07 July 2013<\/i> – Russia’s further participation in\u00a0India’s multibillion dollar Kudankulam nuclear power plant looks uncertain as the\u00a0two sides have failed to\u00a0resolve liability in\u00a0the event of\u00a0an accident, an\u00a0Indian official said Friday [5 Jul 2013].<\/p>\n

Rosatom chief Sergei Kiriyenko<\/a> met India’s Atomic Energy Commission chief RK Sinha in\u00a0Saint Petersburg on\u00a0the sidelines of\u00a0International Ministerial Conference on\u00a0Nuclear Power in\u00a0the 21st Century at\u00a0the end of\u00a0last month. Kudankulam units 3 & 4 were discussed, but the\u00a0two executives failed to\u00a0resolve the\u00a0nuclear liability issue.<\/p>\n

Sinha has been quoted in\u00a0the Indian media as having said that he does not see any contradiction between his country’s legislation concerning liability and\u00a0the 2008 Indo-Russian agreement on\u00a0the plant, which he said had no specifics about legal recourse. Under the\u00a0terms of\u00a0the agreement, Rosatom is set to\u00a0provide expertise and\u00a0technical assistance on\u00a0the construction of\u00a0six 1,000 megawatt reactors at\u00a0Kudankulam. The\u00a0first two are nearing completion.<\/p>\n

An\u00a0Indian official privy to\u00a0the discussions said on\u00a0condition of\u00a0anonymity, since he was not authorized to\u00a0speak to\u00a0the media, that the\u00a0sticking point for\u00a0Russia was India’s insistence on\u00a0placing the\u00a0new reactors under its 2010 Civil Liability for\u00a0Nuclear Damages Act. This law holds the\u00a0plant operator entirely liable in\u00a0the event of\u00a0an accident but gives it a\u00a0right of\u00a0recourse against suppliers if the\u00a0problem is caused by\u00a0defective equipment.<\/p>\n

The\u00a0Russians refer to\u00a0the 2008 agreement, which makes the\u00a0Indian plant operator alone liable for\u00a0possible damages at\u00a0Units 3 to\u00a06, to\u00a0be built at\u00a0Kudankulam. Rosatom believes that Kudankulam’s units 3 & 4 should be out of\u00a0the scope of\u00a0the 2010 law, the\u00a0official said, since the\u00a0Indo-Russian agreement predates it.<\/p>\n

Experts predict that discussions on\u00a0liability, as well as pricing, will continue at\u00a0upcoming high-level bi-lateral meetings, including Indian Prime Minister Manmohan Singh’s visit to\u00a0Saint Petersburg for\u00a0the Group of\u00a020 summit in\u00a0September.<\/p>\n
