(photo: Ryan Rodrick Beiler\/Activestills.org)<\/p><\/div>\n<p>The regulation is over 20 years old and the notice is just a reminder, the U.S. was quick to point out to journalists who scrambled to draw parallels to the European Union\u2019s settlement labeling guidelines <a target=\"_blank\" href=\"http:\/\/www.theguardian.com\/world\/2015\/nov\/11\/eu-sets-guidelines-on-labelling-products-from-israeli-settlements\" >published late last year<\/a>.<\/p>\n<p>And while there are some significant differences between the two regulations regarding settlement products, primarily that under EU rules settlement goods are ineligible for duty free import, the message is the same.<\/p>\n<p>Israel has never annexed the West Bank (save for East Jerusalem) and no country has ever recognized Israeli claims to the West Bank, East Jerusalem, the Gaza Strip or Golan Heights. Over the past two decades, however, under the cover of various peace processes, the number of Israelis living on occupied land has swelled and swelled to well past 500,000 settlers.<\/p>\n<p>Israeli leaders from <a target=\"_blank\" href=\"http:\/\/www.jpost.com\/Israel-News\/Politics-And-Diplomacy\/Herzog-calls-for-building-fences-around-West-Bank-settlement-blocs-442069\" >across the political spectrum<\/a> speak of \u201c<a target=\"_blank\" href=\"http:\/\/972mag.com\/everything-elliott-abrams-knows-about-israeli-settlements-is-wrong\/96418\/\" >consensus settlement blocs<\/a>\u201d as if there is no question that large swaths of the West Bank will remain under Israeli control forever, regardless of whether the Palestinians or anybody else consents. Ministers in the current government <a target=\"_blank\" href=\"http:\/\/www.jpost.com\/Diplomacy-and-Politics\/Bennett-Well-annex-Area-C-and-offer-the-Palestinians-autonomy-on-steroids-350790\" >openly advocate<\/a> the unilateral annexation of more than 60 percent of the West Bank.<\/p>\n<p>When it comes to Israel\u2019s economy, financial instruments, national infrastructure, natural resources, and the legal system for Israeli citizens, the Green Line \u2014\u00a0where Israel ends and Palestine begins as far as the world is concerned\u2014\u00a0no longer exists. (Oren Ziv\/Activestills.org)<\/p><\/div>\n<p>But make no mistake: the matter of settlements is far more serious and consequential than attempts to influence future borders. The very existence of Israeli settlements among the Palestinian population <a target=\"_blank\" href=\"http:\/\/972mag.com\/report-how-settlers-turn-palestinian-lands-into-illegal-outposts\/69541\/\" >directly results in myriad human rights violations<\/a>. It has created what can only be described as a system of apartheid, under which two populations living in the exact same space are subject to <a target=\"_blank\" href=\"http:\/\/972mag.com\/resource-two-legal-systems-discrimination-under-military-occupation\/100377\/\" >separate and unequal legal systems<\/a>.<\/p>\n<p>Over the past year or so, as prospects for a negotiated two-state solution have become less and less imaginable, there is a corresponding growing chorus of international actors who are no longer willing to treat Israel\u2019s settlement enterprise as business as usual.<\/p>\n<p>First there were the <a target=\"_blank\" href=\"http:\/\/972mag.com\/whats-in-the-new-eu-guidelines-regarding-activities-beyond-the-green-line\/75878\/\" >EU settlement guidelines<\/a> reiterating that all agreements with Israel are valid only west of the Green Line, then its labeling guidelines for settlement goods sold in Europe. The governments of Germany, France, Italy, Spain, the UK, and the Netherlands all <a target=\"_blank\" href=\"http:\/\/www.eccpalestine.org\/growing-number-of-european-countries-warns-their-citizens-about-the-risk-involved-in-trading-with-illegal-israeli-settlements\/\" >warned businesses based in their countries<\/a> to not engage in commercial or financial activity in Israeli settlements.<\/p>\n<p>Part of a burgeoning worldwide movement encouraging corporate social responsibility, a number of companies and investment funds, particularly in Europe, have been quietly reducing their ties with the Israeli settlement enterprise. For some, that has meant pulling out of the Israeli market almost entirely.<\/p>\n<p>Last year, +<a target=\"_blank\" href=\"http:\/\/972mag.com\/israeli-cellular-companies-paid-to-squat-on-palestinian-land\/105520\/\" >972 Magazine reported<\/a> how three Israeli cellular phone companies \u2014 including the franchisee of French-owned Orange \u2014 had been paying Israeli settlers to build cellular antennas on land the settlers stole from its rightful Palestinian owners. Earlier this month Orange announced that it is <a target=\"_blank\" href=\"http:\/\/www.reuters.com\/article\/us-orange-partner-comm-idUSKBN0UJ1GB20160105\" >ending its brand licensing agreement<\/a> in all of Israel.<\/p>\n<p>Earlier this month, <a target=\"_blank\" href=\"http:\/\/972mag.com\/airbnb-lets-you-vacation-in-illegal-west-bank-settlements\/115666\/\" >we reported<\/a> about how Airbnb allows Israeli settlers to rent their homes to unsuspecting tourists, thereby making the occupation even more profitable. The American company is now <a target=\"_blank\" href=\"https:\/\/jewishvoiceforpeace.org\/stolen-homes\/\" >the target of a campaign<\/a> demanding that it stop doing business in the settlements.<\/p>\n<p>Just last week, Human Rights Watch published a report calling on businesses to cease operating in Israeli settlements. The report, \u201c<a target=\"_blank\" href=\"https:\/\/www.hrw.org\/node\/285045\/\" >Occupation, Inc.<\/a>\u201d, aims to demonstrate how businesses operating in settlements harm Palestinians, but also how they strengthen make the occupation itself more sustainable \u2014 and profitable.<\/p>\n<p>And now the United States, which regularly expresses its opposition to Israeli settlements <a target=\"_blank\" href=\"https:\/\/www.youtube.com\/watch?v=pdrxZSr3kws\" >with measured statements<\/a> that rarely ruffle anybody anywhere, has sharpened its approach on two fronts in one week. First, Ambassador Dan Shapiro <a target=\"_blank\" href=\"http:\/\/israel.usembassy.gov\/amb01182016.html\" >said in a prominent speech<\/a> that the U.S. is \u201cperplexed\u201d by continued settlement expansion, which he said, \u201craises honest questions about Israel\u2019s long-term intentions\u201d regarding a two-state solution.<\/p>\n<p>A few days later, the U.S. <a target=\"_blank\" href=\"http:\/\/apps.cbp.gov\/csms\/viewmssg.asp?Recid=21420\" >reissued a guidance notice<\/a> on labeling products from the West Bank, which appeared to be a warning about mislabeling of Israeli settlement goods. Pushed on the issue, the <a target=\"_blank\" href=\"http:\/\/www.state.gov\/r\/pa\/prs\/dpb\/2016\/01\/251782.htm\" >State Department clarified<\/a> that as a matter of policy the United States differentiates between Israel proper and the West Bank.<\/p>\n<p>These clarifications, regulations and corporate responsibility campaigns are subtle. For the most part, they do not constitute anything new \u2014 they are almost all reiterations and reminders of long-standing policies and regulations by Israel\u2019s strongest allies. They do not deliver the shock and awe many people have come to expect from BDS, and they will have little immediate impact.
