/a> that, in the cases of Netanyahu and Gallant, \u201cthere is an obligation on me to transmit to the courts should those named seek to come in to our country\u201d.<\/p>\n<p>When in 2006 former Liberian president Charles Taylor was undergoing a war crimes trial in The Hague for aiding rebels in Sierra Leone notorious for hacking off limbs of civilians, the British government offered to house him in a UK jail if convicted.<\/p>\n<p>Sentenced to 50 years imprisonment, Taylor began serving his conviction at HMP Frankland near Durham.
