{"id":67818,"date":"2015-12-21T12:00:11","date_gmt":"2015-12-21T12:00:11","guid":{"rendered":"https:\/\/www.transcend.org\/tms\/?p=67818"},"modified":"2015-12-21T02:10:27","modified_gmt":"2015-12-21T02:10:27","slug":"india-declares-dolphins-non-human-persons-dolphin-shows-banned","status":"publish","type":"post","link":"https:\/\/www.transcend.org\/tms\/2015\/12\/india-declares-dolphins-non-human-persons-dolphin-shows-banned\/","title":{"rendered":"India Declares Dolphins \u201cNon-Human Persons\u201d &#8211; Dolphin Shows Banned"},"content":{"rendered":"<p>India\u2019s Ministry of Environment and Forests have made a <strong>groundbreaking decision<\/strong>, to completely forbid the keeping of captive dolphins for public entertainment in the entire country.<\/p>\n<p><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2015\/12\/dolphin-animal.jpg\"  rel=\"attachment wp-att-67819\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-67819\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2015\/12\/dolphin-animal.jpg\" alt=\"dolphin animal\" width=\"662\" height=\"441\" srcset=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2015\/12\/dolphin-animal.jpg 662w, https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2015\/12\/dolphin-animal-300x200.jpg 300w\" sizes=\"auto, (max-width: 662px) 100vw, 662px\" \/><\/a><\/p>\n<p>A statement about their new policy was released Friday [30 Oct 2015], the ministry advised the state governments to deny any proposals that requested the establishment of a dolphinarium.<\/p>\n<p><em>\u201cby any person \/ persons, organizations, government agencies, private or public enterprises that involve import, the capture of cetacean species to establish for commercial entertainment, private or public exhibition and interaction purposes whatsoever.\u201d<\/em><\/p>\n<p><strong>Why did the ministry come to this decision?<\/strong><\/p>\n<p><em>The ministry elaborated their first statement with these words, <\/em><\/p>\n<p><em>\u201cWhereas cetaceans, in general, are highly intelligent and sensitive, and various scientists who have researched dolphin behavior have suggested that the unusually high intelligence; as compared to other animals means that dolphins should be seen as \u2018non-human persons\u2019 and as such should have their own specific rights and is morally unacceptable to keep them captive for entertainment purpose,\u201d the ministry said.<\/em><\/p>\n<p>For some reason <strong>back in May<\/strong>, this wonderful topic managed to evade worldwide attention including the media\u2019s. \u00a0Since the meeting of the <strong>American Association for the Advancement of Science back in 2011<\/strong>, when a group consisting of conservationists, philosophers, and animal behaviorists attempted to gain world wide support for a <strong>Declaration of Rights for Cetaceans<\/strong> from the scientific communities, to ensure the re-categorization of Cetaceans (porpoises, whales, and dolphins) as nonhuman persons have been gathering strong momentum.<\/p>\n<p><strong>The Declaration is stated below:<\/strong><\/p>\n<ol>\n<li>Every individual cetacean has the right to life.<\/li>\n<li>No cetacean should be held in captivity or servitude; be subject to cruel treatment; or be removed from their natural environment.<\/li>\n<li>All cetaceans have the right to freedom of movement and residence within their natural environment.<\/li>\n<li>No cetacean is the property of any State, corporation, human group or individual.<\/li>\n<li>Cetaceans have the right to the protection of their natural environment.<\/li>\n<li>Cetaceans have the right not to be subject to the disruption of their cultures.<\/li>\n<li>The rights, freedoms and norms set forth in this Declaration should be protected under international and domestic law.<\/li>\n<\/ol>\n<p>You might be wondering what it means to say an animal has<strong> \u201crights\u201d<\/strong>? \u00a0Here is a quick description of what that looks like,<\/p>\n<p><em>\u201cUnlike[\u2026] positive rights, such as the \u2018right\u2019 to education or health care, the animal right is, at the bottom, a right to be left alone. It does not call for the government to tax us in order to provide animals with food, shelter, and veterinary care. It only requires us to stop killing them and making them suffer.\u201d<\/em><\/p>\n<p>That seems more than reasonable enough right? \u00a0Since the intelligence of dolphins has been established for quite some time this declaration really doesn\u2019t seem to be a revolutionary move. \u00a0These beings all show signs of not only to be <strong>self-aware<\/strong> but have the capability of <strong>using tools<\/strong>, cooperating to solve different tasks, and even more recently we have discovered that they may possibly be able to <strong>communicate to one another using individual names<\/strong>.<\/p>\n<p>I believe that what this declaration does for the other sentient beings of the sea is that we are relinquishing our self-proclaimed right to become masters of other sentient beings that at some point were deemed below us. \u00a0In a perfect world, we would not use the abilities that we have gained as human beings to subjugate other beings, whether it be animal human or plant. \u00a0If we would just work together and live together as one, we would be able to solve most, if not all the issues of the world. \u00a0I believe this declaration made by India, is surely a step in the right direction.<\/p>\n<p>httpv:\/\/www.youtube.com\/watch?v=4KRD8e20fBo<\/p>\n<p>_____________________________________<\/p>\n<p><em>EWAO: Earth.
