{"id":56539,"date":"2015-04-20T12:00:59","date_gmt":"2015-04-20T11:00:59","guid":{"rendered":"https:\/\/www.transcend.org\/tms\/?p=56539"},"modified":"2015-05-05T21:25:50","modified_gmt":"2015-05-05T20:25:50","slug":"australia-to-authorize-guards-to-beat-asylum-seekers-to-death-report","status":"publish","type":"post","link":"https:\/\/www.transcend.org\/tms\/2015\/04\/australia-to-authorize-guards-to-beat-asylum-seekers-to-death-report\/","title":{"rendered":"Australia to Authorize Guards to &#8216;Beat Asylum Seekers to Death&#8217; \u2013 Report"},"content":{"rendered":"<div id=\"attachment_56540\" style=\"width: 700px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2015\/04\/australia-immigration-camps-violence.si_.jpg\" ><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-56540\" class=\"size-full wp-image-56540\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2015\/04\/australia-immigration-camps-violence.si_.jpg\" alt=\"A secruity guard keeps watch outside one of the compounds at the Baxter Immigration Reception and Processing Centre near Port Augusta (Reuters \/ Mark Baker)\" width=\"690\" height=\"388\" srcset=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2015\/04\/australia-immigration-camps-violence.si_.jpg 690w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2015\/04\/australia-immigration-camps-violence.si_-300x169.jpg 300w\" sizes=\"auto, (max-width: 690px) 100vw, 690px\" \/><\/a><p id=\"caption-attachment-56540\" class=\"wp-caption-text\">A secruity guard keeps watch outside one of the compounds at the Baxter Immigration Reception and Processing Centre near Port Augusta (Reuters \/ Mark Baker)<\/p><\/div>\n<p>An inquiry by the Australian Supreme Court has proposed new powers to officers at immigration centers, granting them right to resort to violence, should they find it necessary, according to a former Victoria supreme court judge.<\/p>\n<p>Following a Senate hearing of an amendment to the new migration bill Stephen Charles SC, who was the Victoria court of appeal judge until 2006, <a target=\"_blank\" href=\"http:\/\/www.theguardian.com\/australia-news\/2015\/apr\/16\/new-immigration-powers-would-let-guards-beat-asylum-seekers-to-death\" >told<\/a> the Guardian on Thursday [16 Apr 2015] that it would <em>\u201cinevitably encourage violence by guards against asylum seekers\u201d<\/em> by considerably expand their powers.<\/p>\n<p>The new powers, applying to immigration officers, would let them use <em>\u201creasonable force against any person\u201d<\/em> to maintain order and security, which in fact could lead to <em>\u201cbeating asylum seekers to death.\u201d<\/em> The immunity from civil and criminal liability will include private contractors \u2013 people, who are less trained than police officers.<\/p>\n<p><em> \u201cTime and again police in the United States have been acquitted in circumstances such as these,\u201d<\/em> Charles said. <em>\u201cThese amendments to the Migration Act will in effect authorize guards to beat asylum seekers to death on the basis they reasonably believe it is necessary \u2026 to do so.\u201d<\/em><\/p>\n<p>Australia keeps its asylum seekers at the Nauru refugee detention center, and human rights violations including rape and physical abuse have been going on since November 2013. Reports of harsh conditions at the center, consisting of two fenced-off tent camps with up to 1,200 detainees, have been recently passed to the Australian government.<\/p>\n<p>Legal action against human rights violators in immigration centers could only be possible if it is proven that a guard was <em>\u201cin bad faith,\u201d<\/em> which is quite difficult to demonstrate.<\/p>\n<p>The President of the Australian Human Rights Commission Gillian Triggs said: <em>\u201cSenior courts have &#8230; explained the very high threshold that you must prove to demonstrate bad faith. It\u2019s very hard to show a subjective intent of bad faith of a serving officer acting in the course of their employment.\u201d<\/em><\/p>\n<p>On Wednesday, Wickham Point Detention Centre in Darwin saw unrest, with 20 inmates reportedly harming themselves in order to avoid transfer to Nauru Island. Police responded to the rioting, though authorities denied any major <em>\u201cmayhem\u201d<\/em>.<\/p>\n<p>This February, Australians held candle light vigils to commemorate Iranian man Reza Barati, 23, who was beaten to death while being held at the Manus Island detention center in Papua New Guinea. He was allegedly killed by the staff during three days of attacks by locals and rioting he was not involved in.<\/p>\n<p><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2015\/04\/australia-immigration-camps-violence.si2_.jpg\" ><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-56541\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2015\/04\/australia-immigration-camps-violence.si2_.jpg\" alt=\"australia-immigration-camps-violence.si2\" width=\"600\" height=\"600\" srcset=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2015\/04\/australia-immigration-camps-violence.si2_.jpg 600w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2015\/04\/australia-immigration-camps-violence.si2_-150x150.jpg 150w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2015\/04\/australia-immigration-camps-violence.si2_-300x300.jpg 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><\/p>\n<p>Following the rise in violence at the Australian detention centers, the UN Special Rapporteur on Torture, Juan Mendez, examined Australia\u2019s asylum seeker policies. He reported various violations of the convention against torture and other cruel, inhuman or degrading treatment or punishment, signed 30 years ago at the UN Human Rights Council.<\/p>\n<p><em> \u201cThe Government always assures the Australian people that it complies with its international human rights obligations.
