Photo illustration: DonkeyHotey \/ Flickr via Creative Commons<\/p><\/div>\n<p>America\u2019s rising civil liberties movement lost one of its strongest advocates in the US Congress on Tuesday night, <a target=\"_blank\" href=\"http:\/\/www.theguardian.com\/us-news\/2014\/nov\/05\/colorado-republican-cory-gardner-ousts-mark-udall\" >as Colorado\u2019s Mark Udall lost his Senate seat to Republican Cory Gardner<\/a>. While the election was not a referendum on Udall\u2019s support for civil liberties (Gardner <a target=\"_blank\" href=\"http:\/\/www.usnews.com\/news\/articles\/2014\/10\/24\/nsa-reform-has-2-backers-in-close-colorado-senate-race\" >expressed support for surveillance reform<\/a>, and Udall spent most of his campaign <a target=\"_blank\" href=\"http:\/\/www.cnn.com\/2014\/11\/03\/politics\/udall-heckler-colorado\/\" >almost solely concentrating<\/a> on reproductive issues), the loss is undoubtedly a blow for privacy and transparency advocates, as Udall was one of the NSA and CIA\u2019s most outspoken and consistent critics. Most importantly, he sat on the intelligence committee, the Senate\u2019s sole oversight board of the clandestine agencies, where he was one of just a few dissenting members.<\/p>\n<p>But Udall\u2019s loss doesn\u2019t have to be all bad. The lame-duck transparency advocate now has a rare opportunity to truly show his principles in the final two months of his Senate career and finally expose, in great detail, the secret government wrongdoing he\u2019s been criticizing for years. On his way out the door, Udall can use congressional immunity provided to him by the <a target=\"_blank\" href=\"http:\/\/www.law.cornell.edu\/anncon\/html\/art1frag21_user.html\" >Constitution\u2019s Speech and Debate clause<\/a> to read the Senate\u2019s <a target=\"_blank\" href=\"http:\/\/www.theguardian.com\/commentisfree\/2014\/oct\/22\/torture-obama-cover-up-cia\" >still-classified<\/a> 6,000-page CIA torture report into the Congressional record \u2013 on the floor, on TV, for the world to see.<\/p>\n<p>There\u2019s ample precedent for this. In 1971, former Senator Mike Gravel famously <a target=\"_blank\" href=\"http:\/\/query.nytimes.com\/mem\/archive\/pdf?res=990CE6DD1238EF34BC4850DFB066838A669EDE\" >read the top-secret classified Pentagon Papers<\/a> for three hours before almost collapsing and then entering thousands of pages more into the record after he couldn\u2019t speak for any longer from exhaustion.<\/p>\n<p>In fact, Udall and his nearly lone partner in transparency, Senator Ron Wyden, <a target=\"_blank\" href=\"http:\/\/t.co\/gQ5PHO6kZS\" >have received criticism<\/a> for not using this floor privilege before, including very recently when director Laura Poitras, on tour for <a target=\"_blank\" href=\"http:\/\/www.theguardian.com\/commentisfree\/2014\/oct\/11\/the-snowden-documentary-shows-that-only-government-transparency-can-stop-leaks\" >her new documentary<\/a> about Edward Snowden, said Wyden and others <a target=\"_blank\" href=\"http:\/\/thehill.com\/policy\/technology\/221825-snowden-filmmaker-lawmakers-failed-the-public\" >\u201cfailed the public\u201d<\/a> by not coming out and openly saying in 2011 that the NSA had secretly re-interpreted the Patriot Act to collect every American\u2019s phone records. In many ways, Snowden let them off the hook.<\/p>\n<p>But while in office, these two senators have at least a plausible argument they were making the right decision. Udall and Wyden would almost certainly get kicked off the intelligence committee and lose all their clearances if they were to read the still-up-for-review truth about Bush-era atrocities out loud. And by staying on the committee, they\u2019ve had a chance to force change from the inside (like <a target=\"_blank\" href=\"http:\/\/www.wyden.senate.gov\/news\/press-releases\/wyden-udall-statement-on-the-disclosure-of-bulk-email-records-collection-program\" >they\u2019ve successfully done for at least one version<\/a> of internet mass surveillance), and ask tough questions of spies and their bosses who are used to hearing nothing but softballs.<\/p>\n<p>But now, Udall has nothing to lose. He can\u2019t get kicked off any committee he won\u2019t be a part of in two months. And he can\u2019t be prosecuted for revealing classified information as a member of Congress.<\/p>\n<p>With secrecy-fetishist Republican Richard Burr <a target=\"_blank\" href=\"http:\/\/www.theguardian.com\/commentisfree\/2014\/nov\/01\/does-the-cia-want-republicans-to-win-the-midterms\" >likely taking over the chair of the intelligence committee<\/a>, the public cover-up is probably only going to get worse next year. While <a target=\"_blank\" href=\"http:\/\/www.huffingtonpost.com\/2014\/11\/04\/cia-torture-report_n_6103510.html\" >the Huffington Post\u2019s Ali Watkins writes<\/a> that it\u2019s likely Senator Dianne Feinstein wouldn\u2019t let the Republicans take over without first releasing at least the executive summary of the report, she\u2019d have to release a version full of incomprehensible redactions the CIA still won\u2019t budge on.
