A group of residents and the local council challenged permits given to Google, raising concerns about the impact of the development on the city\u2019s already <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/world\/2022\/jun\/01\/chiles-water-crisis-megadrought-reaching-breaking-point\"  data-link-name=\"in body link\">climate-stressed water supply<\/a>.<\/p>\n<p class=\"dcr-1s160rg\">The lawsuit succeeded in <a target=\"_blank\" href=\"https:\/\/www.cooperativa.cl\/noticias\/pais\/medioambiente\/tribunal-ambiental-freno-proyecto-de-data-center-de-google-en-cerrillos\/2024-02-27\/154401.html\"  data-link-name=\"in body link\">halting the Cerrillos project<\/a>, on the grounds that climate impacts had not been properly considered, but not the wider explosion of datacentres, which is <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/global-development\/2026\/may\/26\/chile-datacentres-water-tech-companies-mega-drought\"  data-link-name=\"in body link\">draining Chile\u2019s already drought-stricken wetlands<\/a>.<\/p>\n<p class=\"dcr-1s160rg\">The LSE report identified Ireland as a hotspot for litigation against datacentres. The Irish government <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/environment\/2020\/jan\/06\/why-irish-data-centre-boom-complicating-climate-efforts\"  data-link-name=\"in body link\">wants the sector to expand<\/a>, even though it is already <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/technology\/2026\/may\/28\/irish-datacentres-household-bills-electricity\"  data-link-name=\"in body link\">consuming more than a fifth<\/a> of the nation\u2019s electricity.<\/p>\n<p class=\"dcr-1s160rg\">In December, Ireland\u2019s Commission for the Regulation of Utilities (CRU) <a target=\"_blank\" href=\"https:\/\/www.cru.ie\/about-us\/news\/the-cru-publishes-its-decision-on-new-electricity-connection-policy-for-data-centres\/?ref=the-wave.net\"  data-link-name=\"in body link\">said<\/a> \u201clarge energy users\u201d such as datacentres would be allowed to operate on fossil fuels for the next six years, after which they must run on at least 80% renewables.<\/p>\n<p class=\"dcr-1s160rg\">Friends of the Irish Environment (FIE), Friends of the Earth Ireland and ClientEarth are seeking a judicial review of the decision because they argue it will lock Ireland into high-emitting, expensive fossil gas for years to come.<\/p>\n<p class=\"dcr-1s160rg\">FIE has brought several other claims relating to datacentres in Ireland, including one <a target=\"_blank\" href=\"https:\/\/www.the-wave.net\/ireland-epa-challenged-over-climate-impact-of-approved-data-centre\/\"  data-link-name=\"in body link\">against the Environmental Protection Agency<\/a> over its approval of a project in South Dublin.<\/p>\n<p class=\"dcr-1s160rg\">There is also a growing legal backlash against datacentres in the US. In California, the city of Pittsburg <a target=\"_blank\" href=\"https:\/\/www.climatecasechart.com\/collections\/center-for-biological-diversity-v-city-of-pittsburg_4f57be\"  data-link-name=\"in body link\">must now<\/a> require a datacentre to use renewable energy for power and recycled water to cool its servers. In <a target=\"_blank\" href=\"https:\/\/www.selc.org\/press-release\/groups-challenge-air-permit-for-massive-methane-gas-and-oil-expansion-at-plant-bowen\/\"  data-link-name=\"in body link\">Georgia<\/a> and <a target=\"_blank\" href=\"https:\/\/static1.squarespace.com\/static\/655a2d016eb74e41dc292ed5\/t\/6944581e9fad1452f1c2f278\/1766086686162\/Homer+City+NOA_EHB+Case+No.+2025136.pdf\"  data-link-name=\"in body link\">Pennsylvania<\/a>, there is ongoing litigation against state regulators for approving new fossil fuel infrastructure linked to datacentres.<\/p>\n<p class=\"dcr-1s160rg\">Another case in Mississippi argues that <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/technology\/2026\/feb\/13\/elon-musk-xai-pollution-naacp?ref=the-wave.net\"  data-link-name=\"in body link\">Elon Musk\u2019s xAI<\/a> is breaching the Clean Air Act by running portable methane gas generators without the required permits. The case, brought by the National Association for the Advancement of Colored People, says these pose serious public health risks to nearby Black and minority communities. The US Department of Justice is <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/technology\/2026\/jun\/16\/elon-musk-xai-datacenters-trump-administration\"  data-link-name=\"in body link\">trying<\/a> <a target=\"_blank\" href=\"https:\/\/www.wsj.com\/pro\/sustainable-business\/doj-defends-musks-xai-in-data-center-pollution-lawsuit-25df5258\"  data-link-name=\"in body link\">to block the lawsuit<\/a>, claiming the company\u2019s work is essential to the economy.<\/p>\n<p class=\"dcr-1s160rg\">In the UK, campaigners took legal action against the government\u2019s decision to force through construction of a \u201chyperscale\u201d datacentre in Buckinghamshire. Foxglove, a tech justice non-profit organisation, and Global Action Plan, an environmental charity, represented by the law firm Leigh Day, said the decision ignored the project\u2019s electricity and water demands and did not properly consider its climate impacts.<\/p>\n<p class=\"dcr-1s160rg\">The <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/politics\/2026\/jan\/22\/government-ai-datacentre-approval-quashed\"  data-link-name=\"in body link\">government has since accepted<\/a> there were flaws in the process and the lawsuit was dropped. The <a target=\"_blank\" href=\"https:\/\/www.foxglove.org.uk\/2026\/04\/22\/government-precedent-environmental-protections-data-centres-legally-binding\/\"  data-link-name=\"in body link\">developer now admits<\/a> measures to mitigate environmental impact would need to be made binding through a contract with the council.<\/p>\n<p class=\"dcr-1s160rg\">The LSE report said cases in the US and UK showed how litigation \u201ccan drive changes in climate-related decision-making even in the absence of positive judgments\u201d.
