{"id":71003,"date":"2016-03-21T13:19:54","date_gmt":"2016-03-21T13:19:54","guid":{"rendered":"https:\/\/www.transcend.org\/tms\/?p=71003"},"modified":"2016-03-21T13:19:55","modified_gmt":"2016-03-21T13:19:55","slug":"the-right-to-boycott-is-non-negotiable","status":"publish","type":"post","link":"https:\/\/www.transcend.org\/tms\/2016\/03\/the-right-to-boycott-is-non-negotiable\/","title":{"rendered":"The Right to Boycott Is Non-Negotiable"},"content":{"rendered":"<p><em><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2016\/03\/Amjad-Iraqi.png\"  rel=\"attachment wp-att-71007\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-thumbnail wp-image-71007\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2016\/03\/Amjad-Iraqi-150x150.png\" alt=\"Amjad Iraqi\" width=\"150\" height=\"150\" \/><\/a>Regardless of one\u2019s views of BDS, it is ridiculous that one should have to tell self-proclaimed \u2018democracies\u2019 that the right to boycott is a basic civil right, not a punishable crime.\u00a0<\/em><\/p>\n<p>Last week, over 120 people <a target=\"_blank\" href=\"http:\/\/mondoweiss.net\/2016\/03\/emerging-from-a-reign-of-terror-palestinians-in-israel-hold-first-bds-conference\/\" >attended a conference in Nazareth<\/a> on the subject of \u201cBDS (Boycott, Divestment and Sanctions) and \u201848 Palestinians (citizens living inside Israel\u2019s 1948 borders).\u201d Although the discussions were lively, many participants were cautious with their choice of words: Israel\u2019s Anti-Boycott Law \u2013 which <a target=\"_blank\" href=\"http:\/\/972mag.com\/high-court-upholds-controversial-boycott-law\/105528\/\" >allows groups and citizens to be sued<\/a> for calling for a boycott of Israeli institutions, including settlements \u2013 cast a heavy shadow over the event.<\/p>\n<p>The anxiety of discussing the subject of boycott would have seemed an implausible scenario a decade ago. Boycotts, we always learned, are a legitimate method of political expression, praised in our history books and modern politics as an example of how nonviolence can be more powerful, moral, and strategic in advancing human rights struggles around the world.<\/p>\n<p>Now, in a corrupt twist, the very countries that purport to uphold civil rights have become the main forces undermining them. In recent months (and years), governments and local authorities in the USA, France, the UK, and others have advanced new laws, administrative decisions, and behind-the-scenes pressures to stem the rising tide of BDS activities \u2013 simply because they are being applied against Israel. This transnational counter-movement, as Glenn Greenwald and Andrew Fishman <a target=\"_blank\" href=\"https:\/\/theintercept.com\/2016\/02\/16\/greatest-threat-to-free-speech-in-the-west-criminalizing-activism-against-israeli-occupation\/\" >recently detailed in the Intercept<\/a>, is part of a \u201cvery coordinated and well-financed campaign\u201d to censor BDS \u2013 and \u201cit is succeeding.\u201d<\/p>\n<div id=\"attachment_71004\" style=\"width: 610px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2016\/03\/openhillel-531x354-israel-bds-palestine.jpg\"  rel=\"attachment wp-att-71004\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-71004\" class=\"wp-image-71004\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2016\/03\/openhillel-531x354-israel-bds-palestine.jpg\" alt=\"Participants in the Open Hillel Conference, Harvard. (photo: Gili Getz)<\/p><\/div>\n<p>The political backlash to BDS was always expected; similar attacks by state authorities had targeted the boycott movements in the Jim Crow south and against apartheid South Africa. What is shocking, however, is not only the extent to which authorities are working to crush today\u2019s BDS movement, but the use of legal measures to restrict or fully silence boycott activities against Israel. <a target=\"_blank\" href=\"https:\/\/theintercept.com\/2016\/02\/16\/greatest-threat-to-free-speech-in-the-west-criminalizing-activism-against-israeli-occupation\/\" >These include<\/a> criminal convictions of BDS activists in France; the threat of penalties against local councils in the UK that boycott Israeli goods; and new regulations that will fully incorporate West Bank settlements into the US\u2019s trade with Israel, among others.<\/p>\n<p>The authorities\u2019 manipulation of legal tactics against BDS has severely compromised citizens\u2019 rights. When the Israeli Supreme Court upheld the Anti-Boycott Law last year in a 5-4 ruling, the majority of justices departed from technical arguments and <a target=\"_blank\" href=\"http:\/\/972mag.com\/high-court-on-bds-somewhere-between-terror-and-holocaust-denial\/105656\/\" >openly endorsed the law\u2019s political goals<\/a>. One justice wrote that boycott could be a form of \u201cpolitical terror;\u201d another wrote that BDS should stand for \u201cBigoted, Dishonest and Shameful;\u201d and a third wrote that \u201cThere is nothing wrong in anchoring laws passed by the Knesset in the struggle against those who wish to destroy us.\u201d Far from defending freedom of expression, the court willingly gave the green light to deny Israeli citizens a basic tool to <a target=\"_blank\" href=\"http:\/\/972mag.com\/you-can-boycott-anything-in-israel-except-the-occupation\/105600\/\" >challenge the state\u2019s occupation and discriminatory policies<\/a>.<\/p>\n<div id=\"attachment_71005\" style=\"width: 541px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2016\/03\/bds-wall-531x354-israel-palestine.jpg\"  rel=\"attachment wp-att-71005\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-71005\" class=\"size-full wp-image-71005\" src=\"https:\/\/www.transcend.org\/tms\/wp-content\/uploads\/2016\/03\/bds-wall-531x354-israel-palestine.jpg\" alt=\"BDS graffiti on Israeli separation wall, Bethlehem, West Bank, June 17, 2014. (Photo by Ryan Rodrick Beiler\/Activestills.org)<\/p><\/div>\n<p>These legal crackdowns point to the success of Israel and its supporters in <a target=\"_blank\" href=\"http:\/\/972mag.com\/israels-war-on-bds-misses-the-point\/107343\/\" >portraying boycott as an immoral act<\/a>: that to support boycott is to be anti-Israel (and anti-Semitic), and to undermine the advancement of peace. This view, of course, is grossly misguided. Boycotts are <a target=\"_blank\" href=\"http:\/\/972mag.com\/bdss-jewish-roots-a-lesson-for-hillel\/89209\/\" >supported by Jews too<\/a> \u2013 including inside Israel, where many left-wing academics, artists, and figures have expressed their opposition to working in the settlements. Globally, Jewish groups and activists are <a target=\"_blank\" href=\"http:\/\/972mag.com\/four-things-every-israeli-needs-to-know-about-jewish-bds-activists\/109395\/\" >among the leading proponents of BDS<\/a>. Boycott supporters, even Palestinian ones, vary in their preferred targets for boycotts, which can range from specific companies and officials, to settlement products only, to blanket boycotts of the state. Moreover, BDS is arguably the only movement that is <a target=\"_blank\" href=\"http:\/\/972mag.com\/interview-the-man-behind-the-bds-movement\/107771\/\" >altering the conflict\u2019s worsening status quo<\/a>, at a time when political actors are either deliberately or inadvertently preserving it.<\/p>\n<p>It is true that there are some pro-BDS groups and individuals who abuse their rights for politically ignorant and sometimes racist reasons. But that is hardly the majority of BDS supporters (which itself is a diverse and decentralized movement), and is certainly not a justification for trying to suppress the right to boycott for millions of people, as is now becoming the case. Regardless of one\u2019s views of BDS, it is ridiculous that one should have to tell the governments and courts of self-proclaimed \u201cdemocracies\u201d that the right to boycott is a non-negotiable civil right, not a punishable crime.
