Anti-BDS Case against Jake Lynch Falls Apart"},"content":{"rendered":"<p><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2014\/07\/BDS-logo-israel-palestine.jpg\" ><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-44634\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2014\/07\/BDS-logo-israel-palestine.jpg\" alt=\"BDS-logo israel palestine\" width=\"248\" height=\"170\" \/><\/a><\/p>\n<p>A hard-line Israeli legal centre targetting an Australian academic is about to suffer a humiliating defeat in an Australian court.<\/p>\n<p>An Australian academic accused of breaching the Racial Discrimination Act for supporting the Boycott, Divestment and Sanctions (BDS) campaign is on the verge of a significant victory after the Israeli law centre pursuing him signed an agreement to request the case be dismissed.<\/p>\n<p>Centre for Peace and Conflict studies director Jake Lynch told New Matilda today that Israeli group Shurat HaDin have now agreed to pay his costs after taking him to the Federal Court for his support of BDS, which encourages a disengagement from Israel in retaliation for the nation\u2019s occupation of Palestinian land, and policies of collective punishment.<\/p>\n<p>Shurat HaDin lodged a complaint with the Australian Human Rights Commission in August 2013 and then pursued it in the Federal Court with the intention of dealing a blow to <a target=\"_blank\" href=\"https:\/\/newmatilda.com\/2013\/10\/31\/israeli-law-centre-sues-outlaw-boycotts\" >both Lynch and the Australian BDS movement more broadly.<\/a><\/p>\n<p>Lynch said he was excited and relieved that the case was being abandoned.<\/p>\n<div id=\"attachment_43152\" style=\"width: 190px\" class=\"wp-caption alignright\"><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2014\/05\/jake-lynch-180x167.jpg\" ><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-43152\" class=\"size-full wp-image-43152\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2014\/05\/jake-lynch-180x167.jpg\" alt=\"Prof. Jake Lynch\" width=\"180\" height=\"167\" \/><\/a><p id=\"caption-attachment-43152\" class=\"wp-caption-text\">Prof. Jake Lynch<\/p><\/div>\n<p>\u201cIt\u2019s both an opportunity and in a sense a challenge, to not only other academics but others in the Australian community, to think about what they can do in solidarity with the Palestinian struggle for rights and freedoms,\u201d Lynch said.<\/p>\n<p>The case was filed after Lynch refused to assist Israeli Professor Dan Avnon in his attempts to secure a fellowship at the University of Sydney. Despite being drawn in to the controversy, Avnon was not an applicant in the case.<\/p>\n<p>While deeply critical of the BDS campaign, the Executive Council of Australian Jewry declined to provide support for the lawsuit.<\/p>\n<p>Lynch said the case had represented a significant risk to him both financially and reputationally.<\/p>\n<p>\u201cIf the case had gone the other way I would have effectively been labelled a racist,\u201d Lynch said.<\/p>\n<p>\u201cGiven that I\u2019m a Professor of Peace and Conflict Studies committed to peace for justice, that would have been a significant blow to my reputation,\u201d Lynch said.<\/p>\n<p>He accused Shurat HaDin of defaming him by reiterating accusations of anti-Semitism and for misrepresenting his reasons for supporting BDS.<\/p>\n<p>While Shurat HaDin and their legal representative Andrew Hamilton had not responded to requests for comment at the time of print, the organisation told The Australian newspaper that the conclusion of <a target=\"_blank\" href=\"http:\/\/www.theaustralian.com.au\/national-affairs\/israeli-group-drops-case-against-sydney-academic-jake-lynch\/story-fn59niix-1226983474575\" >the case was based on a \u201clegal technicality\u201d<\/a>. The group was not able to nominate a living plaintiff.<\/p>\n<p>The head of Shurat HaDin, Nitsana Darshan-Leitner, told the newspaper: \u201cWe are absolutely determined that Lynch committed an unlawful breach of Australian anti-discrimination law.\u201d<\/p>\n<p>\u201cWe\u2019ve crossed the Rubicon really, because Shurat HaDin is the only one of the original applicants that still has permission to bring a case, and they have thrown in the towel,\u201d Lynch said.<\/p>\n<p>The conclusion of the matter comes as the relations between Israel and Palestine have disintegrated almost entirely.<\/p>\n<p>Rocket fire from Gaza has been met with devastating Israeli bombardments, reported to have <a target=\"_blank\" href=\"http:\/\/www.theguardian.com\/world\/2014\/jul\/10\/israel-gaza-conflict-prompts-emergency-un-security-council-meeting-live-updates#block-53be73d3e4b0bd8dbcd86a85\" >killed up to 90 Palestinians including 22 children<\/a>.<\/p>\n<p>No Israelis have yet been <a target=\"_blank\" href=\"http:\/\/www.nytimes.com\/2014\/07\/11\/world\/middleeast\/israel-gaza.html?_r=0\" >killed by the rocket fire from Palestine.<\/a><\/p>\n<p>\u201cThe circumstances today make the case more strongly for BDS than anything else could, and that\u2019s why we need to step up our efforts,\u201d Lynch said.<\/p>\n<p>The case against Lynch will come before the court again on Wednesday, at which point Justice Roberson is expected to follow the request of both parties to have it dismissed.<\/p>\n<p>Lynch was previously awarded costs for an earlier segment of the proceedings and will now have to negotiate the final costs with Shurat HaDin and the Court.<\/p>\n<p>_____________________________<\/p>\n<p><em>Jake Lynch, former BBC newsreader, political correspondent for Sky News and Sydney correspondent for the Independent, is Associate Professor of Peace Journalism and Director of the Centre for Peace and Conflict Studies at the University of Sydney, Australia.
