{"id":312021,"date":"2026-01-19T12:00:19","date_gmt":"2026-01-19T12:00:19","guid":{"rendered":"https:\/\/www.transcend.org\/tms\/?p=312021"},"modified":"2026-01-14T19:32:31","modified_gmt":"2026-01-14T19:32:31","slug":"will-the-icj-deliver-justice-and-accountability-for-myanmars-rohingyas","status":"publish","type":"post","link":"https:\/\/www.transcend.org\/tms\/2026\/01\/will-the-icj-deliver-justice-and-accountability-for-myanmars-rohingyas\/","title":{"rendered":"Will the ICJ Deliver Justice and Accountability for Myanmar\u2019s Rohingyas?"},"content":{"rendered":"<blockquote><p><em>As gratifying as it is to see the Rohingya people having their day at &#8220;the world&#8217;s court, the ICJ will not end the era of impunity for Myanmar junta and change Rohingya lives for better.<\/em><em><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2026\/01\/icj-rohingya.webp\"><br \/>\n<img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-312023\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2026\/01\/icj-rohingya-1024x394.webp\" alt=\"\" width=\"700\" height=\"269\" srcset=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2026\/01\/icj-rohingya-1024x394.webp 1024w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2026\/01\/icj-rohingya-300x115.webp 300w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2026\/01\/icj-rohingya-768x295.webp 768w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2026\/01\/icj-rohingya.webp 1456w\" sizes=\"auto, (max-width: 700px) 100vw, 700px\" \/><\/a><\/em><\/p><\/blockquote>\n<p>Today, 12 January, at the Palace of Peace, The Hague, <a target=\"_blank\" href=\"https:\/\/icj-cij.org\/index.php\/court\"  rel=\"\">the International Court of Justice<\/a> <a target=\"_blank\" href=\"https:\/\/webtv.un.org\/en\/asset\/k1b\/k1bq5epaed\"  rel=\"\">kicked off its Merit Phase proceedings<\/a> (evidence and counter-evidence presentations and examinations to support legal claims and counterclaims of genocide) in <a target=\"_blank\" href=\"https:\/\/www.icj-cij.org\/case\/178\/summaries\"  rel=\"\">the Gambia vs. Myanmar case<\/a>.<\/p>\n<p>Six years ago, the small African state of Gambia filed the case against Myanmar alleging that the latter as a signatory state to the Genocide Convention is in breach of its legally binding treaty obligations under the Convention on the Prevention and Punishment of the Crime of Genocide against the country\u2019s Rohingya ethnic group.<\/p>\n<p>On the opening day of this Merit Phase proceedings, I joined the two distinguished professionals at the TRT World Newsmaker program to discuss the likely impact of the ICJ\u2019s final verdict, whenever : <a target=\"_blank\" href=\"https:\/\/www.alainpellet.eu\/biographie?lang=en\"  rel=\"\">Alain Pellet<\/a>, former Chair of <a target=\"_blank\" href=\"https:\/\/legal.un.org\/ilc\/\"  rel=\"\">the International Law Commission<\/a> and the Honorary President of the <a target=\"_blank\" href=\"https:\/\/ilafrance.org\/en\/conferences-en\/\"  rel=\"\">French Society for International Law <\/a>and <a target=\"_blank\" href=\"https:\/\/www.refugeesinternational.org\/authors\/lucky-karim\/\"  rel=\"\">Lucky Karim<\/a>, founder of Refugee Women for Peace and Justice (RWPJ) and Rohingya refugee fellow with Refugees International based in Washington DC.<\/p>\n<p>Watch the 26-minutes program aired this evening <a target=\"_blank\" href=\"https:\/\/youtu.be\/o6M4iAyws1c?si=ZP2hRQfmaeOJoycp the discussion with me and 2 people including the former head of the International Law Commission and a Rohingya woman activist begins at 5 minutes from the start of the 26 min program.\"  rel=\"\">here<\/a>.<\/p>\n<p>The discussion begins at 5 minutes. My main point is: the ICJ and international law should not become a source of \u201cfalse hope\u201d for the oppressed and the <em>genocided<\/em>, especially in the light of the fact that both <a target=\"_blank\" href=\"https:\/\/www.thejakartapost.com\/opinion\/2023\/10\/16\/powerful-states-are-killing-international-law-genocide-convention.html\"  rel=\"\">powerful states such as the United States have pretty much destroyed the United Nations, its judicial organs and international law<\/a> for them to make any real positive impact on the lives of those nations and communities that need the protection and support of these institutions and instruments.<\/p>\n<p><em>___________________________________________<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2023\/02\/Maung-Zarni-e1761901595577.png\" ><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-228999\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2023\/02\/Maung-Zarni-e1761901595577.png\" alt=\"\" width=\"90\" height=\"81\" \/><\/a> A Buddhist humanist from Burma (Myanmar), Maung Zarni, nominated for the 2024 Nobel Peace Prize, is a member of the <\/em><a href=\"https:\/\/www.transcend.org\/tms\/\" ><em>TRANSCEND Media Service<\/em><\/a><em> Editorial Committee, of the <\/em><a href=\"https:\/\/www.transcend.org\/\" >TRANSCEND Network for Peace Development Environment<\/a><em>, former Visiting Lecturer with Harvard Medical School, specializing in racism and violence in Burma and Sri Lanka, and Non-resident Scholar in Genocide Studies with Documentation Center \u2013 Cambodia.\u00a0Zarni is the co-founder of <\/em><a target=\"_blank\" href=\"http:\/\/forsea.co\/\" >FORSEA<\/a><em>, a grass-roots organization of Southeast Asian human rights defenders, coordinator for Strategic Affairs for <\/em>Free Rohingya Coalition,<em> and an adviser to the <\/em>European Centre for the Study of Extremism<em>, Cambridge<strong>. <\/strong>Zarni holds a PhD (U Wisconsin at Madison) and a MA (U California), and has held various teaching, research and visiting fellowships at the universities in Asia, Europe and USA including Oxford, LSE, UCL Institute of Education, National-Louis, Malaya, and Brunei. He is the recipient of the &#8220;Cultivation of Harmony&#8221; award from the Parliament of the World&#8217;s Religions (2015). His analyses have appeared in leading newspapers including the <\/em>New York Times, The Guardian <em>and<\/em> the Times<em>. Among his academic publications on Rohingya genocide are <\/em>The Slow-Burning Genocide of Myanmar\u2019s Rohingyas<em> (Pacific Rim Law and Policy Journal), <\/em>An Evolution of Rohingya Persecution in Myanmar: From Strategic Embrace to Genocide<em>, (Middle East Institute, American University), and <\/em>Myanmar\u2019s State-directed Persecution of Rohingyas and Other Muslims<em> (Brown World Affairs Journal).
