{"id":51462,"date":"2014-12-22T12:00:41","date_gmt":"2014-12-22T12:00:41","guid":{"rendered":"https:\/\/www.transcend.org\/tms\/?p=51462"},"modified":"2015-05-05T21:27:09","modified_gmt":"2015-05-05T20:27:09","slug":"hamas-calls-for-eu-talks-after-court-ruling","status":"publish","type":"post","link":"https:\/\/www.transcend.org\/tms\/2014\/12\/hamas-calls-for-eu-talks-after-court-ruling\/","title":{"rendered":"Hamas Calls for EU Talks after Court Ruling"},"content":{"rendered":"<div id=\"attachment_51463\" style=\"width: 630px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2014\/12\/gaza-palestine-israel-west-bank-hamas.png\" ><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-51463\" class=\"size-full wp-image-51463\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2014\/12\/gaza-palestine-israel-west-bank-hamas.png\" alt=\"Gaza man points to war damage after an Israeli incursion in 2008\/2009 (Photo: Amir Farshad Ebrahimi)\" width=\"620\" height=\"300\" srcset=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2014\/12\/gaza-palestine-israel-west-bank-hamas.png 620w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2014\/12\/gaza-palestine-israel-west-bank-hamas-300x145.png 300w\" sizes=\"auto, (max-width: 620px) 100vw, 620px\" \/><\/a><p id=\"caption-attachment-51463\" class=\"wp-caption-text\">Gaza man points to war damage after an Israeli incursion in 2008\/2009 (Photo: Amir Farshad Ebrahimi)<\/p><\/div>\n<p><em>17 Dec 2014 &#8211; <\/em>Hamas wants the EU foreign relations chief, Federica Mogherini, to come to Gaza to start a new dialogue after the EU court said it should be taken off the terrorist register.<\/p>\n<p>Its deputy foreign minister, Ghazi Hamad, told EUobserver by phone on Wednesday (17 December): \u201cI invite Ms Mogherini to come here to hold many different meetings at all levels\u201d.<\/p>\n<p>\u201cI hope we can open a new channel for political dialogue, to build bridges, because without the participation of Hamas [in the peace process] there will never be peace or security\u201d.<\/p>\n<p>The EU court in Luxembourg earlier the same day \u201cannulled\u201d on \u201cprocedural grounds\u201d an EU decision, dating back to 2003, to impose an asset freeze on the Palestinian militant group.<\/p>\n<p>But it maintained the freeze for at least three months to stop funds being wired in case the EU appeals.<\/p>\n<p>It also gave a withering account of the way that EU countries handled the Gaza listing. \u201cThe contested measures are based not on acts examined and confirmed in decisions of competent authorities but on factual imputations derived from the press and the Internet\u201d, it said.<\/p>\n<p>EU countries\u2019 diplomats will hold talks in January on how to react.<\/p>\n<p>Mogherini\u2019s office said in a statement the EU \u201cwill, in due course, take appropriate remedial action, including any eventual appeal to the ruling\u201d.<\/p>\n<p>It added that \u201cit is a legal ruling of a court, not a political decision taken by the EU governments. The EU continues to uphold the Quartet principles\u201d.<\/p>\n<p>The principles are international benchmarks on Hamas recognition, which include a demand for the group to renounce armed resistance and an informal ban on high-level EU meetings.<\/p>\n<p>One EU source laughed when EUobserver asked what are the chances of a Mogherini visit, noting \u201cit [the verdict] doesn\u2019t reflect any political change, so there won\u2019t be any meeting\u201d.<\/p>\n<p>A second EU source noted that even if the verdict sticks, the ban on high-level talks won\u2019t be lifted until Hamas complies with Quartet conditions.<\/p>\n<p><strong>Vindication?<\/strong><\/p>\n<p>But for his part, the Hamas minister claimed the ruling as a moral vindication.<\/p>\n<p>\u201cIt\u2019s good news, but it comes 12 years too late\u201d, Hamad said.<\/p>\n<p>He described Hamas as a \u201cnational liberation movement\u201d which has a \u201cright\u201d to resist Israeli occupation \u201cby all means necessary, which are not against international law\u201d.<\/p>\n<p>Hamas openly targetted Israeli civilians in the last Gaza war in summer, killing two people.<\/p>\n<p>But Hamad noted that Israel killed over 800 women and children despite claims it tries to avoid hurting civilians.<\/p>\n<p>He added that Hamas is ready to accept a two-state solution, but said Palestinians \u201cgot nothing\u201d out of the last 22 years of peace talks.<\/p>\n<p>\u201cWe are all waiting for the end of the occupation. We\u2019ve accepted an Israeli state in 1967 borders in many documents and media interviews\u201d.<\/p>\n<p>He said EU countries and the US talk to Hamas anyway despite the Quartet ban.<\/p>\n<p>He listed Italy, France, Spain, Sweden, and the UK as the most active.<\/p>\n<p>\u201cWe discuss everything with them and they admit, even the US officials admit, that Hamas is not a terrorist organisation, that it\u2019s part of the political equation\u201d.<\/p>\n<p>\u201cIt\u2019s time for these underground talks to see the light of day\u201d.<\/p>\n<p><strong>EU and US systems<\/strong><\/p>\n<p>The court ruling is the latest in a series of defeats for EU sanctions &#8211; on Iran and Sri Lanka, among others &#8211; and augurs badly for court challenges brought by blacklisted Russian and Ukrainian officials.<\/p>\n<p>EU countries in November launched a review of the evidence underpinning their decisions on all 35 entities on its terrorist register.<\/p>\n<p>By contrast, the US department of treasury has never lost an asset freeze challenge.<\/p>\n<p>But an EU diplomat said: \u201cThe EU and US judicial systems are different. They often request that we impose sanctions in various cases, but we have to decline on legal grounds\u201d.<\/p>\n<p>A second EU diplomat noted: \u201cA bad decision on sanctions can ruin people\u2019s businesses, ruin lives. So we should be happy we have a court which looks into these things\u201d.<\/p>\n<p>He added the sanctions defeats stem from reluctance by some EU states to share classified information both with the court and with fellow EU countries.<\/p>\n<p>\u201cWe work on the basis of trust.
